Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a Special meeting in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on August 31, 2017, at the Beaumont Municipal Court Building, Emergency Operations Center, 700 Orleans Street, Beaumont, Texas, at 12:00 p.m. to consider the following: OPENING Roll Call Present at the meeting were Mayor Ames, Mayor Pro Tem Wright, Councilmembers Jordan, Getz, Pate, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. REPORTS Reports from the Emergency Operations Center EMERGENCY BUSINESS Extension of Hurricane Harvey Disaster Declaration. The Mayor issued a proclamation declaring a state of disaster for the City of Beaumont, Texas due to widespread or severe damage, injury, or loss of life and property or the imminent threat of same resulting from Hurricane Harvey. The Mayor has determined that extraordinary measures must be taken to alleviate the suffering of people and to protect or rehabilitate property. Section 418.108(b) of the Texas Government Code provides that a local state of disaster may not be continued for a period in excess of seven (7) days without the consent of the governing body of the political subdivision. That the declared state of disaster proclaimed for the City of Beaumont by the Mayor on August 25, 2017, is hereby extended and shall continue until terminated by ordinance of the City Council. This ordinance is passed as an emergency measure and pursuant to local authority for emergency measures and shall become and take effect immediately from and after its issuance. Minutes —August 31, 2017 Councilmember Pate moved to approve the Extension of Hurricane Harvey Disaster Declaration. Councilmember Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED 2. Consider, approval of removing the operations of the competitive bidding requirements. The City of Beaumont has declared a state of disaster and emergency in accordance with Section 418.108 of the Texas Disaster Act of 1975, Local Government Code of Texas. The Governor of the State of Texas and the President of the United States have designated the City of Beaumont as a disaster area. Now, therefore the City Council of the City of Beaumont, Texas has determined that the operation of the competitive bidding provisions of the City Charter and Code of Ordinances with respect to contracts for all recovery related procurements made by reason of the public calamity resulting from Hurricane Harvey, is hereby removed for a period of 90 days from and after August 25, 2017, unless the state of disaster is terminated earlier, provided, however, that, insofar as practicable, bids, quotations, or estimates of material, labor and other cost for purchases, goods, works and the like described will be diligently solicited and procured prior to entering into contract therefor, and such contract, if awarded, will be made to the lowest, best, or expedient bid is within the sole discretion of the City Manager, and his decision is final. Councilmember Jordan moved to ADOPTAN ORDINANCE DECLARINGAN EMERGENCY; REMOVING THE OPERATION OF THE COMPETITIVE BIDDING REQUIREMENTS OF THE APPLICABLE COMPETITIVE BIDDING PROVISIONS OF THE CITY CHARTER AND CODE OF ORDINANCES PURSUANT TO SECTION 252.022 OF THE TEXAS LOCAL GOVERNMENT CODE WITH RESPECT TO CONTRACTS FOR PROCUREMENTS MADE BECAUSE OF THE PUBLIC CALAMITY RESULTING FROM HURRICANE HARVEY, FOR A PERIOD OF AT LEAST 90 DAYS FROM AND AFTER AUGUST 25, 2017. Mayor Pro Tem Wirght seconded the motion.
