Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on January 9, 2018, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1-4/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor John C. McKinney Sr., gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Wright, Councilmembers Jordan, Getz, Pate, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions "Presentation of certificate of Appreciation to Sacred Heart University" - Twenty undergraduate students from Fairfield, Connecticut were presented with a certificate of appreciation for helping to rebuild homes impacted by Hurricane Harvey in the City of Beaumont. Accepting the certificate was Karreem A. Mebane, Director of the Volunteer Programs and Service Learning for the University, he also introduced the students and adult counselors that accompanied the undergraduates. Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Public Comment: Persons may speak on scheduled agenda items 1-4/Consent Agenda None CONSENT AGENDA Minutes — January 9, 2017 * Approval of minutes – December 19, 2017 * Confirmation of committee appointments – None A. Approve an annual contract with Piney Woods Sanitation, Inc. for the pickup of refuse containers at various City facilities – This Item was Pulled B. Approve a proposal submitted by Air Comfort, Inc. to replace air handler No. 5 at the Police Department Facility located at 255 College Street – Resolution 18-001 C. Approve the purchase of 36 tablet computers from DELL for use in the Police Department– Resolution 18-002 D. Approve the City of Beaumont Investment Policy —Resolution 18-003 E. Authorize the City Manager, or his designee, to reenter into a Cooperative Working Agreement with the Rape and Suicide Crisis Center of Southeast Texas, Inc. – Resolution 18-004 F. Authorize the City Manager to execute all documents necessary for a Rollover Agreement between the City of Beaumont and City Ambulance Service – Resolution 18-005 G. Authorize the City Manager to apply for and receive funding through U.S. Department of Homeland Security, 2018 Emergency Management Performance Grant program – Resolution 18-006 H. Approve a resolution appointing members to the Beaumont Youth Advisory Council – Resolution 18-007 Councilmember Pate moved to approve the Consent Agenda excluding Item A. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution authorizing an agreement with Jeffrey S. Ward and Associates for property acquisition consultation services. Jeffrey S. Ward and Associates (JSW) will assist the City in applying for and administering grants related to flood buyouts and/or the elevation of houses damaged by Hurricane Harvey. A Request for Proposal was solicited from seven (7) vendors. Four (4) responses were received and evaluated by City staff. Minutes — January 9, 2017 Community Development Block Grant funds or General Fund. Approval of the resolution. Councilmember Jordan moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH JEFFERY S. WARD AND ASSOCIATES FOR PROPERTY ACQUISITION SERVICES RELATED TO FLOOD BUYOUTS AND/OR THE ELEVATION OF HOUSES DAMAGED BY HURRICANE HARVEY. Mayor Pro Tem Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 18-008 2. Consider a resolution authorizing the City Manager to award a bid to Horseshoe Construction, Inc., of La Porte for the Amelia Area Pipe Bursting Contract - Section I Project. This project will provide the replacement of designated pipe segments by means of pipe bursting and replacing manholes in the