Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on August 22, 2017, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda item No.1-2/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Deanna Andrews with Harvest of Lost Souls Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Wright, Councilmembers Getz, Pate, Samuel and Mouton. Absent: Councilmember Jordan. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Councilmember Jordan was absent as she was out of the City. None CONSENT AGENDA * Approval of minutes —August 15, 2017 * Confirmation o(committee appointments — None Minutes — August 22, 2013 A) Authorize the City Manager to execute a Development Agreement with the Magnolia Garden Club related to the construction of an educational observation building over -looking the Cattail Marsh Wetlands Area — Resolution 17-174 B) Authorize the waiving of interest on a 1923 paving lien at 740 Washington — Resolution 17- 175 Councilmember Mouton moved to approve the Consent Agenda. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider authorizing the City Manager to enter an agreement with Enterprise refined Products Company LLC for economic development incentives under the City's Chapter 312 Economic Development Program. Chapter 312 of the Texas Local Government Code allows cities to implement economic incentive programs to encourage new businesses as well as project expansions. In June 2014, the City Council established the Chapter 312 Economic Development Program to encourage significant economic development projects within the City. Enterprise Refined Products Company LLC is considering the construction of new crude oil storage tanks, pipeline interconnects and distribution system at its existing Beaumont facility. Enterprise owns land and improvements located inside and outside the city limits of Beaumont. Property taxes for property owned by Enterprise that is located outside the city limits is governed by an Industrial District Agreement with the City. Improvements made by Enterprise that are located within the city limits will be governed by the 312 Agreement. The estimated value of improvements being made within the city limits is $210 million. The applicant is requesting a 100% abatement of city taxes for eight years, beginning in FY 2019. For consideration of the tax abatement being provided, the City has negotiated with Enterprise for payments to be made over a nine-year period. A payment of $850,000 will be made to the City in FY 2018 and FY 2019 and payments of $161,544 will be made in FY 2020- FY 2026. Payments are accounted for in the General Fund. Approval of resolution. Councilmember Pate moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A TAX ABATEMENT AGREEMENT WITH ENTERPRISE REFINED PRODUCTS COMPANY, LLC FOR THE CONSTRUCTION OF NEW CRUDE OIL STORAGE TANKS, PIPELINE INTERCONNECTS AND DISTRIBUTION SYSTEM AT ITS EXISTING BEAUMONT FACILITY. Mayor Pro Tem Wright seconded the motion. Minutes — August 22, 2013 AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 17-176 2. Consider a resolution approving an amendment to the industrial district agreement (IDA) with Arkema and approving an addendum related to abatements and additional payments. By Resolution No. 15-253 and on November 17, 2015, City Council approved an IDA with Arkema. The IDA is being amended to incorporate language related to an abatement of a proposed construction project, add minimum and maximum caps to the computation of payments due to the City and to include a new article to the agreement for assignment procedures. Details of the addendum for the proposed construction project, abatement and additional payments are as follows: Construction of new facilities to produce intermediates in animal feed supplements at the same Beaumont site, involving an overall investment estimated at a value between $365- $400 million. All new construction and equipment related to this project will receive a 50% abatement for 7 years beginning the year following completion of the project. In consideration for this abatement, Arkema will pay the City $250,000 in years 2019-2021. These payments will be in addition to the normal payments received forthe existing facilities. Payments are accounted for in the General Fund. Approval of resolution. Councilmember Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE AN ADDENDUM TO THE AMENDED AND RESTATED AGREEMENT AMENDED AND RESTATED AGREEMENT BETWEEN THE CITY OF BEAUMONT AND ARKEMA, INC. