HomeMy WebLinkAboutORD 18-019ORDINANCE NO. 18-019 ENTITLED AN ORDINANCE AMENDING CHAPTER 4, ARTICLE 4.04, SECTION 4.04.003 AND CHAPTER 4, ARTICLE 4.09, SECTION 4.09.0019(k) OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS TO MAKE CHANGES RELATING TO RABIES VACCINATION AND ANIMAL CARE FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. THAT Chapter 4, Article 4.04, Section 4.04.003 of the Code of Ordinances of the City of Beaumont, be and the same is hereby amended to read as follows: Sec. 4.04.003 Vaccination Every owner of a dog, cat or ferret -shall have the animal vaccinated against rabies by four (4) months of age. The animal must receive a booster within the twelve (12) month interval following the initial vaccination and then must be revaccinated against rabies once every three (3) years by a veterinarian duly licensed to practice in the state. There shall be a fee charged for vaccinations administered at the city animal care facility as provided for in section 4.09.001. Any person moving into .the city shall comply with this section within thirty (30) days after relocation. To prevent improper vaccination of animals against and the accidental exposure of humans to rabies, killed virus rabies vaccine for animals shall be administered only by or under the direct supervision of a veterinarian who is licensed to practice in the state. Section 2. THAT Chapter 4, Article 4.09, Section 4.09.001(k) of the Code of Ordinances of the City of Beaumont, be and the same is hereby amended to read as follows: Sec. 4.09.001 Fees (k) Adoption fees: (1) Unaltered adult animals: (A) Cats: $100.00. (B) Dogs: $130.00. (2) Altered or underage animals: (A) Cats: $40.00. (B) Dogs: $60.00. (3) Adoption fees may be waived or modified at the discretion of the city manager. Section 3. That if any section, subsection, sentence, clause of phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to suchend, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Car4inn r% That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1.01.009 of the Code or Ordinance of Beaumont, Texas. The meeting at which this ordinance was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