Amelia Area. On December 21, 2017, bids were solicited for furnishing all labor, materials, equipment, and supplies for the project. The Water Utilities Engineer recommends awarding the project to Horseshoe Construction, Inc., the second low bidder, in the amount of $744,379.00. Funds will come from the Capital Program. Approval of resolution. Minutes — January 9, 2017 Councilmember Getz moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO HORSESHOE CONSTRUCTION, INC., OF LA PORTE, TEXAS, IN THE AMOUNT OF $744,379.00 TO FURNISH ALL LABOR, MATERIALS, EQUIPMENT, AND SUPPLIES FOR THE AMELIA AREA PIPE BURSTING CONTRACT SECTION 1 PROJECT AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH HORSESHOE CONSTRUCTIONS, INC., OF LA PORTE, TEXAS. Councilmember Jordan seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 18-009 3. Consider a resolution approving a contract with Lockwood, Andrews and Newman Inc. for Grant Management and Engineering Services related to Riverfront Park. Lockwood, Andrews and Newman Inc. (LAN) will provide consulting services for disaster recovery, alternative funding pursuits, grant management and engineering services to address damages incurred to Riverfront Park during Hurricane Harvey. LAN will work with the Corps of Engineers and other agencies to determine the most efficient way to stabilize the Riverfront bank and, if possible, find funds to engineer and recapture the land that was lost due to Harvey. A Request for Qualifications was solicited from ten (10) vendors. Five (5) responses were received and evaluated by City staff. Ninety percent (90%) of the fees will be covered by FEMA. The remaining fees will be funded by other grants, if applicable, or the Capital Program. Approval of the resolution. Councilmember Pate moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH LOCKWOOD, ANDREWS AND NEWMAN, INC. (LAN) FOR GRANT MANAGEMENT AND ENGINEERING SERVICES TO ADDRESS DAMAGES INCURRED DURING HURRICANE HARVEY. Councilmember Jordan seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 18-010 Minutes — January 9, 2017 4. Consider a resolution authorizing Beaumont Retreat W, LP to submit an application to the Texas Department of Housing and Community Affairs for a proposed Housing Tax Credit project known as the Retreat West Beaumont, located in the 5900 Block of College Street, as well as offering expressed support for the project. Beaumont Retreat W, LP is requesting authorization to submit an application to the Texas Department of Housing and Community Affairs (TDHCA) for use of Housing Tax Credit (HTC) funds for the construction of a one hundred -ten (110) unit senior housing development located in the 5900 Block of College Street. Seventy-seven (77) units would be affordable and thirty-three (33) would be market rate units. Currently, Beaumont has more than twice the state average of housing units supported by Tax Credits or private activity bonds per capita. As such, additional subsidized ,units could not be considered for this program by TDHCA unless the City acknowledges that Beaumont has more than twice the state average of subsidized housing units per capita as outlined in §11.3(b) of the Qualified Allocation Plan (QAP). In addition, this resolution would approve the construction of the development and authorize an allocation of Housing Tax Credits pursuant to Tex. Gov't Code §2306.6703(a)(4). Also, applications that receive a Commitment .of Development Funding in the amount of at least $500 in the form of a loan, grant or reduced fees will receive additional consideration by TDHCA. Finally, the applicant has requested that the City offer exclusive support for this project within the Urban Region Five funding pool. This item is being requested for consideration by Councilmembers W.L. Pate and Virginia Jordan. Councilmember Jordan moved to APPROVE A RESOLUTION THAT THE CITY OF BEAUMONT HEREBY SUPPORTS THE PROPOSED NEW BEAUMONT RETREAT W, LP DEVELOPMENT, AND CONFIRMS THAT ITS GOVERNING BODY HAS VOTED SPECIFICALLY TO APPROVE THE CONSTRUCTION AND OF THE RETREAT WEST BEAUMONT ELDERLY LIMITATION APARTMENT DEVELOPMENT AND TO AUTHORIZE AN ALLOCATION OF HOUSING TAX CREDITS FOR THIS DEVELOPMENT PURSUANT TO TEX. GOVT CODE §2306.6703(A)(4), AND THAT THE CITY OF BEAUMONT, TX ACTING THROUGH ITS GOVERNING BODY, HEREBY CONFIRMS THAT IT IS EXCLUSIVELY SUPPORTING IN THE TDHCA 2018 COMPETITIVE TAX CREDIT APPLICATION CYCLE IN THE URBAN REGION 5 FUNDING POOL, THE PROPOSED BEAUMONT RETREAT W, LP'S NEW ELDERLY LIMITATION DEVELOPMENT TO BE LOCATED IN THE 5900 BLOCK OF COLLEGE STREET, BEAUMONT, TX 77707 WITH THE TDHCA APPLICATION NUMBER OF #18095 AND THAT THIS FORMAL ACTION HAS BEEN TAKEN TO PUT ON RECORD THE OPINION EXPRESSED BY THE CITY OF BEAUMONT, TX AT ITS REGULARLY SCHEDULED COUNCIL MEETING ON JANUARY 9, 2018 AND THAT THE CITY OF BEAUMONT, TX WILL MAKE A CONTRIBUTION OF AT LEAST FIVE HUNDRED DOLLARS ($500.00) TOWARD THE CONSTRUCTION OF THE RETREAT WEST BEAUMONT IN THE FORM OF CASH OR IN-KIND SERVICES AND THAT FOR AND ON BEHALF OF THE GOVERNING BODY, BECK AMES, MAJOR OF THE CITY OF BEAUMONT, TX AND/OR KYLE HAYES, CITY MANAGER ARE HEREBY AUTHORIZED, EMPOWERED AND DIRECTED TO CERTIFY THESE RESOLUTIONS TO THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE Minutes — January 9, 2017 MOTION PASSED Resolution 17-011 COMMENTS Public Comments (Persons are limited to three minutes) Steve Hoffman 7045 Blarney Beaumont TX Spoke to Council in regards to a blog on Facebook and the City site, stated that there seems to be a lot of interest in Jefferson Theatre, in particular the organ which is not functioning, stated that he would like to see the organ at the Jefferson stay downtown because it is a jewel, stated that he's not asking the city to fund it, asked the Council to get behind this, there is a lot of people in the private sector that would take part in getting the organ repaired, ask that Council maybe adopt a resolution or whatever they need to do to get on top of this issue, thanked Council for working on getting the River Front Park back online Sam Parigi 445 N. 14th St. Beaumont TX Wanted to remind Council that you can't sell out of an empty wagon, used that analogy because he knows that the City has access property throughout Beaumont, stated that some property is for sale and some isn't, but just because there is property doesn't mean you have to sell it just because it's not producing something for the City, commented on the property across from the Event Centre and wanted to remind Council that the City of Beaumont is in a great position and moving in the right direction and would like to keep it going that way Jason Marshburn 1070 Monterrey Dr. Beaumont TX Stated that he's just as optimistic as some of the other speakers about the development of Beaumont, it hasn't grown in many decades, stated that downtown does need better parking, maybe a parking garage, there is a need for more housing downtown near the Event Centre, stated