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 17-177 Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Minutes —August 22, 2013 COMMENTS Public Comments (Persons are limited to three minutes) Dora Nisby 4250 Corey St. Beaumont TX Spoke on behalf of the Library Commission for the City of Beaumont in which she is the Chair, wanted to thank Council for their continued support financially and otherwise, also wanted to thank the staff that works at all of the branches and the great work that they are providing for all citizens, also thanked library staff for the great Science project The All American Solar Eclipse that was held at the Beaumont Event Centre, there was 1,200 glasses available to hand out, there was about 2,000 citizens in attendance, everyone enjoyed the event Willie Coleman 3285 Blossom Dr. Beaumont TX Stated that he and his wife are the owners of World of Color Development Center, , they have recently decided to expand, complained in regards to the Permit Department, stated that the department could do a much better job than what they do, stated that they were not told all of the details in regards to obtaining a permit, what they failed to do is to give him a list of everything that he needs to do all at one time and that the person he dealt with wasn't very educated in regards to her job, asked that the City please make sure that their employees are well educated as to what information they are providing the citizens and to try and provide everything at one time instead of what was done and is still being done with him Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER JORDAN - ABSENT COUNCILMEMBER GETZ - MADE COMMENTS IN REGARDS TO THE ECLIPSE VIEWING PARTY, THE KIDS WERE ENJOYING THE EVENT AS WELL AS THE ROTARY PLAYGROUND, THERE WERE PEOPLE OUT ON BLANKETS AND THE FOOD TRUCKS WERE THERE, IT WAS NICE TO SEE EVERYONE OUT HAVING A REALLY GOOD TIME, ANNOUNCED THE DOWLEN/WEST NEIGHBORHOOD ASSOCIATION MEETING, TUESDAY, AUGUST 22, 2017, AT ROGERS PARK COMMUNITY CENTER, THERE WILL BE A MEET AND GREET AT 6:00 P.M., THE MEETING WILL START AT 7:00 P.M., MAYOR BECKY AMES WILL BE THE GUEST SPEAKER, ANNOUNCED THE LABOR DAY TENNIS TOURNAMENT OVER THE WEEKEND AUGUST 26 & 27, 2017, AT THE MUNICIPAL TENNIS CENTER, THE TOURNAMENT IS FREE TO THE PUBLIC MAYOR PRO TEM WRIGHT - STATED THAT SHE WAS SORRY SHE WASN'T ABLE TO ATTEND THE ECLIPSE VIEWING, AS SHE WAS OUT OF TOWN, IT SEEMS THAT SHE MISSED THE BEST EVENT EVER, STATED SHE IS VERY PROUD OF WHAT THE LIBRARY SYSTEM IS DOING Minutes —August 22, 2013 COUNCILMEM13ER PATE - APPRECIATED ARKEMA FOR THEIR INDUSTRIAL AGREEMENT, ANNOUNCED THE COPS AND KIDS THIS SATURDAY, AUGUST 16, 2017, THE GUSHER AT SPINDLETOP, AND THE EZRA CHARLES 2017 TOUR AT THE JEFFERSON THEATRE AT 8:00 P.M., ON AUGUST 26, 2017, COMMENTED ON THE CHARLIE PRUITT COUNTRY REUNION SHOW AND HOW WELL IT WAS ATTENDED, ENCOURAGED EVERYONE TO GET OUT AND TAKE PART IN SOME OF THE EVENTS THAT ARE GOING ON COUNCILMEMBER SAMUEL - NONE COUNCILMEMBER MOUTON - THANKED MR. AND MRS. WILLIE COLEMAN FOR BRINGING THEIR CONCERNS TO THE COUNCIL, STATED THAT SHE HAD THE PRIVILEGE OF SPEAKING ON THE RADIO WITH CAMERON GRISBY, HE'S A CENTRAL HIGH SCHOOL FOOTBALL PLAYER THAT WORKS AT HEB, CAMERON FOUND A WALLET WITH $1,500 IN IT AND TURNED IT IN, STATED THAT SHE THANKED HIM FOR DOING THAT AND EXPRESSED TO HIM THE HE HAS SET AN EXAMPLE FOR HIS PEERS, ALSO TOLD HIM THAT HIS MOTHER RAISED HIM WITH THE RIGHT VALUES, CAMERON INFORMED HER THAT HE TURNED THE WALLET IN BECAUSE THAT COULD HAVE BEEN SOMEONE'S MORTGAGE PAYMENT OR UTILITY BILL MONEY AND HE KNOWS WHAT IT WOULD BE LIKE FOR HIS PARENTS IF THEY LOST THAT AMOUNT OF MONEY, STATED TO HIM THAT SHE WOULD INVITE HIM TO COUNCIL TO BE RECOGNIZED, ALSO COMMENTED ON THE ECLIPSE, ANNOUNCED THAT PASTORS KENNEDY AND DEANNA ANDREWS WITH HARVEST OF LOST SOULS WOULD BE HAVING A BACK TO SCHOOL PRAYER FOR THE KIDS AS WELL AS THE TEACHERS AND CROSSING GUARDS ON TUESDAY, AUGUST 23, 2017 AT 7:00 P.M.
