Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on October 18, 2016, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Reverend Freddy Wright with North Point Community Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Guidroz, Getz, Wright, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Down Syndrome Awareness Month" - October, 2016 - Proclamation read by Councilmember Pate; accepted by Gary Hidalgo, Executive Director of ARC of Beaumont along with Cindy Bloodsworth Jeanis, Matthew Bloodsworth and others "Texas Red Ribbon Campaign Celebration Week" — October 23-31, 2016 - Proclamation read by Mayor Ames; accepted by Audrey Bowser Collins, Principal of Amelia Elementary and Reverend Freddy Wright, with North Point Community Church, Agent Timothy Duriso, with the DEA Administration and David Moore Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda. None CONSENT AGENDA * Approval of minutes — October 11, 2016 Minutes — October 18, 2016 * Confirmation of committee appointments - None A) Approve compensation for the City Clerk — Resolution 16 - 200 B) Authorize the City Manager to reject an Earnest Money Contract for the sale of 125 Magnolia Avenue - Resolution 16 - 201 C) Approve an annual contract for the purchase of lime slurry from LaHoist North America, Inc. of LaPorte for use by the Streets and Drainage Division - Resolution 16 - 202 Councilmember Getz moved to approve the Consent Agenda. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution authorizing the City Managerto award a bid to MK Constructors, Inc., of Vidor for the construction of the Northwest Parkway Project (From Major Drive to Parkdale Mall Loop). Northwest Parkway will connect Parkdale Mall with Major Drive, Folsom Drive and Old Dowlen Road. The connection with Major Drive will be through Homsar Boulevard and the connection with Folsom Drive will be through Pointe Parkway. The new four (4) lane roadway will relieve traffic congestion on Dowlen Road by providing alternate routes to the City's major thoroughfares. On September 22, 2016, five (5) formal bids were received. The bid totals are shown in the table below. Contractor Location Bid MK Constructors Vidor, Texas $12,109,789.38 Brystar Contracting, Inc. Beaumont, Texas $13,445,330.23 APAC Beaumont, Texas $14,709,201.06 ALLCO Beaumont, Texas $14,762,879.42 L&L General Contractors Beaumont, Texas $16,102,090.53 On October 12, 2016, City staff and the City's engineering consultant, Chica and Associates, Inc., met with MK Constructors, Inc., representatives to discuss initial concerns regarding their bid amount being significantly lower than the estimated construction cost and their ability to complete the project within budget. MK Constructors, Inc. provided a concise plan of construction and explained how their planned construction methods will result in lower costs. Following this meeting Chica and Associates, Inc., provided the City with a letter recommending award to MK Constructors, Inc. Public Works/Engineering is in agreement with the consultant's recommendation. Minutes — October 18, 2016 Approval of resolution. COuncllmember Guidroz moved to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY MK CONSTRUCTORS, OF VIDOR, TEXAS, IN THE AMOUNT OF $12,109,789.38 FOR A CONTRACT FOR THE NORTHWEST PARKWAY PROJECT (FROM MAJOR DRIVE TO PARKDALE MALL LOOP) BE ACCEPTED BY THE CITY OF BEAUMONT AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH MK CONSTRUCTORS, OF VIDOR, TEXAS. