BACKGROUND Refuse container and collection services are required at forty (40) sites throughout the City. The size of refuse containers required range from two to ten cubic yards, and the collection frequency rates range from one to four per week. Bids were requested from five vendors; four responded. The lowest qualified bid with an estimated annual cost of $85,962.84 was received from Republic Services. This represents an approximate two percent (2%) increase over the previous three year contract. Specifications allow for a twelve (12) month contract with the option of two renewals of twelve (12) month terms at the same pricing as the awarded contract and state the size, location, and frequency of collection currently under contract. Also, they allow the City to add or delete containers and change locations or container sizes as needed. The bid also requested monthly rates for additional containers on an as needed basis such as special events or cleanup following a hurricane. Republic Services has the current contract. Bid tabulation is attached. FUNDING SOURCE In fiscal year 2017, the General Fund incurred 90% of the cost and the other 10% was incurred by six other funds. RECOMMENDATION Approval of the resolution. WHEREAS, bids were solicited for an annual contract, with the option to renew for two (2) additional twelve (12) month terms, for container and solid waste collections; and, WHEREAS, Republic Services, of Beaumont, Texas, submitted a bid in the amount of $85,962.84; and, WHEREAS, City Council is of the opinion that the bid submitted by Republic Services is the lowest bid providing the best value to the City and should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the bid submitted by Republic Services, of Beaumont, Texas, for an annual contract, with the option to renew for two (2) additional twelve. (12) month terms, in the amount of $85,962.84 for container and solid waste collections at forty (40) City facilities be accepted by the City of Beaumont; and, BE IT FURTHER RESOLVED THAT the City Manager is authorized to execute a contract with Republic Services, of Beaumont, Texas, in the amount of $85,962.84 for the purposes described herein. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. BACKGROUND On November 8, 2016, Council approved Resolution 16-225 for a two (2) year consignment agreement with Games People Play for the sale of golf merchandise at the golf pro shop located at the Henry Homberg Golf Course. Games People Play has been providing a service at this location for over four years; however, they are changing their company structure and will no longer provide this service. Moving forward, golf course staff will manage the merchandise internally. The agreement allows for the termination of the contract for any reason after receipt of 30 days notice. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of the resolution. RESOLUTION NO. WHEREAS, on November 8, 2016, the City Council of the City of Beaumont, Texas adopted Resolution No. 16-225 approving a two (2) year Consignment Agreement between the City of Beaumont and Games People Play for the sale of golf merchandise at the golf pro shop located at Henry Homberg Golf Course; and, WHEREAS, Games People Pay is changing its company structure and the City of Beaumont will no longer be able to partner with them; and, WHEREAS, the Consignment Agreement allows termination of the contract, with or without cause, upon providing a thirty (30) day written notice to the other party; and, WHEREAS, Games People Play has agreed to terminate the agreement upon receipt of a thirty (30) day written notice from the City of Beaumont; and, WHEREAS, the City Council is of the opinion that it is in the best interest of the City of Beaumont to terminate the Consignment Agreement with Games People Play for the sale of golf merchandise at the golf pro shop located at Henry Homberg Golf Course; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the City Manager is hereby authorized to give thirty (30) days written notice to Games People Play to terminate the Consignment Agreement; and, BE IT FURTHER RESOLVED THAT the Consignment Agreement with Games People Play for the sale of golf merchandise at the golf prop shop located at Henry Homberg Golf Course is hereby terminated upon the giving of sufficient notice. BACKGROUND Old Dowlen Cottages Apartments, LP has agreed to convey a ten foot (10') wide exclusive Water Line Easement to the City of Beaumont. The easement is described as being a 0.4900 acre of land situated in the Wesley Dykes Survey, Abstract No. 17, Jefferson County, Texas. The water line easement is for the development of a new apartment complex located at 4453-4489 Old Dowlen Road. