Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on April 4, 2017, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on the Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Father Anthony P. Clark, with St. Mark's Episcopal Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Guidroz, Getz, Wright, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Crime Victims' Rights Week" - April 2 - 8, 2017 - Proclamation read by Mayor Ames; accepted by Darla Daigle, Education Specialist, with Rape and Suicide Crisis of South East Texas along with George Heartsfield with Boys Haven Public Comment: Persons may speak on the Consent Agenda. None CONSENT AGENDA Approval of minutes — March 28, 2017 Confirmation of committee appointments - None A) Approve a six month contract for the purchase of sodium hydroxide from TDC, LLC of Houston for use by the Water Utilities Department — Resolution 17 — 062 Minutes —April 4, 2017 B) Approve a six month contract for the purchase of liquid chlorine from Brenntag Southwest, Inc., of Houston for use by the Water Utilities Department — Resolution 17 - 063 C) Approve a one year contract with ANA -Lab Corporation, of Houston for laboratory testing services in the Water Utilities Department — Resolution 17 - 064 D) Approve Change Order No. 27 to the contract with the Texas Department of Transportation (TxDOT) for the Concord Road Project — Resolution 17 - 065 E) Authorize the Chief Financial Officer to execute all documents necessaryto accept funding from the Texas Department of State Health Services (DSHS) to assist the Beaumont Public Health Department's Immunization Division — Resolution 17 - 066 F) Authorize the Chief Financial Officer to execute all documents necessary to accept funding from the Texas Department of State Health Services (DSHS) as a part of the Regional Local Services System/Local Public Health Services Grant Program — Resolution 17 - 067 G) Authorize the Chief Financial Officer to execute all documents necessary to accept funding from the Texas Department of State Health Services (DSHS) related to a Public Health Emergency Preparedness grant - Resolution 17 - 068 H) Authorize the Chief Financial Officer to execute all documents necessary to accept funding from the Texas Department of State Health Services (DSHS) related to a TB/PC Tuberculosis Prevention Control/State grant - Resolution 17 - 069 1) Approve a resolution opposing Senate Bill 1524 - Resolution 17 - 070 Mayor Pro Tem Mouton moved to approve the Consent Agenda. Councilmember Sam seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED WORK SESSION Review and discuss the use of three federal earmarks for various street Projects. Dr. Joe Majdalani, Public Works Director, reviewed and discussed utilization of three federal earmarks related to the Dowlen (College to Walden) Project and the Washington (Langham to Major) Project. Dr. Majdalani, discussed the initial earmark 1 and the revised initial earmark 1 for Washington Blvd., 7th Street, Tyrrell Park Loop and 11th Street. There was also discussion on the Project Specific Data, such as width, length and estimated cost for all of the streets listed. Discussion was also held in regards to Washington at Dowlen extension and Washington widening project, as well as the Washington Blvd., from West Beaumont City limit to Highway. Minutes — April 4, 2017 Review and discuss private streets located within the City of Beaumont. City Manager, Kyle Hayes, discussed private streets located within the City of Beaumont. He discussed private streets in each Ward. Ward 1 has 25 private streets; Ward 2 has 26 private streets; Ward 3 has 7 private streets and Ward 4 has 5 private streets. The City manager spoke about the private streets in each Ward that were determined to be in very poor condition. COMMENTS Public Comments (Persons are limited to three minutes) Jason Marshburn 1070 Monterrey Dr. Beaumont TX Spoke to Council in regards to streets, stated that he realizes that the City doesn't have enough money to do the streets that already are in need of repair, stated he's not in favor of the City taking on more streets right now, main focus should be on the arterial and collector streets, those streets should be done with concrete, curbs and gutters, main focus should also be to develop the commercial areas, also likes the idea of Parkway North, need to get citizens from other cities to spend money in Beaumont, the more retails that we can bring to the City the better, stated that Stagg Drive in front of Gateway shopping center is pretty bad and needs repairs and Old Dowlen is