that Dowlen Road is full, applauded Council on the proposal for the removal of the Brooks overpass, thinks that Dowlen Road being extended all way down to 110 if the money is available in the near future is a great idea, commented on crime, stated that if we get more policing then the crime can be controlled, there's too much of everything near the Parkdale Mall area Sherry Fox 8235 Shilow Dr. Beaumont TX Made comments regarding the organ at the Jefferson Theatre, encouraged Council to keep the organ and exposing our children to the organ, it's nothing like anyone will ever hear Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER JORDAN - COMMENTED ON THE COLD WEATHER AND THE PETS, STATED THAT THE BEAUMONT ANIMAL CONTROL IS NOW STOCKING HAY, WHICH IS SOMETHING THAT CAN KEEP THE PETS WARM IF THEY CAN'T BE BROUGHT INSIDE, ENCOURAGED CITIZENS TO Minutes — January 9, 2017 VISIT BEAUMONT ANIMAL CONTROL AT 1814 PINE ST., FOR SOME HAY TO STUFF IN THE DOG HOUSES, IN ADDITION BE MINDFUL TO NOT KEEP ANIMALS CHAINED FOR EXTENDED PERIODS OF TIME, STATED THAT SHE THINKS IT'S AGAINST THE LAW TO KEEP PETS CHAINED IN LESS THAN 32 DEGREE WEATHER, ALSO COMMENTED ON THE CITY TRASH PROBLEM, HOPES THAT AN ANSWER CAN BE FOUND TO CUT DOWN ON THE AMOUNT OF TRASH IN THE CITY, STATED THAT THE CITY DOES HAVE A CONTRACTOR THAT PICKS UP TRASH BUT THE CITIZENS ARE THROWING TRASH OUT FASTER THAN IT CAN BE PICKED UP, THE CITY NEEDS TO TRY AND GET A HANDLE ON THIS, WANTED BUSINESS OWNERS TO KNOW THAT THE PARKING LOTS ARE STILL THEIR RESPONSIBILITY, ASKED THAT THE OWNERS OF ALL LOCAL BUSINESSES NEED TO KEEP AN EYE ON THEIR PARKING LOTS AND KEEP THEM CLEAN, IF THE CITY ISN'T CLEAN THEN IT DOESN'T PRESENT A GOOD FACE TO THE PUBLIC, ALSO COMMENTED ON HER RIDE ALONG WITH THE BEAUMONT POLICE DEPARTMENT ON A RAID OF AN EIGHT LINER FACILITY, THANKED THE POLICE DEPARTMENT FOR LETTING HER RIDE ALONG COUNCILMEMBER GETZ - WISHED EVERYONE A HAPPY NEW YEAR, STATED THIS COUNCIL OBVIOUSLY VALUES AFFORDABLE HOUSING FOR SENIORS AS EVIDENCE BY THE UNANIMOUS VOTE TO PUT IN AN AFFORDABLE SENIOR HOUSING PROJECT AT A LOCATION NEAR KELLY HIGH SCHOOL WHICH IS ON THE GAMES PEOPLE PLAY PROPERTY, COMMENTED ON SEVERAL PROJECTS THAT ARE RUN BY THE BEAUMONT HOUSING AUTHORITY, WHILE HE IS HAPPY THAT THERE WILL BE A NEW AFFORDABLE SENIOR PROJECT ON COLLEGE, HE IS SADDENED THAT THERE WAS A LOST OPPORTUNITY TO PUT AN AFFORDABLE SENIOR HOUSING PROJECT DOWNTOWN ON SOME LAND THAT THE CITY OWNS, STATED THAT THE PROJECT WAS AN $18 MILLION DOLLAR PROJECT AND WAS BEING PROPOSED WITH 150 UNITS, STILL DOESN'T HAVE A CLEAR UNDERSTANDING AS TO WHY THAT PROJECT WAS DERAILED, MADE COUNCIL AWARE OF WASHINGTON BLVD. TO LANGHAM, WHICH HAS BIG DITCHES ON BOTH SIDES, NO LIGHTS AND NEEDS TO BE RESURFACED, ALSO HAS NO SIDEWALKS FOR THE KIDS THAT ARE WALKING TO AND FROM SCHOOL, ALSO SHARED ALL OF THE OTHER COUNCILS CONCERNS REGARDING THE CLEANLINESS OF THE CITY, MAYBE THE CITY SHOULD CONSIDER AN ORDINANCE TO CHARGE FOR PLASTIC BAGS LIKE SOME OF THE OTHER CITIES DO MAYOR PRO TEM WRIGHT - COMMENTED ON THE TRASH PROBLEM THAT COUNCILMEMBER JORDAN SPOKE ABOUT, SPOKE REGARDING RECYCLING, STATED THAT SHE HAS RECEIVED SEVERAL PHONE CALLS REGARDING THE SAFETY OF BIGNER RD., THERE IS NO SHOULDER OR SIDEWALK, SOMETHING NEEDS TO BE DONE, IT Minutes — January 9, 2017 IS VERY DANGEROUS FOR CITIZENS TO WALK ON BIGNER RD., FROM ELGIE TO WEST VIRGINIA THERE IS ALSO NO SIDEWALKS AND CITIZENS HAVE NOWHERE TO WALK SO THEY WALK IN THE