Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on September 12, 2017, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m., to consider the following: OPENING Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Councilmember Samuel gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Wright, Councilmembers Jordan, Getz (arrived at 1:34 p.m.), Pate, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions None Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda None CONSENT AGENDA * Approval of minutes — August 22, 2017 Confirmation of committee appointments — Marc McDonald will fill the unexpired term of Richard James on the Convention and Tourism Advisory Committee. The term would commence September 12, 2017 and expire September 30, 2017. (Councilmember Virginia Jordan) — Resolution 17-178 Minutes — September 12, 2017 Vivian Todd will fill the unexpired term of Travis Hefley on the Parks and Recreation Advisory Committee. The term would commence September 12, 2017 and expire September 30, 2017. (Councilmember Virginia Jordan) — Resolution 17-179 Melinda McWhite will fill the unexpired term of Charles Heare on the Parks and Recreation Advisory Committee. The term would commence September 12, 2017 and expire September 30, 2017. (Councilmember Virginia Jordan) — Resolution 17-180 Roy Steinhagen will fill the unexpired term of Marty Craig on the Planning and Zoning Advisory Committee. The term would commence September 12, 2017 and expire September 30, 2017. (Councilmember W.L. Pate) — Resolution 17-181 A) Authorize the renewal of an annual maintenance agreement with SirsiDynix for software used in the Library System — Resolution 17-182 Councilmember Mouton moved to approve the Consent Agenda. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider approving an ordinance granting a franchise for solid waste collection and transportation services to 2S Roll -off Service, LLC. According to City Ordinance 22.05.101, no person shall engage in the business of collecting, hauling or transporting, in the city, any garbage, waste or refuse, without first having obtained a franchise from the City. Six (6) entities currently have nonexclusive franchise agreements with the City and are doing business in this area. 2S Roll -off Service, LLC has requested that the City Council grant the company a franchise agreement. 2S serves southeast Texas with its corporate office located at 3065 W. Cedar Street, Beaumont, Texas. The agreement provides for a term of one year from its effective date and a franchise fee of seven percent (7%) of gross revenues received for service. It also requires the entity to indemnify the City of Beaumont and provide insurance which names the City of Beaumont as a named insured. According to the City Charter, franchise ordinances require readings at three (3) separate Council meetings, with the third not less than thirty (30) days from the first reading. The ordinance does not take effect until sixty (60) days after its adoption on the third and final reading. After passage, the ordinance must be published for four (4) consecutive weeks in a newspaper of general circulation in the city. All publication costs are paid by the franchisee. Attached is a copy of the franchise agreement for your review. This is the third and final reading. The first reading took place on July 25, 2017. Minutes — September 12, 2017 A franchise fee of seven percent (7%) of gross receipts will be paid to the City. Approval of resolution. Councilmember Pate moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE GRANTING A FRANCHISE FOR SOLID WASTE COLLECTION AND TRANSPORTATION SERVICES TO 2S ROLL -OFF SERVICE, LLC. Mayor Pro Tem Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 17-049 WORKSESSION Review and discuss the proposed FY 2018 Budget and the proposed 2018 Capital Program Kyle Hayes, City Manager reviewed and discussed the proposed FY 2018 Budget and the proposed 2018 Capital Program. Mr. Hayes first discussed the proposed FY 2018 budget overview, stating that there would be a 2.5% wage increase for Fire (per their contract), a 2% wage increase for Police (per their contract), and a 2% wage increase for civilian employees. Health insurance premiums will remain the same for employees and there would be no rate increase for water, sewer or garbage collection rates for FY 2018. There was discussion regarding a two -cent property tax rate increase, $0.69/100 assessed valuation to $0.71/100. The General Fund rate of $0.49059 with 0.7 cents of the 2 cents would be dedicated to the General Fund to help fund wage increases for Police, Fire and civilian employees. The Debt Service Fund rate is $0.21941, 1.3 cents of the 2 cents would be dedicated to the Debt Service to help fund the $10 million bond issue for street rehabilitation planned in 2018 and 2019. The General Fund and it largest revenue sources were discussed, the sale and use taxes are at 32% with a projected 0.5% growth, property taxes are at 29% with an appraised value increase of 3%, industrial payments are at 15% with a projected 3% increase and the utility fund in lieu is at 8%, the Water Fund will transfer an additional $500,000 to this fund. The General Fund statement of revenues and expenditures were discussed with revenues at $121,742,200, expenditures were $123,038,500, and excess (deficit) revenues over appropriations were ($1,296,300). The beginning fund balance is at $30,673,330, and the ending fund balance will be $29,377,030. The General Fund, fund balance rainy day account was also discussed with the FY 2018 budget ending with $29,377,030, with 23.9% of expenditures. The Water Utilities Fund overview will have no water and sewer rate increase for FY 2018 with an estimated ending fund balance that has increased by 275% since 2014. The Water Utilities Fund statement of revenues and expenditures showed the revenues at $50,247,300, the expenditures were $50,153,700, the excess (deficit) Minutes — September 12, 2017 revenues over appropriations at $93,600. The beginning fund balance was $15,283,248 and the ending fund balance was $15,376,848. The Water Utilities Fund balance (rainy day account) for FY 2017 was estimated at $15,283,248 with 32.7% expenditures. The Solid Waste Fund overview was discussed with no garbage collection rate increase for FY 2018, the fund balance is very healthy which will allow large equipment and fleet purchases to be paid for with cash. The recycling program has 680 current participants. The Solid Waste Fund state of revenues and expenditures show the revenue to be $10,665,000, the expenditures $11,875,000, the excess (deficit) revenues over appropriations at ($1,210,000). The beginning fund balance is at $4,680,471 and the ending fund balance was $3,470,471. Box 72888 Beaumont TX Wanted to thank the Mayor and Council as well as staff for all that was done during and after Hurricane Harvey Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER JORDAN - STATED THAT THERE'S NO WORDS THAT CAN DESCRIBE THE AMOUNT OF EFFORT AND GOOD HEARTED LOVE THAT HAS BEEN SEEN THROUGHOUT THE COMMUNITY, SAW THE BEST OF THE