Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on April 11, 2017, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Willie Williams of Starlight Missionary Baptist Church gave the invocation. A video of The National Anthem by the U. S. Army Field Band was played and afterwards, Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Guidroz, Getz, Wright, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Fair Housing Month" - April, 2017 - Proclamation read by Councilmember Guidroz; accepted by Chris Boone, Director of Community Development for the City of Beaumont "Sexual Assault Awareness Month" - April, 2017 - Proclamation read by Councilmember Wright; accepted by Cheryl Williams, Education Specialist, Rape and Suicide Crisis Center "National Safe Digging Month" - April, 2017 - Proclamation read by Councilmember Getz; accepted by Phillip Green, Construction Supervisor for CenterPoint Energy "Beaumont Rice Mills, Inc. Day" - April 15, 2017 - Proclamation read by Mayor Ames; accepted by Lewis Broussard and members of the Broussard Family "Centennial Anniversary of American Red Cross of Southeast and Deep East Texas" - Year of 2017 - Proclamation read by Councilmember Pate; accepted by Chester Jordan, Executive Director of the American Red Cross of Southeast and Deep East Texas Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Councilmember Wright left the meeting at 2:11 p.m. Public Comment: Persons may speak on scheduled agenda items 1 & 2/Consent Agenda. Patsy Guidry 2415 Wescalder Rd. Beaumont TX Spoke to Council regarding Item #2 on the Agenda; A Resolution adopting guidelines for the acceptance of private streets and infrastructure for maintenance by the City of Beaumont CONSENT AGENDA * Approval of minutes — April 4, 2017 * Confirmation of committee appointments - None A) Approve the purchase of a new roof system from SETEX Construction Corp. for Fire Station No. 4 located at 1301 West Lucas — Resolution 17 - 071 B) Accept maintenance of the street, storm sewer, water and sanitary sewer improvements in Deerfield Phase V, Subdivision — Resolution 17 - 072 Councilmember Getz moved to approve the Consent Agenda. Councilmember Mayor Pro Tem Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, PATE AND SAMUEL NAYS: NONE MOTION PASSED Councilmember Wright returned to the meeting at 2:15 p.m. GENERAL BUSINESS 1. Consider an ordinance authorizing the suspension of the effective date of CenterPoint Energy's proposed rate increase until July 13, 2017. On March 30, 2017, CenterPoint Energy ("CenterPoint") filed with the City of Beaumont an annual Gas Reliability Infrastructure Program (GRIP) interim rate adjustment notice to increase gas rates in the Beaumont/East Texas Division Service Area. The City of Beaumont maintains exclusive original jurisdiction over the rates, operations and services of CenterPoint as a gas utility operating in the City of Beaumont. The requested increase would ordinarily go into effect sixty (60) days after giving notice of the intent to increase rates. This ordinance is a request to suspend the effective date of CenterPoint's proposed rate increase for a period of forty-five (45) days until July 13, 2017, in order to review the company's filings for compliance with the Gas Utility Regulatory Act and the company's last base rate case. The review of the company's GRIP filing is limited to a ministerial review of the filings for compliance with the Act. Approval of ordinance. Mayor Pro Tem Mouton moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE OF THE CITY OF BEAUMONT, TEXAS SUSPENDING THE RATES PROPOSED BY CENTERPOINT ENERGY RESOURCES CORP., D/B/A CENTERPOINT ENERGY ENTEX AND CENTERPOINT ENERGY TEXAS GAS ("CENTERPOINT" OR "COMPANY") COMPANY'S GAS RELIABILITY INFRASTRUCTURE PROGRAM ("GRIP") FILING MADE WITH THE CITY ON MARCH 30, 2017; FINDING THAT THE MEETING COMPLIES WITH THE OPEN MEETINGS ACT; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT, AND DECLARING AN EFFECTIVE DATE. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Ordinance 17 - 022 2. Consider a resolution adopting guidelines for the acceptance of private streets and infrastructure for maintenance by the City of Beaumont. The City Council approved guidelines for the acceptance of private streets and infrastructure in February of 2012. The existing guidelines make it very difficult for the owner(s) of a private street to make the necessary repairs needed in order for the City to accept for public use and maintenance. The proposed guidelines will hopefully streamline the process. City staff has identified 63 private streets located within the City of Beaumont. Any requests for private streets and infrastructure to become public would go before the Planning Commission and then to the City Council for approval. Approval of the resolution. COuncilmember GUidroz moved t0 APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES GUIDELINES FOR ACCEPTANCE OF PRIVATE STREETS AND INFRASTRUCTURE FOR MAINTENANCE BY THE CITY OF BEAUMONT. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 17 - 073 COMMENTS None Public Comments (Persons are limited to three minutes) Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS MAYOR PRO TEM MOUTON - THANKED EVERYONE THAT TOOK PART IN THE TRASH OFF ON SATURDAY, APRIL 8, 2017 COUNCILMEMBER SAMUEL - THANKED ALL OF THE CITIZENS THAT CAME OUT FOR THE TRASH OFF COUNCILMEMBER PATE - COMMENTED ON THE TRASH OFF, THANKED EVERYONE FOR COMING OUT, APPRECIATED EVERYONE GETTING INVOLVED, COMPLIMENTED THE YMBL FOR PUTTING ON A FANTASTIC FAIR, ANNOUNCED THAT ON SATURDAY, APRIL 15, 2017, LAMAR UNIVERSITY FOOTBALL TEAM UNDER THE NEW HEAD FOOTBALL COACH MIKE SCHULTZ WILL BE PLAYING A SPRING GAME AT 10:00 A.M. COUNCILMEMBER WRIGHT - COMMENTED ON THE TRASH OFF AND THE YMBL STATE FAIR, AS WELL AS THE NECHES RIVER FESTIVAL PARADE, ANOTHER GREAT DAY IN BEAUMONT, REMINDED EVERYONE THAT EARLY VOTING STARTS ON APRIL 24, 2017, AND ELECTION DAY IS MAY 6, 2017, ENCOURAGED EVERYONE TO GET OUT AND VOTE FOR THE CANDIDATE OF THEIR CHOICE COUNCILMEMBER GETZ - THANKED EVERYONE THAT CAME OUT TO ROGERS PARK AND PARTICIPATED IN THE TRASH OFF, ANNOUNCED THE U.S. ARMY FIELD BAND WILL BE AT THE JULIE ROGERS THEATRE ON SATURDAY, APRIL 15, 2017, AT 7:00 P.M., STATED THAT EVEN THOUGH THE CONCERT IS FREE A TICKET IS STILL NEEDED, ANYONE WISHING TO ATTEND CAN CALL THE BEAUMONT CIVIC CENTER TO GET TICKETS, WISHED EVERYONE A HAPPY PASSOVER COUNCILMEMBER GUIDROZ - COMMENTED ON THIS BEING HOLY WEEK, THANKED CHRIS BOONE, PLANNING AND ZONING DIRECTOR, FOR ALL THAT HE DOES FOR THE CITY AS WELL AS DR. MAJDALANI, PUBLIC WORKS DIRECTOR, THANKED ALL OF THE CITIZENS THAT CAME OUT FOR THE TRASH OFF AT KLEIN PARK, ANNOUNCED A TXDOT MEETING ON TUESDAY, APRIL 11, 2017, AT 6:00 P.M., THE DISCUSSION WILL BE IN REGARDS TO THE PINE BAYOU ROAD/HIGHWAY AND BOAT RAMP, ALSO ANNOUNCED THE CREATIVE FOUNDATIONS EVENT ON THURSDAY AT 6:30 P.M., AT THE BEAUMONT CIVIC CENTER, THE FOUNDATION IS WANTING TO SPONSOR ONE HUNDRED STUDENTS PER YEAR WITH SCHOLARSHIPS TO LIT CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - COMMENTED ON THE TRASH OFF, THANKED THE MAYOR, COUNCILMEMBERS AND CITY STAFF THAT HELPED MAKE THE TRASH OFF A SUCCESS MAYOR AMES - COMMENTED ON THE NECHES RIVER FESTIVAL PARADE, THIS IS THE FIRST TIME THAT THEY DECIDED TO HAVE THE PARADE DOWNTOWN IN FRONT OF CITY HALL AND THE ATTENDANCE WAS AWESOME, HOPE THAT THEY WILL CONTINUE TO HAVE THE PARADE DOWNTOWN, ALSO COMMENTED ON A SMALL EVENT THAT WAS PUT ON BY THE NECHES RIVER FESTIVAL, THE PRINCESSES AND THE QUEEN RAISE MONEY TO GIVE BOOKS TO ST. ELIZABETH FOR THE CHILDREN THIS IS SOMETHING THAT IS BEING ENCOURAGED FOR THE KIDS THAT ARE INVOLVED IN THE NECHES RIVER FESTIVAL TO GIVE BACK TO THE COMMUNITY, ANNOUNCED THE U.S. ARMY BAND AT 7:00 P.M., AT THE JULIE ROGERS THEATRE, AS WELL AS THE CREATIVE FOUNDATIONS EVENT THAT WILL BE AT THE SAME TIME, AT THE BEAUMONT CIVIC CENTER, ALSO ANNOUNCED THE CHAMPAGNE AND RIBS EVENT THAT WILL BE ON NEXT THURSDAY, APRIL 20, 2017, AT 6:30 P.M., AT FORD PARK Open session of meeting recessed at 2:29 p.m. EXECUTIVE SESSION * Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: 2175 W.