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of the resolution. RESOLUTION NO. WHEREAS, Old Dowlen Cottages Apartments, LP has agreed to convey one (1) ten foot (10') wide exclusive water line easement, said easement being a 0.4900 acre of land situated in the Wesley Dykes Survey, Abstract No. 17, Jefferson County, Texas as described and shown in Exhibit "1," attached hereto, to the City of Beaumont for new development of cottages located at 4453-4489 Old Dowlen Road; and, WHEREAS, the City Council has considered the purpose of said conveyance and is of the opinion that the acceptance of said conveyance is necessary and desirable and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT one (1) ten foot (10') wide exclusive water line easement conveyed by Old Dowlen Cottages Apartments, LP, being a 0.4900 acre of land situated in the Wesley Dykes Survey, Abstract No. 17, Jefferson County, Texas as described and shown in Exhibit "1," attached hereto, be and the same is hereby, in all things, accepted for the stated purposes. BACKGROUND The Code of Ordinances currently has a monthly garbage and trash collection fee of $17.00. There is also a litter removal fee of $0.50 per unit per month for single-family residential units and $0.25 per unit per month for multifamily dwellings of two or more units. The Administration proposes that the monthly garbage and trash collection fee of $17.00 be increased to $18.25 and the litter removal fees be eliminated. The net increase to a residential customer would be $0.75 per month or $9.00 per year. The last increase approved by the City Council was in October of 2015. The proposed changes would provide an estimated $290,000 in additional annual revenue that will be used for trash removal services throughout the city and along Interstate 10 and Highway 69 through the city limits of Beaumont. RECOMMENDATION The above changes simplify the Code of Ordinances and will allow the Administration to move forward with trash removal along Interstate 10 and Highway 69 through the city limits of Beaumont as discussed in a work session with the City Council. In the annual operating budget, funds are transferred each year from the Solid Waste Fund to the General Fund as allowed by the City Charter. The cost of mowing along Interstate 10 and Highway 69 will be paid for from the annual transfer. Page 1 of 1 b) Garbage and trash rates. No rate adjustment will be made for temporary nonuse of service. Nonpayment of the collection services fee shall be sufficient grounds for discontinuance of city water service. The rate for collection outside the city limits shall be one hundred fifty (15 0) percent of the rate established for service inside the city limits. No type of service will be offered residences exempted under section 22.05.007(c) or for vacant lots except as provided in section 22.05.062. If a business is located in a part of a residence, a collection services fee shall be charged for each connection to the city's water system. The following monthly rates apply for collection services: (1) The monthly rates for standard collection services shall consist of the following elements: (A) Garbage and trash collection: $44.-9@- f (g, A 10% discount to the garbage and trash collection fee shall apply to customers residing in single-family residences who are sixty-five (65) years of age or older. To obtain the senior citizen garbage and trash collection rate, eligible persons must file a sworn application on a form provided therefor with the central collections division. The rate shall remain in effect so long as the customer residing in the single-family residence is sixty-five (65) years of age or older. (B) Additional containers: A one-time $20.00 prep and delivery fee for each additional container obtained. The monthly fee for each additional container is three dollars and seventy-five cents ($3.75) per month. (2) A reconnect container fee will be assessed for those households whose garbage container(s) have been collected by the city due to the removal of a water meter as a result of nonpayment of city water and/or garbage services, and then subsequently reissued upon payment and reinstallation of the meter. (A) Reconnect container fee: $20.00 per container. (c) Recycling_ service. Citizens participating in curbside recycling shall pay the fees listed below. (1) The rates to be charged for curbside recycling shall consist of the following: (A) A recycling container service fee of fifty-eight dollars ($58.00) per container. The container is to remain the property of the city. (B) A recycling fee of eleven dollars and fifty cents ($11.50) per month. (2) Recyclable materials will only be collected if they are placed inside the recycling container. (3) Recycling containers must be placed on the curbside for them to be collected by the city. THAT Chapter 22, Article 22.05, Section 22.05.211(b)(1)(A) of the Code of Ordinances of the City of Beaumont, be and the same is hereby amended to read as follows: (A) Garbage and trash collection: $18.25. A 10% discount to the garbage and trash collection fee shall apply to customers residing in single-family residences who are sixty-five (65) years of age or older. The rate shall remain in effect so long as the customer residing in the single-family residence is sixty-five (65) years of age or older. Section 2. THAT Chapter 22, Article 22.05, Section 22.05.21(b)(1)(C) of the Code of Ordinances of the City of Beaumont, be and the same is hereby repealed. Section 3. That if any section, subsection, sentence, clause of phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished, as provided in Section 1.01.009 of the Code or Ordinance of Beaumont, Texas.