probably the worst street in Beaumont Wilferd Richard 3680 Blossom Dr. Beaumont TX Asked why the City is continuing to spend money on new projects and new roads instead of the streets that are inside the city limits that's already bad, asked that Council pass down Washington Blvd., after dark, wanted to know where the street lights are, there were street lights before the project started and they have not been put back, the street is very dark, also asked about the North Parkway project, why is the City spending money on that project out of the oil and gas royalties, stated that he thought Council wasn't going to pay for any street projects out of the oil and gas royalties Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER GUIDROZ - INVITED EVERYONE TO COME OUT AND TAKE PART IN THE TRASH OFF THIS COMING SATURDAY, LAST TIME HE CHECKED THERE WERE OVER 60 CITIZENS THAT SIGNED UP AT KLEIN PARK WHICH IS IN HIS WARD, STATED THAT THE DISC GOLF PEOPLE ARE EXCITED BECAUSE THE CITY HAS DONE A NUMBER OF IMPROVEMENTS FOR DISC GOLF AT THAT PARK, ANNOUNCED THAT ON SATURDAY, APRIL 8, 2017, THE OAKS PRESERVATION BASH WILL TAKE PLACE COUNCILMEMBER GETZ - STATED THAT HE WILL BE AT ROGERS PARK ON SATURDAY MORNING FOR THE TRASH OFF, HOPES TO SEE HIS CONSTITUENTS THERE, COMMENTED ON THE STREETS, STATED THAT THE BIGGEST COMPLAINT THAT THEY HEAR IS Minutes — April 4, 2017 STREETS, ALL OF COUNCIL KNOWS THAT STREETS ARE EXPENSIVE AND THERE IS NO EASY MONEY JUST LYING AROUND, THE NEXT COUNCIL THAT COMES IN LOOKING TO BORROW WILL HAVE TO THINK ABOUT WHERE THE MONEY IS GOING TO COME FROM, YOU CAN'T BUILD STREETS WITHOUT MONEY, STATED THAT THE $15 MILLION REHAB THAT HAS BEEN DONE FOR THE LAST COUPLE OF YEARS IS IMPORTANT, THERE WILL HAVE TO BE SOME OTHER SOURCE OF REVENUE AND THAT MIGHT MEAN A TAX RATE INCREASE FOR NEW PROJECTS COUNCILMEMBER WRIGHT - STATED THAT SHE CONCURS ABOUT THE STREET SITUATION, SOME TIME AGO SHE BROUGHT UP AN IDEA ABOUT A BOND ELECTION, TO GET THE STREETS AND INFRASTRUCTURE REPAIRED, THIS IS SOMETHING THAT THE CITIZENS WOULD VOTE ON, SHE ISN'T ADVOCATING A TAX INCREASE AT ALL TO GET THE STREETS FIXED, JUST WANTED THAT TO BE AN ALTERNATIVE, ENCOURAGED EVERYONE TO ATTEND THE TRASH OFF ON SATURDAY MORNING COUNCILMEMBER PATE - THANKED DR. MAJDALANI AND HIS STAFF FOR PUTTING THE OPTIONS TOGETHER THAT WERE PRESENTED TO COUNCIL ON TODAY AS WELL AS THEIR WORK WITH TXDOT, MENTIONED THE TRASH OFF ON SATURDAY MORNING, ENCOURAGED CITIZENS TO GET OUT AND PICK UP SOME TRASH COUNCILMEMBER SAMUEL - COMMENTED ON THE STREETS IN THE CITY, STATED THAT THEY WON'T NEED A BOND ISSUE TO MAKE PROGRESS, THAT IS ALREADY HAPPENING WITH THE IMPLEMENTED STREET MAINTENANCE PROGRAM WHERE THEY ARE SPENDING $15 MILLION OVER A TWO YEAR PERIOD, IT'S NOT LIKE THE CITY ISN'T WORKING ON GETTING AS MANY STREETS AS POSSIBLE REPAIRED, WANTS TO BE CLEAR THAT THE CITY IS MAKING PROGRESS, THERE'S A LONG WAY TO GO BUT THEY ARE MAKING STRIDES, THE CITY HAS A VERY SOUND FUND BALANCE, SO IF THERE IS SOMETHING UNEXPECTED THAT MAY OCCUR THE CITY CAN TAKE CARE OF THE UNEXPECTED, ENCOURAGED CITIZENS IN WARD III TO GO TO STERLING PRUITT CENTER OR CHARLTON POLLARD PARK AS A MEETING PLACE FOR THE TRASH OFF MAYOR PRO TEM MOUTON - THANKED COUNCILMEMBER SAMUEL FOR HIS STATEMENTS ABOUT THE STREETS, STATED THAT THERE ARE BAD STREETS ALL OVER THE CITY, THEY WOULD LIKE TO HAVE THEM ALL REPAIRED BUT IT'S IMPOSSIBLE TO DO THAT, THERE IS A BALANCE, THE STREETS ARE A PROBLEM AND COUNCIL IS AWARE OF THE STREET PROBLEMS AND THEY ARE ADDRESSING THEM, STATED SHE WILL BE AT ALICE KEITH PARK AND AT TERRELL PARK FOR THE TRASH OFF, Minutes —April 4, 2017 ENCOURAGED EVERYONE TO COME OUT AND JOIN IN, THERE IS STILL TIME TO SIGN UP AT THE CITIES WEB SITE CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - COMMENTED ON THE STREETS, MENTIONED THE $15 MILLION THAT WAS BORROWED WHICH IS A DEBT SERVICE THAT HAS TO BE PAID BACK, IF THERE WAS A BOND ELECTION AND IT WAS APPROVED BY THE CITIZENS, THERE WOULD STILL BE A TAX INCREASE BECAUSE THE BOND WOULD HAVE TO BE PAID FOR, ALSO MENTION THE TRASH OFF ON SATURDAY, ASKED THAT EVERYONE SHOW UP AT ONE OF THE AREAS IN THE CITY AND HELP PICKUP TRASH, THERE IS STILL TIME TO SIGN UP ONLINE, YOU JUST WON'T BE ABLE TO GET A T-SHIRT, ANNOUNCED ON FRIDAY NIGHT IN DOWNTOWN BEAUMONT THE NECHES RIVER FESTIVAL PARADE WILL START AT 5:30 P.M., THE PARADE WILL START IN FRONT OF CITY HALL, ENCOURAGED ALL CITIZENS TO ATTEND THE PARADE Open session of meeting recessed at 3:05 p.m. There being no action taken in Executive Session, Council adjourned. the City Clerk's Office.