STREET, WHEN CARS PASS THEY HAVE TO JUMP THE DITCH, STATED THAT FOR THE SAKE OF SAFETY SOMETHING NEEDS TO BE DONE, ALSO IN THE 4500 BLOCK OF ABRAHAM, THE ROAD IS IN BAD SHAPE, MADE COMMENTS REGARDING THE AFFORDABLE SENIOR HOUSING PROJECT THAT WAS TO BE BUILT ACROSS FROM THE EVENT CENTRE, STATED THAT SHE IS NOT AGAINST AFFORDABLE HOUSING FOR SENIORS JUST DOESN'T THINK THAT ACROSS FROM THE EVENT CENTRE IS THE PROPER LOCATION FOR THE PROJECT COUNCILMEMBER PATE - COMMENDED STAFF ON THE PIPE BURSTING ITEM ON THE AGENDA, STATED THAT IT CAME IN $100,000 UNDER THE ESTIMATED AMOUNT, MADE MENTION OF THE AFFORDABLE SENIOR PROJECT THAT WILL BE NEAR KELLY HIGH SCHOOL COUNCILMEMBER SAMUEL - HAD SEVERAL ISSUES THAT HE NEEDED STAFF TO TAKE A LOOK AT, ON THE CORNER OF TRINIDAD AND GENERAL, THE STREET LIGHTS ARE OUT, ALSO CITIZENS HAVE MAJOR CONCERNS REGARDING FAIRWAY, ASKED PREVIOUSLY IF IT'S SCHEDULED FOR CONSTRUCTION AT ANY TIME, STATED THAT HE DID GET A RESPONSE FROM DR. MAJDALANI THAT FAIRWAY HAS BEEN MOVED FROM THE PLANNING PHASE TO THE CONSTRUCTION PHASE AND THE COST OF THE PROJECT IS $128,000, JUST WANTED CITIZENS THAT HAD CONCERNS TO KNOW WHAT THE STATUS OF THE PROJECT IS, THANKED DR. MAJDALANI FOR HIS QUICK RESPONSE, AGREED WITH COUNCILMEMBER JORDAN REGARDING CLEANING UPTHE CITY, STATED THERE ARE TAX PAYERS THAT PUT A LOT OF TIME, MONEY AND EFFORT INTO THEIR PROPERTY AND THEN THERE ARE PROPERTY OWNERS THAT DON'T, STATED THAT THERE IS THE ISSUE OF CITIZENS THROWING MATTER OUT OF THEIR VEHICLES, ASKED THAT CODE ENFORCEMENT BE LOOKED AT, THERE ARE CERTAIN PLACES IN THE CITY THAT CODE ENFORCEMENT WOULD NEVER ALLOW JUNK MOTOR VEHICLES TO REMAIN ON PROPERTIES FOR MONTHS AT A TIME BUT IT'S HAPPENING, TRASH IS BEING LEFT ON STREETS AND VACANT CAR WASHES, IT'S HIS HOPE THAT CODE ENFORCEMENT CAN DO A BETTER JOB OF ADDRESSING THOSE TYPES OF ISSUES AND THINKS IT STARTS WITH CODE ENFORCEMENT AND WHAT'S DONE BY THEM SHOULD BE SHOULD BE ACROSS THE CITY AND NOT SELECTED AREAS COUNCILMEMBER MOUTON - WISHED EVERYONE A HAPPY NEW YEAR, COMMENTED ON THE TRASH AND THE WAY THAT THE CITY LOOKS, ASKED IF THERE COULD BE A WORK SESSION WITH CODE ENFORCEMENT, THE CLEANLINESS OF THE CITY AND SOME NEW GUIDELINES FOR CODE ENFORCEMENT NEEDS TO BE ADDRESSED, MADE Minutes — January 9, 2017 COMMENTS REGARDING ABRAHAM ST., STATED THAT SHE HAS REPORTED THIS STREET ON SEVERAL DIFFERENT OCCASIONS, THE CURB WAS GONE ON THIS STREET BUT HAS BEEN REPLACED, THIS STREET IS HIGHLY TRAVELED AND NEEDS A LITTLE ATTENTION, IT'S IN POOR CONDITION, ALSO THERE ARE KIDS WALKING FROM ODOM ACADEMY AND THEY ARE IN DESPERATE NEED OF SIDEWALKS, STATED THAT SHE VISITED UT PHYSICIANS, THE DOCTOR REQUESTED TO VISIT WITH HER, THERE IS A CONCERN WITH UT PHYSICIANS IN REGARDS TO .STAGG DR., THE STREET IS IN TERRIBLE NEED OF REPAIR, THEY ARE STILL UNDER CONSTRUCTION BUT THE CONSTRUCTION WILL BE OVER SOON AND THEY WILL HAVE PATIENTS IN AND OUT SO THE TRAFFIC WILL INCREASE EVEN MORE, MADE MENTION OF JEANNETTE PRICE WHO IS PRESIDENT OF THE BLIND ASSOCIATION, STATED THAT THERE IS A NEW PROCEDURE THAT MS. PRICE HAS HAD AT BAYLOR MEDICAL, SHE HAS HER SIGHT BACK AND NO LONGER USING HER CANE AND IS ALSO DRIVING, JUST WANTED TO SHARE THAT WITH COUNCIL ON HOW BLESSED MS. PRICE HAS BEEN AND SHE WILL CONTINUE TO BE AN ADVOCATE FOR THE BLIND, ANNOUNCED THAT THE MLK PARADE WILL BE THIS SATURDAY, ENCOURAGED EVERYONE TO COME OUT AND BE A PART OF THE FESTIVITIES, CONGRATULATED ALABAMA CRIMSON TIDE ON THEIR WIN, THANKED MR.
