Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on February 20, 2018, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item. No. 1/Consent Agenda * Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Rodney Graves with McCabe Roberts Avenue United Methodist Church gave the invocation. Beaumont Police Officer Nick Thompson led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Councilmembers Jordan, Getz, Pate, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions None Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda J None CONSENT AGENDA * Approval of minutes — February 13, 2018 * Confirmation of committee appointments — None A) Approve an annual contract with Republic Services for the pickup of refuse containers at various City facilities — Resolution 18-037 Minutes — February 20, 2018 B) Approve a resolution terminating a consignment agreement with Games People Play at the Henry Homberg Golf Course — Resolution 18-038 C) Authorize the acceptance of a ten -foot wide Exclusive Water Line Easement located at 4453-4489 Old Dowlen Road — Resolution 18-039 D) Authorize the settlement of the claim of Emerald Thomas, Individually and as Next Friend of Trentin Thomas, Jr., A Minor — Resolution 18-040 E) Authorize the settlement of the claim of David Pouncy, Individually and on Behalf of the estate of Nancy Pouncy, Deceased — Resolution 18-041 Councilmember Jordan moved to approve the Consent Agenda. Councilmember Getz seconded the motion. AYES: MAYORAMES, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUELAND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider amending Section 22.05.211. of the Code of Ordinances related to garbage and trash rates. The Code of Ordinances currently has a monthly garbage and trash collection fee of $17.00. There is also a litter removal fee of $0.50 per unit per month for single-family residential units and $0.25 per unit per month for multifamily dwellings of two or more units. The Administration proposes that the monthly garbage and trash collection fee of $17.00 be increased to $18.25 and the litter removal fees be eliminated. The net increase to a residential customer would be $0.75 per month or $9.00 per year. The last increase approved by the City Council was in October of 2015. The proposed changes would provide an estimated $290,000 in additional annual revenue that will be used for trash removal services throughout thecity and along Interstate 10 and Highway 69 through the city limits of Beaumont. The above changes simplify the Code of Ordinances and will allow the Administration to move forward with trash removal along Interstate 10 and Highway 69 through the city limits of Beaumont as discussed in a work session with the City Council. In the annual operating budget, funds are transferred each year from the Solid Waste Fund to the General Fund as allowed by the City Charter. The cost of mowing along Interstate 10 and Highway 69 will be paid for from the annual transfer. Councilmember Pate moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 22, ARTICLE 22.05, SECTION 22.05.211 (13)(1)(A) AND REPEALING CHAPTER 22, ARTICLE 22.05, SECTION 22.05.211 (13)(1)(C) OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS TO MAKE CHANGES RELATING TO GARBAGE AND TRASH RATES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Jordan seconded the motion. Major Dr. Beaumont TX Made comments regarding a Police Officer Mansor who is now retired and a family that needed help, offered condolences from his family to the .family of Mayor Pro Tem, Gethrel Williams -Wright family, said that she was a force to be reckoned with, stated that our life is but a vapor, we are here for a moment and then we are gone, God Bless the memory of Gethrel Wright our Councilmember At -Large Kelly Kays 2396 Dowlen Beaumont TX Stated that she's a veterinarian in the City of Beaumont and the City's veterinarian, gave an update regarding the animal shelter, stated that since she's taken over she has personally purchased a shuttle bus in 2017, hired a full-time person to assist her in the shelter and in the marketing and transporting of the animals, 800 more lives were saved in 2017 than in 2016, commented on the Spade and Neuter Grant the City received, as well as the no kill procedure Eric Bender 2770 1 H 10 E Beaumont TX Commented on bicycle lanes on Magnolia, as well as a conversation he had with a lady on Orleans regarding filling out a card regarding better bicycle facilities in South East Texas James Levine 735 Prairie Beaumont TX Thanked Council for all that they are doing and have done, stated that he does view the Council meeting on television, stated that they all are doing a fine job, he wanted to come and speak to Ms. Wright who is no longer with us, he enjoyed listening to her comments, thanked the Mayor and City Manager for not leaving during Harvey and everyone else that stayed while the storm was going on Mary Jane Shaw 2025 Milam Beaumont TX Stated that she is still living here in Beaumont as she is displaced from Houston, she commented on her issues of arrest, causing havoc in the City but stated that she has changed, said she could blame other people but she can only blame herself for the decisions Minutes — February 20, 2018 that she made for herself, she was asked to come to Council to speak about the homeless and homeless women in the community and the trash issue Mary Nixon 3850 Roland Beaumont TX Stated that she still has concerns regarding the .trash in the City as well as in the `neighborhoods, she is of the mind set of Council that if TxDOT doesn't do the job then we as a city needs to do something, also dealing with the problem of trash in the ditches in her area and that keeps the ditches full of water, made comments about raising tax dollars as well as enforcement with code enforcement laws and talking with the judges to enforce the laws that are already on the books, wants Beaumont to look beautiful, stated that Mayor Pro Tem Wright will be truly missed, she was to be honored at the Deliver the Difference Luncheon that will be held in May, Mayor Pro Tem Wright will still be honored if anyone is interested in attended Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER MOUTON - NONE COUNCILMEMBER SAMUEL - CONDOLENCES TO THE FAMILY OF MAYOR PRO TEM WRIGHT COUNCILMEMBER PATE - APPRECIATE KELLY KAYS AND HER FRIENDS FOR ATTENDING THE MEETING ON TODAY, ANYTHING THAT CAN BE DONE TO FURTHER HELP ENCOURAGED HER TO LET COUNCIL KNOW, ASKED THAT EVERYONE KEEP MAYOR PRO TEM WRIGHT'S FAMILY IN THEIR PRAYERS, HE KNOWS WHERE GET IS BECAUSE SHE KNOWS WHERE SHE WAS GOING COUNCILMEMBER GETZ - ANNOUNCED THE DOWLEN/WEST NEIGHBORHOOD ASSOCIATION, ON TUESDAY, FEBRUARY 20, 2018, AT MILLER LIBRARY, ENCOURAGED EVERYONE TO GO OUT AND VOTE COUNCILMEMBER JORDAN - MADE COMMENTS REGARDING MAYOR PRO TEM WRIGHT AND THE MILK PARADE, STATED HOW PROUD SHE WAS OF DR.
