Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on December 19, 2017, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda * Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Councilmember Audwin Samuel gave the invocation. Jayla Franklin led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Wright, Councilmembers Jordan, Getz, Pate, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions "Recognitions" - Stacey Lewis, City of Beaumont Recreation Manager, recognized members of the City's Recreation Track Clubs Male and Female Athlete of the Year to Council, Female Athlete of the Year was Jayla Franklin and Male Athlete of the Year was Hunter Denton Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Public Comment: Persons may speak on scheduled agenda items No. 1/Consent Agenda Patrick Phelan 2460 Long Beaumont TX Spoke regarding Item A on the Consent Agenda; Approving a Resolution opposing the removal of .the Brooks Road Overpass, asked that Council vote in favor of this item to oppose removal of the overpass Minutes — December 18, 2017 Kathie Hughes 1220 Glendale Beaumont TX Spoke regarding Item A on the Consent Agenda; Approving a Resolution opposing the removal of the Brooks Road Overpass, asked that Council vote in favor of this item to oppose removal of the overpass CONSENT AGENDA Approval of minutes — December 12, 2017 Confirmation of committee appointments — None A) Approve a resolution opposing the removal of the Brooks Road Overpass — Resolution 17- 267 Councilmember Getz moved to approve the Consent Agenda. Councilmember Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider a resolution authorizing the City Manager to award a bid to ALLCO, LLC of Beaumont for the Dowlen Road Project (Hwy 69 Frontage Road to 1,300 -ft north of College Street). On June 20, 2017, by Resolution No. 17-124, City Council authorized the City_Manager to execute Amendment No. 2, to the Advanced Funding Agreement with the Texas Department of Transportation (TxDOT) to change the scope of work for the Dowlen Road Project. Dowlen Road is a heavily traveled, four (4) lane roadway, that requires minor concrete repair and resurfacing, sidewalks and ADA ramps at various locations. TxDOT has approved the City of Beaumont Construction Plans and Specifications per federal and state requirements. The Engineering Estimate is $3,200,000.00. On October 26, 2017, bids were solicited for furnishing all labor, materials, equipment, and supplies for the project. Three (3) bids were received as indicated in the table below: Contractor Location Base Bid Amount Pamela Dodson, dba LD Construction Beaumont, TX $2,560,463.45 Oldcastle Materials Texas, Inc., dba Gulf Coast an Oldcastle Company Beaumont, TX $2,699,577.40 ALLCO, LLC Beaumont, TX $3,211,284.00 Minutes — December 18, 2017 Pamela Dodson, dba LD Construction's bid was found to be Non -Responsive due to not being a Pre -Qualified Contractor with TxDOT as required in Item 2L, of the Instructions to Bidders. Oldcastle Materials Texas, Inc., dba Gulf Coast an Oldcastle Company's bid was found to be Non -Responsive due to Bid Item 500 Mobilization exceeding 10%. The Public Works Engineering Staff recommends this project be awarded to ALLCO, LLC as the lowest, responsive bidder in the amount of $3,211,284.00. A total of 300 calendar days are allocated for completion of the project. Funds will come from the Department of Transportation Federal Highway Administration in the amount of $2,569,027.20 and the remaining $642,256.80 from the Capital Program. Approval of resolution. Councilmember Jordan moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO ALLCO, LLS, OF BEAUMONT, TEXAS, IN THE AMOUNT OF $3,211,284.00 TO FURNISH ALL LABOR, MATERIALS, EQUIPMENT AND SUPPLIES FOR THE DOWLEN ROAD (Hwy 69 FRONTAGE ROAD TO 1,300 FT. NORTH OF COLLEGE STREET) PROJECT AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH ALLCO, LLC, OF BEAUMONT, TEXAS. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 17-268 COMMENTS Public Comments (Persons are limited to three minutes) Harry Holmes 1695 Ave C Beaumont TX Spoke regarding trash and debris that is being dumped illegally, stated that he has complained to Clean Community on three different occasions, there's a group of citizens that are dumping debris in a ditch at the corner of Avenue C and Forsythe, also gave the address where the citizens live that are dumping the debris, asked -that someone look into this matter Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER MOUTON - WISHED EVERYONE A MERRY CHRISTMAS AND A HAPPY NEW YEAR TO ALL COUNCILMEMBER SAMUEL - WISHED EVERYONE A MERRY CHRISTMAS AND A HAPPY NEW YEAR Minutes — December 18, 2017 COUNCILMEMBER PATE - STATED THAT THE KIDS ARE OUT OF SCHOOL, WATCH OUT FOR THEM AS THEY MOVE ABOUT, WISHED EVERYONE A MERRY CHRISTMAS AND HAPPY NEW YEAR AND A HAPPY HANUKKAH MAYOR PRO TEM WRIGHT - THANKED THE PARKS AND RECREATION DEPARTMENT FOR THE BEAUMONT TRACK TEAM, CONGRATULATED HUNTERAND JAYLA, WISHED EVERYONE A MERRY CHRISTMAS, HAPPY HANUKKAH AND HAPPY KWANZAA, STATED THAT SHE WAS OUT FOR THREE CONSECUTIVE MEETINGS, THANKED ALL THE CITIZENS THAT CALLED TO CHECK ON HER COUNCILMEMBER GETZ - STATED THAT THEY ARE ON THEIR SEVENTH DAY HANUKKAH AND STILL CELEBRATING, WISHED ALL OF HIS CHRISTIANS FRIENDS A MERRY CHRISTMAS AND HAPPY HANUKKAH, ANNOUNCED UPCOMING ACTIVITIES THAT CITIZENS CAN PARTICIPATE IN, DISNEY LIVE WILL BE AT THE BEAUMONT CIVIC CENTER ON WEDNESDAY, DECEMBER 20, 2017, ALSO AN EVENING WITH JACK INGRAM ON DECEMBER 21, 2017 AT THE JEFFERSON THEATRE, ROGERCREAGER'S "SING ALONG PARTY" ON FRIDAY, DECEMBER 21, 2017, HOPE THAT EVERYONE CAN COME OUT TO THE EVENTS AND ENJOY COUNCILMEMBER JORDAN - WISHED EVERYONE A MERRY CHRISTMAS AND A HAPPY NEW YEAR, ENCOURAGED CITIZENS TO REACH OUT AND HELP ANYONE THAT THEY CAN, THIS IS THE SEASON CITY ATTORNEY COOPER - MERRY CHRISTMAS TO EVERYONE CITY MANAGER HAYES - NONE MAYOR AMES - WISHED EVERYONE A VERY MERRY HOLIDAY SEASON, STATED THAT COUNCIL WILL BE ON VACATION FOR TWO WEEKS AND WON'T MEET AGAIN UNTIL JANUARY 9, 2018 Open session of meeting recessed at 2:04 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Claim of David Pouncy, Individually and on Behalf of the Estate of Nancy Pouncy, Deceased Claim of Emerald Thomas, Individually and as of Next Friend of Trentin Thomas, Jr., a Minor Ashley Scott v.