CITIZENS, STATED THAT THE CITY WILL GET BACK AND DOESN'T NEED ANYONE TO CARRY US WE WILL DO IT, COMMENDED THE MAYOR AND ALL THE WONDERFUL STAFF AROUND HER FOR DOING A GREAT JOB COUNCILMEMBER GETZ - STATED THAT HURRICANE HARVEY WAS UNPRECEDENTED IN TERMS OF DAMAGE SUSTAINED, THANKED ALL EMPLOYEES AND FIRST RESPONDERS, ALSO THANKED THE MAYOR, CITY MANAGER AND STAFF FOR GETTING THE WATER UP SO QUICKLY MAYOR PRO TEM WRIGHT - STATED THAT THE ADMINISTRATION WORKED LIKE A WELL- OILED MACHINE, THANKED EVERYONE THAT HAD A PART IN THE REMARKABLE JOB THAT WAS DONE, STATED THAT SHE WORKED AT THE DEMOCRATIC HEADQUARTERS AND HAS NEVER SEEN SUCH A WELL -ORGANIZED OPERATION, STATED THAT ALL THE JUDGES WERE THERE WORKING TO HELP GIVE MUCH NEEDED SUPPLIES AND OTHER ITEMS TO THE CITIZENS THAT WERE IN NEED, THANKED EVERYONE THAT DONATED FOOD, CLEANING SUPPLIES ETC. COUNCILMEMBER PATE - THANKED THE MAYOR, CITY MANAGER AND EOC STAFF WHO MADE ALL THE THINGS THAT TRANSPIRED WORK, EVERYONE DID A GREAT JOB, NO ONE WAS ASKED TO DO ANYTHING THEY JUST JUMPED IN AND DID IT, THANKED STAFF WITH THE WATER DEPARTMENT FOR THE GREAT JOB THEY DID GETTING THE WATER BACK ONLINE, SO PROUD OF ALL THE HARD WORK BY EVERYONE Minutes — September 12, 2017 COUNCILMEMBER SAMUEL - COMMENTED ON HURRICANE HARVEY AND HOW EVERYONE CAME TOGETHER TO TAKE CARE OF THE COMMUNITY AND NOT ONLY IN THE CITY BUT ACROSS THE NATION, WE HAVE SEEN PEOPLE FROM ALL OVER THIS COUNTRY COME TO BEAUMONT AND WORK, PASSING OUT GOODS THAT WERE DONATED, CLEARING OUT DAMAGED PROPERTY, THANKED ALL OF THE CITIZENS FOR COMING TOGETHER AND WORKING ON ONE ACCORD, THANKED EMPLOYEES, POLICE AND FIRE FOR ALL THAT THEY DID TO GO ABOVE AND BEYOND THE CALL OF DUTY, THANKED THE CITY MANAGER FOR THE GREAT JOB HE DID AS WELL AS THE MAYOR AND EOC STAFF COUNCILMEMBER MOUTON - STATED THAT PEOPLE MATTER AND BEING THERE TO HELP OTHER PEOPLE MATTERS, SALUTED FIRE, POLICE, EMS AS WELL AS 311 AND 911 OPERATORS THAT MANNED THE PHONES, ALL CITY WORKERS THAT WORKED LONG HOURS WITH VERY LITTLE SLEEP, ALSO THANKED THE CITY MANAGER, MAYOR AND THE EOC STAFF FOR ALL OF THE LONG HOURS AND HARD WORK, ALSO THANKED THE PASTORS AND CHURCHES, ASKED THAT EVERYONE NOT FORGET OUR NEIGHBORS IN PORT ARTHUR AND NOME WHO WERE HIT THE HARDEST CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - STATED THAT ON BEHALF OF THE ADMINISTRATION THEIR PRAYERS ARE WITH THE PUBLIC, STATED THAT HE WENT OUT AND TOURED THE CITY WITH THE MAYOR AND COUNCILMEMBER JORDAN, COUNCILMEMBER SAMUEL STAYED IN TOUCH WITH HIM, HE WENT DOOR TO DOOR IN HIS AREA TO MAKE SURE THAT CITIZENS WERE ALRIGHT IF THEY WERE HOME, STATED THAT SOME CITIZENS HAVE LOST EVERYTHING AND JUST ABOUT EVERYTHING THEY OWN IS ON THE CURB, COMMENTED ON THE MAYOR AND HOW STRONG AND STEADY SHE WAS, THANKED HER FOR EVERYTHING SHE DID WITH VERY LITTLE SLEEP, ALSO THANKED TIM OCNASCHCK AND THE EOC STAFF ALONG WITH THE WATER DEPARTMENT STAFF THAT WORKED AROUND THE CLOCK TO GET WATER BACK ONLINE IN THE CITY MAYOR AMES - NONE THANKED EOC AND STAFF, AS WELL AS THE CITY MANAGER AND ALL EMPLOYEES FOR ALL OF THEIR HARD WORK AND WORKING AROUND THE CLOCK, THANKS TO THE WATER DEPARTMENT STAFF FOR WORKING AROUND THE CLOCK AS WELL TO GET THE WATER RESTORED TO THE CITY, ALSO THANKED THE OUTSIDE ENGINEERING COMPANIES AND OTHERS THAT WORKED WITH STAFF ON THE WATER, THANKED THE CITY MANAGER AND CITY ATTORNEY FOR THEIR GUIDANCE THROUGH EVERYTHING Minutes — September 12, 2017 repeing no Executjxe Session Council adjourned at 2:26 p.m. es Tina Broussard, City Clerk Minutes — September 12, 2017
