WHEREAS, on July 26, 2016, the City Council of the City of Beaumont, Texas,
adopted Resolution No. 16-131 approving the award of a contract to BDS constructors,
LLC d/b/a MK Constructors, of Vidor, Texas, in the amount of $594,133.00 for the
Sanitary Sewer Lift Station Rehabilitation -Arthur Lane, Holiday Street & Voth Road
Projects; and,
WHEREAS, on March 16, 2017, the City Manager executed Change Order No. 1
in the amount of $7,100.00 to provide additional electrical and mechanical
improvements to the Holiday Street and Voth Road lift stations; adjust the existing bid
item quantities; and, to include time to perform the work for the additional
improvements, thereby increasing the total contract amount to $601,233.00; and,
WHEREAS, Change Order No. 2 is required to increase the contract time to
provide for weather and other delays, thereby having no effect on the total contract
amount of $601,233.00; and,
WHEREAS, the project has been inspected by the Schaumburg & Polk, Inc. and
the Water Utilities Department and found to be complete in accordance with the
provisions and terms set forth in the contract;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL -OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted, and,
THAT the City Manager be and he is hereby authorized to execute Change
Order No. 2 for the additional time described above, thereby having no effect on the
contract amount of $601,233.00, for the Sanitary Sewer Lift Station !Rehab iIitation-Arthur
Lane, Holiday Street & Voth Road Projects; and,
BE IT FURTHER RESOLVED THAT the Sanitary Sewer Lift Station
Rehabilitation -Arthur Lane, Holiday Street & Voth Road Projects be and the same are
hereby found to be complete in accordance with the terms of the contract and are
accepted; and,
BE IT ALSO RESOLVED THAT the City Manager is hereby authorized to make
final payment in the amount of $30,061.65 to BDS constructors, LLC d/b/a MK
Constructors, of Vidor, Texas.
