Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on May 16, 2017, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Dwight Benoit of Magnolia Missionary Baptist Church gave the invocation. MayorAmes led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were MayorAmes, Mayor Pro Tem Mouton, Councilmembers Guidroz, Getz, Wright, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. ELECTION OF MAYOR AND COUNCILMEMBERS Consider approval of an ordinance canvassing the results of the May 6, 2017 City General Election Administration of the Oath of Office Councilmembers/City Manager Comments Recess Council to consider approval of an Ordinance canvassing the results of the May 6, 2017, City General Election. The Election Code, Section 67.003, states that each local canvassing authority shall convene to conduct the local canvass at the time set by the canvassing authority's presiding officer not earlier than the eight day or later than the eleventh day after Election Day. Council shall meet and canvass the returns and officially declare the results. Election officials will be sworn in and take office in their respective positions. Approval of ordinance. COuncilmember Guidroz moved to APPROVE AN ORDINANCE CANVASSING THE RETURNS OF THE GENERAL ELECTION OF THE CITY OF BEAUMONT HELD ON THE 6TH DAY OF MAY, 2017, FOR THE PURPOSE OF ELECTING A MAYOR, TWO COUNCILMEMBERS-AT-LARGE, FOUR (4) WARD COUNCILMEMBERS (WARDS I, II, III AND IV); PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. Councilmember Getz seconded the motion. None CONSENT AGENDA * Approval of minutes — May 9, 2016 * Confirmation of committee appointments — None A) Approve the purchase of a new roof system from Setex Construction Corp. for the Water Utilities Building located at 1350 Langham Road — Resolution 17 - 092 B) Authorize the City Manager to update a memorandum of agreement with CHRISTUS Saint Elizabeth Hospitals of Southeast Texas which is providing shelter and support facilities for City of Beaumont personnel and equipment during emergency operations — Resolution 17- 093 C) Authorize the City Manager to apply for and receive funding from the State of Texas for Interlibrary Loan activities for FY2017 — Resolution 17- 094 D) Authorize the acceptance of a ten foot wide and a forty foot wide Drainage Easement located at 685 Pinchback Road — Resolution 17 - 095 E) Authorize the acceptance of a ten foot wide Exclusive Water Line Easement located at 4255 Dowlen Road — Resolution 17 - 096 Councilmember Pate moved to approve the Consent Agenda. Consider a resolution authorizing the City Manager to enter into a Development Agreement in lieu of annexation for approximately 692 acres of land located on the west side of Major Drive and the north side of Dishman Road In September of 2016, the City annexed a 77.73 acre area located on the west side of Major Drive, just south of the right-of-way for Folsom Road. During the analysis of the annexation process, it was determined that the city should pursue the annexation of the entire unincorporated area extending form Folsom, south to Dishman and from Major Drive, west to Keith Road. However, Chapter 212 of the Texas Local Government Code offers immunity from annexation for properties having an "agricultural exemption" for taxing purposes, provided the property owners and the City execute a Development Agreement. Minutes — May 16, 2016 The agreement would limit development on the property that might be detrimental to the city in exchange for deferring annexation. The agreement stipulates that should any non- agricultural development occur the result would be an automatic petition for annexation by the land owner. The term of the agreement would be fifteen (15) years. It should be noted that this agreement is related to a separate agreement controlling a 692 acre tract extending from the west side of Major Drive and north side of Dishman Road. This larger area of land is proposed to be under a separate agreement as it is agricultural in use and is much likely to be developed in the near future, triggering the petition for annexation as outlined in the agreement. Approval of the resolution. Councilmember Getz moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO ENTER INTO A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF BEAUMONT AND MCNEIL, L.L.C., THE OWNER OF APPROXIMATELY 692 ACRES OF LAND LOCATED ON THE WEST SIDE OF MAJOR DRIVE AND THE NORTH SIDE OF DISHMAN ROAD, IN LIEU OF ANNEXATION OF THE PROPERTY. Councilmember Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 17 - 097 2. Consider a resolution approving the purchase of 10 Console Operator Positions from Motorola Solutions Inc. for use in the Fire and Police Departments. Pricing for the proposal was obtained through the Houston -Galveston Area Council (H -GAC) Cooperative Purchasing Program. H -GAC is a cooperative purchasing association providing cities and political subdivisions with the means to purchase specialized equipment at volume pricing. H -GAC complies with the State of Texas procurement statutes. The Console Operator Positions are used in Fire and Police 911 centers to send and receive radio communications. The current Console Operator Positions are 19 years old and are close to end of service life. The project cost to replace all of the hardware, software and networking equipment necessary for the new Console Operator Positions will be $826,074.00. The project will be funded through the 2015 Port Security Grant Program (PSGP) which requires a 25% match. Council approved receiving 2015 PSGP funding on September 29, 2015 by approving Resolution 15-206. 