WHEREAS, Christian Fellowship Worship Center, Inc., has agreed to donate
0.067 acres of land situated in the W. B. Dyches Survey, Abstract No. 17, as shown and
described in Exhibit 1," attached hereto, to the City of Beaumont for the Pointe
Parkway North Project and,
WHEREAS, the City Council has considered the donation of said tract of land
and is of the opinion that the delivery and receipt of said tract for the stated purpose is
necessary and desirable and that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT the donation of the above described property donated by Christian
Fellowship Worship Center, Inc. is hereby in all things accepted; and,
BE IT FURTHER RESOLVED THAT the City Manager is hereby authorized to
execute all documents necessary to accept said donation.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 14th day of
February, 2017.

That, CHRISTIAN FELLOWSHIP WORSHIP CENTER, INC., a Texas nonprofit
corporation, of the County of Jefferson, State of Texas, hereinafter called GRANTOR GIVES,
DONATES, GRANTS AND CONVEYS, as a gift, with no reversionary right or interest in and
to the property retained, subject to the reservations and exceptions hereinafter made, and by these
presents does GIVE, DONATE, GRANT AND CONVEY unto the CITY OF BEAUMONT,
a municipal corporation, domiciled in Jefferson County, Texas, hereinafter called GRANTEE,
P. O. Box 3827, Beaumont, Texas 77704, and to its successors and assigns forever the property
described in Exhibit "A'.', attached hereto and made a part hereof for all purposes.
GRANTOR does hereby except and reserve from this conveyance unto itself, its
successors and assigns, forever, all of the oil, gas, and sulphur in and under the land herein
conveyed but waives all rights of ingress and egress to the surface thereof for the purpose of
exploring, developing, mining or drilling for same.
This conveyance is expressly made subject to all zoning laws and to restrictions,
covenants, conditions, easements and mineral and/or royalty reservations, if any, effecting the
property. TO HAVE AND TO HOLD the above described premises together with all and
singular the rights and appurtenances thereto and in any wise belonging, unto the said
GRANTEE and GRANTEE'S successors and assigns, forever; and said GRANTOR binds
themselves and their successors and assigns to warrant and forever defend all and singular the -

said premises unto the said GRANTEE and GRANTEE'S successors or assigns, against every
person lawfully claiming or to claim all or any part of the property, subject to the provisions
stated above, when the claim is by, through, or under GRANTOR but not otherwise.

METES AND BOUNDS DESCRIPTION OF A 0.067 ACRE TRACT OF LAND
SITUATED IN AND A PART OF THE W. B. DYCHES SURVEY, ABSTRACT No. 17
JEFFERSON COUNTY, TEXAS
Being a 0.067 acre tract or parcel of land lying and being situated in Jefferson County, Texas, a part of the
W. B. DYCHES SURVEY, ABSTRACT No. 17, and being a part of and out of Tract J of Highlands
Pointe' II Subdivision, recorded under Clerk's File No. 2008016321 in the Official Public Records of
Jefferson County, Texas and being a portion of that certain tract of land (called "10.0187 acres")
described in that certain instrument to Christian Fellowship Worship Center, Inc., recorded under Clerk's
File No. 2006029008 in the Official Public Records of Jefferson County, Texas, and the said 0.067 acre
tract being more particularly described by metes and bounds as follows:
FOR LOCATIVE PURPOSES COMMENCING at a 1/2" iron rod with cap marked "Access" found
for an interior "ell" comer of Pointe Parkway, a public dedicated Right -of -Way, the said corner being in a
curve with a radius of 1000.00 feet, and the said 1/2" rod having a State Plane Coordinate value of
N 13,986,101.91' and E 3,491,520.89';
THENCE South 86 deg. 26 min. 12 sec. East, a total distance of 10.00 feet to a 1/2" steel rod with cap
marked "AW&C LLC" set for the southwest corner and POINT OF BEGINNING of the said herein
described tract of land, and having a State Plane Coordinate value of N 13,986,101.29' and E
3,491,530.87';
THENCE along and with a curve to the right having a radius of 990.00 feet, a central angle of 12 deg. 46
min. 53 sec., an arc length of 220.85 feet, a chord bearing of North 10 deg. 02 min. 29 sec. East and a
chord length of 220.39 feet to a 1/2" iron rod with cap marked "Access" found in the most southerly line
of that certain tract of land (called "14.553 acres"), described in that certain instrument to The City Of
Beaumont, recorded under Clerk's File No. 2014018397 in the Official Public Records of Jefferson
County, Texas, and most northerly line of the hereinbefore said 10.0187 acres tract for the northwest
corner of the said herein described tract of land;
THENCE South 51 deg. 27 min. 09 sec. East, along and with the said most southerly line of the 14.553
acres tract and most northerly line of the 10.0187 acres tract, a total distance of 19.72 feet to a 1/2" steel
rod with cap marked "AW&C LLC" set for the northeast corner of the said herein described tract of land;
THENCE South 16 deg. 40 min. 49 sec. West, over and across the said 10.0187 acres tract, a total
distance of 65.23 feet to a 1/.2" steel rod with cap marked "AW&C LLC" set for the beginning of a curve
to the left;
THENCE, along and with said curve to the left having a radius of 610.00 feet, a central angle of 13 deg.
39 min. 13 sec., an arc length of 145.36 feet, a chord bearing of South 09 deg. 51 min. 13 sec. West and a
chord length of 145.02 feet to a 1/2" steel rod with cap marked "AW&C LLC" set for the southeast comer
of the said herein described tract of land;

THENCE North 86 deg. 26 min. 12 sec. West, continuing over and across the said 10.0187 acres tract, a
total distance of 10.33 feet and returning back to the POINT OF BEGINNING of the said herein
described tract of land and containing 0.067 acre of land, more or less.
