HomeMy WebLinkAboutRES 17-105RESOLUTION NO. 17-105 BE ITRESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be 'and he is hereby authorized to execute an Interlocal Agreement with the Beaumont Independent School District (BISD) relating to the School Crossing Guard Program. The Interlocal Agreement is substantially in the form attached hereto as Exhibit "A" and made a part hereof for all purposes. PASSED BY THE CITY COUNCIL of the City of Beaumont this the 23rd day of May, 2017. - To Becky Ames - A STATE OF TEXAS COUNTY OF JEFFERSON INTERLOCAL AGREEMENT This Interlocal Agreement ("the Agreement") is entered into between the City of Beaumont, a municipal corporation of Jefferson County, Texas, (herein "City") and Beaumont Independent School District (herein "BISD"), entities which are authorized to enter into interlocal agreements in accordance with Section 791.001, et seq., of the Government Code of the State of Texas (Vernon 1996). WITNESSETH: WHEREAS, BISD has agreed to administer the School Crossing Guard Program for the benefit of BISD and the City; and NOW, THEREFORE, THE PARTIES HEREBY AGREE AS FOLLOWS: The term of this agreement shall be for three (3) years, beginning on July 1, 2017 and ending on June 30, 2020. A. Obligations of BISD: 1. Provide overall management and administration of the program and its employees. 2. Maintain accurate records for invoicing. These records will be made available for the City to review upon request. 3. BISD will submit two invoices per year. The first invoice will be submitted for payment by January 15 (for the previous year's hours), which will be due by EXHIBIT "A" February 15. The second invoice will be submitted by June 15, which will be due by July 15. 4. Provide a training program for all crossing guards in traffic directions as defined by the basic peace officer course curriculum established by the Commission on Law Enforcement Standards and Education. B. Obligations of City: 1. Provide payment for 50% of the actual cost of the School Crossing Guard Program, not to exceed $90,000 per year. In connection with this Agreement, notification shall be as follows: City of Beaumont Kyle Hayes, City Manager P.O. Box 3827 Beaumont, Texas 77704 and Beaumont Independent School District John W. Frossard, Superintendent 3395 Harrison Avenue Beaumont, Texas 77702 IV. Either party may cancel this agreement without cause by providing 60 - days written notice to the other party of its intent to do so. V This Agreement may be amended by the mutual agreement of the parties hereto in writing and any amendment shall be attached to and incorporated into this Agreement.