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 16 - 203 2. Consider a resolution authorizing the City Manager to execute an agreement with CDM Smith, Inc. of Houston to continue management of the Municipal Separate Storm Sewer System (MS4) Permit for the City of Beaumont for Fiscal Year 2017. On October 16, 2012, by Resolution No. 12-249, City Council awarded CDM Smith, Inc. of Houston, Texas an agreement for Professional Engineering Services to manage the Municipal Separate Storm Sewer System (MS4) Permit. The manager of the permit conducts dry and wet weather screenings of our five major outfalls in the City. Under the permit, the City is required to submit an annual report summarizing activities and results of the screenings and other inspections conducted throughout the year which CDM Smith, Inc., will complete on the City's behalf. Approval of resolution. COuncilmember Pate moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE AN ENGINEERING SERVICES AGREEMENT BETWEEN THE CITY OF BEAUMONT AND CDM SMITH INC., OF HOUSTON, TEXAS, IN AN AMOUNT NOT TO EXCEED $250,000, TO CONTINUE MANAGEMENT OF THE MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) PERMIT ON BEHALF OF THE CITY OF BEAUMONT. Councllmember Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 16 - 204 3. Consider a resolution authorizing the City Manager to sign all documents necessaryfor the City of Beaumont to receive funding through the Department of Homeland Security 2016 Port Security Grant Program (PSGP). Minutes - October 18, 2016 The Homeland Security Grant Program consists of a number of grants, one of which is the Port Security Grant Program (PSGP). This grant is utilized to enhance the security of the Port of Beaumont and the agencies that support it. The City will spend $838,000 to upgrade the eleven (11) dispatch consoles and related computers used by Police and Fire Dispatch. In addition, $133,000 will be spent to purchase nineteen (19) mobile radio replacements for Fire and EMS vehicles as well as purchases to replace approximately 475 radio batteries for Police and EMS that have reached their end -of -life. Approval of the resolution. Mayor Pro Tem Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO RECEIVE AND EXECUTE ALL DOCUMENTS NECESSARY FOR THE GRANT FUNDING THROUGH THE DEPARTMENT OF HOMELAND SECURITY 2016 PORT SECURITY GRANT PROGRAM (PSGP) IN THE AMOUNT OF $728,250.00. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 16 — 205 Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. COMMENTS Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER GUIDROZ - COMMENTED ON THE LAMAR TENNIS CLUB, STATED THAT THEY HOSTED SEVENTEEN UNIVERSITIES FROM ACROSS THE STATE, ALL TEAMS PLAYED AT THE BEAUMONT TENNIS CENTER TO COMPETE TO GO TO NATIONALS, ATTENDED OKTOBERFEST WHICH WAS AWESOME, COMMENDED COUNCILMEMBER GETZ AND OTHERS FOR ALL THE WORK THAT HE DID TO MAKE IT A SUCCESS, ALSO COMMENTED ON LAMAR UNIVERSITY FOOTBALL AS WELL AS THE INCIDENT THAT OCCURRED AT WEST BROOK HIGH SCHOOL, THE NEXT MORNING AFTER THE INCIDENT THERE WAS A GROUP OF STUDENTS THAT WERE IN A CIRCLE PRAYING FOR THEIR SCHOOL COUNCILMEMBER GETZ - SPOKE REGARDING OKTOBERFEST AND HOW GREAT IT WAS, THERE WERE OVER 5,000 PEOPLE IN ATTENDANCE, ANNOUNCED THE DOWLEN/WEST NEIGHBORHOOD Minutes — October 18, 2016 ASSOCIATION MEETING ON TUESDAY, OCTOBER 18, 2016, AT ROGERS PARK, THE BEAUMONT POLICE DEPARTMENT WILL BE IN ATTENDANCE TO DISCUSS HOW CITIZENS CAN ENGAGE IN PERSONAL PROTECTION AND THINGS TO BE AWARE OF AS WE APPROACH THE HOLIDAY SEASON, STATED THAT IT HAS BEEN BROUGHT TO HIS ATTENTION THAT NOT ALL CITIZENS CAN ATTEND MOST OF THE CITY COUNCIL MEETINGS, SUGGESTED THAT COUNCIL CONSIDER MAYBE HAVING AN EVENING MEETING WHEN THERE IS A LIGHT AGENDA, EACH MEETING WOULD TAKE PLACE QUARTERLY WITHIN EACH WARD COUNCILMEMBER