Mayor Pro Tern Mouton led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Pro Tern Mouton, Councilmembers Jordan, Getz, Sam, Pate and Samuel. Absent: Mayor Ames. Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda None CONSENT AGENDA * Approval of minutes — March 27, 2018 * Confirmation of committee appointments — None Minutes — April 10, 2018 A) Approve the purchase of EMS billing software from ESO Solutions of Austin for use in the Emergency Medical Services and Central Collections Divisions — Resolution 18-074 B) Authorize the City Manager to execute Change Order No. 2 to the contract with Brystar Contracting, Inc. for work done on Harrison Avenue and 14th Street — Resolution 18-075 C) Approve a contract with The Examiner for the publication of various City legal notices — Resolution 18-076 D) Authorize the City Manager to apply for and accept funding through Entergy's Open Grants Program — Resolution 18-077 E) Authorize the City Manager to enter into a Memorandum of Understanding related to the transportation planning process often required when receiving state and federal transportation funds — Resolution 18-078 F) Authorize the City Manager to accept seized vehicles awarded to the City of Beaumont — Resolution 18-079 G) Approve a resolution accepting maintenance of sewer line improvements that serve two lots on Braeburn Lane — Resolution 18-080 Councilmember Pate moved to approve the Consent Agenda. Consider a resolution authorizing the City Manager to award a bid to Allco, LLC of Beaumont for the Wastewater Treatment Plant Sludge Dewatering Improvements Phase 1 — Belt Press Project. The project will install an additional Dewatering Unit including associated pumps, controls, and site developments. On Thursday, March 29, 2018, bids were solicited for furnishing all labor, materials, equipment, and supplies for the project. Two (2) bids were received as follows: Contractor Location Total Base Bid Total Award Amount Allco, LLC Beaumont, TX $ 858,935.00 $ 858,935.00 Placo, LTD Lumberton, TX $1,005,800.00 $1,005,800.00 Engineers Estimate $11079,000.00 Minutes -April 10, 2018 On April 3, 2018, the City's engineering consultant, Schaumburg & Polk, Inc., of Beaumont, provided the City with a letter recommending award to Allco, LLC for the Total Base Bid. Water Utilities is in agreement with the consultant's recommendation. A total of 270 calendar days are allocated for completion of the project. Funds will come from the Capital Program. Approval of resolution. Councilmember Jordan moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO ALLCO, LLC, OF BEAUMONT, TEXAS, IN THE AMOUNT OF $858,935.00 TO FURNISH ALL LABOR, MATERIALS, EQUIPMENT, AND SUPPLIES FOR THE WASTEWATER TREATMENT SLUDGE DEWATERING IMPROVEMENTS PHASE I — BELT PRESS PROJECT AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTACT WITH ALLCO, LLC., OF BEAUMONT, TEXAS. Councilmember Sam seconded the motion. AYES: MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 18-072 2. Consider an ordinance authorizing the suspension of the effective date of CenterPoint Energy's proposed rate increase until July 11, 2018. On March 29, 2018, CenterPoint Energy ("CenterPoint") filed with the City of Beaumont an annual Gas Reliability Infrastructure Program (GRIP) interim rate adjustment notice to increase gas rates in the Beaumont/East Texas Division Service area. The City of Beaumont maintains exclusive original jurisdiction over the rates, operations and services of CenterPoint as a gas utility operating in the City of Beaumont. The requested increase would ordinarily go into effect sixty (60) days after giving notice of the intent to increase rates. This ordinance is a request to suspend the effective date of CenterPoint's proposed rate increase for a period of forty-five (45) days until July 11, 2018, in order to review the company's filings for compliance with the Gas Utility Regulatory Act and the company's last base rate case. The review of the company's GRIP filing is limited to a ministerial review of the filings for compliance with the ACT. All reasonable expenses associated with rate cases are reimbursable by the company. Approval of the Ordinance. Councilmember Sam moved to ADOPT AN ORDINANCE OF THE CITY OF BEAUMONT, TEXAS, SUSPENDING THE RATES PROPOSED BY CENTERPOINT ENERGY RESOURCES CORP., D/B/A CENTERPOINT