2015 Port Security Grant Program and $206,518.50 in matching funds available in the Capital Reserve. Approval of the resolution. Mayor Pro Tem Mouton moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE PURCHASE OF TEN (10) MCC7500 CONSOLE OPERATOR POSITIONS FOR USE BY THE FIRE AND POLICE DEPARTMENTS FROM MOTOROLA SOLUTIONS, INC., OF SCHAUMBERG, ILLINOIS, IN THE AMOUNT OF $826,074.00 THROUGH THE HOUSTON-GALVESTON AREA COUNCIL (H -GAC) COOPERATIVE PURCHASING PROGRAM. Councilmember Samuel seconded the motion. Consider a resolution approving the purchase of body worn cameras from WatchGuard for use in the Police Department. Pricing was obtained through the State of Texas Department of Information (DIR). DIR provides cities and political subdivisions with the means to purchase information technology at volume prices contracted under the procurement statutes of the State of Texas. The Body -Worn Camera Program grant for the Police Department will provide 141 body cameras including chargers, switches, transfer stations and mounting equipment for cars. The total project cost for 141 body cameras is $162,880. Council approved applying for and receiving Body -Worn Camera Program Grant funding through the Office of the Governor Criminal Justice Division in Resolution 16-125 on July 12, 2016. This funding requires a 25% match. Body -Worn Camera Program Grant - $130,300 in grant funds with $32,580 in matching funds available in the Capital Reserve. Approval of the resolution. COuncilmember Samuel moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE PURCHASE OF BODY -WORN CAMERAS FOR USE BY THE POLICE DEPARTMENT FROM WATCHGUARD, OF ALLEN, TEXAS, THROUGH THE STATE OF TEXAS DEPARTMENT OF INFORMATION RESOURCES (DIR) CONTACT, IN THE AMOUNT OF $162,880.00. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 17 — 100 WORK SESSION Review and discuss the utilization of a Federal Earmark on Dowlen Road between US 69 and College Dr. Joe Majdalani, Public Works Director reviewed and discussed the utilization of a Federal Earmark on Dowlen Road between US 69 and College St. Dr. Majdalani discussed the scope of work for the Dowlen Road resurfacing project with an estimated construction cost of $3,200,000, this project would consist of removal of damaged road sections along with curb and gutter. It Was stated that once the base repairs are completed an asphalt concrete pavement will be placed. Sidewalks along the east side of Dowlen Road will be installed along with ADA compliant curb ramps. There was also discussion in regards to pavement limits from College St. to Folsom Dr., sidewalk limits from Phelan Blvd., to Folsom Dr., and turning bay modifications and addition locations; such as modification to the existing right turning bay on Dowlen Rd. and Folsom Dr., modifications to the existing left turning bay and Minutes — May 16, 2016 addition of right turn bay to the Parkdale Mall entrance. COMMENTS Public Comments (Persons are limited to three minutes) Bruce Hoffer 2535 North St. Beaumont TX Spoke to Council in regards to youth soccer, stated that the last time he spoke regarding soccer Beaumont had about 800 kids playing in the fall and about 200 to 300 kids playing in the spring, attendance was just counted and there are now 1,059 in the Spring, the Fall is still pretty consistent there's about 1,100, the City hosted a statewide tournament in April and all games went on fine minus a little bad weather, just wanted to inform Council as to what is transpiring in the soccer world Jes Prince 8079 Labelle Rd. Beaumont TX Announced a free event that will be held at Riverfront Park called Riverfront Rhythms, the event will be on Sunday, May 21, 2017, from 3:00 p.m. to 7:00 p.m., there will be live entertainment from 3:00 p.m. to 5:00 p.m., as well as the Bayou Boys food truck that will be on site, this event is free to the public, would like to encourage everyone to come out and enjoy the food and entertainment Ivory North 5261 Sunset Ave. Beaumont TX Congratulated Council, stated that her and her husband moved to Beaumont about five or six years ago, stated that they live near Lamar University, stated they are working really hard to get some repairs to their street and drainage, they have reached out to their Councilmember Robin Mouton who has helped reach out to Thomas Gill who is over Streets and Drainage, he did make contact with them in April of last year, Mr. Gill promised her that he would repair the street and the drainage, he left his business card with her, she made numerous emails, voice messages etc., with no response, very disappointed with Mr. Gill who is a paid employee and he doesn't have any integrity to do what he says he would do Councilmembers/City Manager/City Attorney comments on various matters With there being no Executive Session, Council adjourned at 3:30 p.m. io available, upon request in the City Clerk's Office..