WRIGHT - THANKED THE ELEVEN OR SO CITIZENS THAT CONTACTED HER IN REGARDS TO HOW MUCH IT WOULD COST FORA BOND ELECTION, STATED THAT IF SHE COULD GET TWENTY MORE CITIZENS TO CONTACT HER, SHE WILL BE ASKING COUNCIL TO HAVE A WORKSESSION IN REGARDS TO A BOND ELECTION COUNCILMEMBER PATE - STATED THAT HE ATTENDED OKTOBERFEST WHICH WAS WELL ATTENDED AND HAD A GREAT TIME, FROM THERE HE WENT TO THE LAMAR UNIVERSITY FOOTBALL GAME, ANNOUNCED THAT COACHES HARMONY AND PRICE WITH LAMAR WILL BE HAVING A TIP OFF LUNCHEON FUNDRAISER ON SATURDAY, OCTOBER 22, 2016 COUNCILMEMBER SAMUEL - STATED THAT HE SPOKE WITH A SMALL GROUP OF HIS CONSTITUENTS, THERE IS AN ISSUE WITH TWO MOBILE HOME TRAILERS THAT HAVE BEEN MOVED ONTO TWO PIECES OF PROPERTY IN THE 4000 BLOCK OF BENNETT ST., WHICH IS A VACANT LOT, WOULD LIKE THE INSPECTORS TO CHECK ON THIS MAYOR PRO TEM MOUTON - GAVE CONDOLENCES TO THE FAMILY OF BEAUMONT NATIVE AIRMAN 1ST CLASS, ISAAC COLLIGAN, WHO WAS KILLED IN A ONE -VEHICLE CRASH IN JAPAN, CONGRATULATED COUNCILMEMBER SAMUEL ON BEING ONE OF FIFTEEN TO BE NOMINATED TO THE NLC NOMINATING COMMITTEE, ENCOURAGE EVERYONE TO PARTICIPATE IN THE BUDDY WALK ON SATURDAY, OCTOBER 22, 2016, AT THE BEAUMONT EVENT CENTRE, AT 10:00 A.M., ANNOUNCED THAT THIS WEEK IS ANTI -BULLYING WEEK, IEA WILL BE HAVING THEIR FALL FESTIVAL/OPEN HOUSE OCTOBER 18, 2016, FROM 4:30 P.M. MCNICHOLAS, HIS FUNERAL SERVICES WERE ON MONDAY, OCTOBER 17, 2016, HE ALSO SERVED AS THE FORMER CHIEF MAGISTRATE AT THE CITY OF BEAUMONT'S MUNICIPAL COURT, ALSO COMMENTED ON THE BUDDY WALK, ENCOURAGED EVERYONE TO GO OUT AND SUPPORT THEM Public Comments (Persons are limited to three minutes) Officer D.T. Jackson 700 Main St. Beaumont TX Spoke to Council regarding the Citizens Safety Presentations, the presentations aren't geared towards any one Ward, they are being presented throughout the City, there was one scheduled at Alice Keith, on Monday, October 17, 2016, no one showed up, wanted to inform the public and Council that there will be one on tonight (October 18, 2016) at Rogers Park as stated by Councilmember Getz, there will be another presentation on October 20, 2016, at Sterling Pruitt Activity Center, from 7:00 p.m. to 8:00 p.m., this presentation is geared toward general safety on how to be less of a target as a victim and especially geared towards holiday safety such as traveling and being out at the mall etc. William Johnson 1045 Madison St. Beaumont TX Spoke to Council in regards to his property taxes, doesn't understand why his taxes have increased, stated that he filled out a form for a senior citizen discount that decreased his taxes as he has reached 65 years of age, now he has received a tax statement and his taxes have tripled, would like to know why his taxes have increased Reynard Rigues 2350 Pecos St. BeaumontTX Spoketo Council in regards to a home that he owns in Oaks Historic District, stated that he has been bumping heads with Building Codes and feels like he's being harassed by that department, would like to know what council can do regarding this issue, stated that he has to go through Planning and Zoning, then to Council just to get a permit, would like to know how he can expedite getting a permit without having to go through the different meetings, all of this delays work with the contractors and is costing him money, also stated that he never sees the presence of police in the neighborhood and would like to see more police presence EXECUTIVE SESSION Consider matters related to employment, evaluation and duties of a public officer or employee in accordance with Section 551.074 of the Government Code, to wit: City Attorney — Tyrone E.