ENTERGY ENTEX AND CENTERPOINT ENERGY TEXAS GAS ("CENTERPOINT" OR "COMPANY") COMPANY'S GAS RELIABILITY INFRASTRUCTURE PROGRAM ("GRIP") FILING MADE WITH THE CITY ON MARCH 29, 2018; FINDING THAT THE MEETING COMPLIES WITH THE OPEN MEETINGS ACT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT, AND DECLARING AN Minutes — April 10, 2018 EFFECTIVE DATE. AYES: MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Ordinance 18-015 PUBLIC HEARING Receive comments related to the Local Provider Participation Fund for FY 2018 Open — 1:52 p.m. None Close — 1:53 p.m. 3. Consider setting the mandatory payment rate related to the Local Provider Participation Fund for FY 2018. On June 9, 2015, the City Council authorized the City's participation in a municipal health care provider participation program to support the payment of Medicaid supplemental hospital payments to Safety -Net Hospitals in the City. At the same time, the City Council authorized the execution of indigent care affiliation agreements with Baptist Hospitals of Southeast Texas and Christus Hospital. In addition, on July 28, 2015, the City Council approved model rules and procedures related to the City of Beaumont's facilitation of the program. The City of Beaumont is required to set the amount of the mandatory payments required to be paid by the hospitals. The mandatory payment must be uniformly proportionate with the amount of net patient revenue generated by each paying hospital in the municipality. The mandatory rate for the fiscal year ending 2018 will be 3.84%. - Local Safety -Net Hospitals will make mandatory payments into the Beaumont Municipal Health Care Provider Participation Fund. Approval of resolution. Councilmember Samuel moved to APPROVE A RESOLUTION SETTING THE MANDATORY PAYMENT RATE FOR THE FISCAL YEAR 2018 FOR THE LOCAL PROVIDER PARTICIPATION FUND IN THE MUNICIPAL HEALTH CARE PROVIDER PARTICIPATION PROGRAM. Beaumont TX Stated that he lives in the Amelia neighborhood, he and his neighbors are plagued with the issue that every time it rains their plumbing stops working and in some cases the sewer backs up into their homes, the City has come out and has assured them that as soon as the main line drains all will be well, that hasn't been the case, in his household alone they haven't been able to flush the toilets properly since last year, he has also had to have a plumber come out who has stated that the issue is on the City's side, his neighbors also have had sewer back up in their bath tubs, stated that this is an issue that has been going on for quite some time and they are really in need of some help, stated that they can't live this way anymore, asked the City for help Mike Mahood P.O. Box 20572 Beaumont TX Commented about a news story that aired on yesterday's news regarding raw sewage running on the ground in an area in Old Town, stated that the situation was to be treated as an emergency and an immediate health issue, it is to be dealt with as a violation of EPA Regulations, City Codes etc., made comments on infrastructure projects such as drainage boxes on MLK and Calder, also has noticed that the street sweeping program has been curtailed, it needs to be reinstated, the drains need to be swept and cleaned due to debris, all drainage boxes need to be inspected on a regular basis to make sure that debris isn't clogging the boxes so that water can drain properly Orenthal Augustine 153 Orgain St. Beaumont TX Stated that on Saturday morning at about 10:00 a.m., his home was flooded by sewer water and lost everything, commented on poor piping in the neighborhoods and the Minutes—April 10, 2018 fact that they all need to be replaced, also commented on the equipment that the City uses as well as the City replacing piping that doesn't need to be replaced in certain areas of the City Eric Bender 27701 H 10 E Beaumont TX Spoke regarding the Southeast Hike and Bike Coalition that was founded in 2004, stated that lanes are too narrow, signs and share roads are too few and sidewalks are too dangerous, commented on Washington Blvd. and Harrison on 1 10 don't have bicycles lanes and both are newly reconstructed, the leadership and policies need to be changed, it needs to state that all roads of transportation are accommodated, all lanes must be wider to share with bicycles and vehicles Dayna Rothenberger 3890 E.
