HomeMy WebLinkAboutRES 16-156RESOLUTION NO. 16-156 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be and he is hereby authorized to update and execute a memorandum of agreement with Beaumont Preservation Partners, LLC, which is providing parking shelter for vehicles and equipment belonging to the City of Beaumont during times of emergency operations. L- yor Becky Ames - 4t,'Oatl MEMORANDUM OF AGREEMENT BETWEEN CITY OF BEAUMONT AND BEAUMONT PRESERVATION PARTNERS, LLC FOR THE PARKING GARAGE AT 505 ORLEANS 1. PURPOSE: This agreement outlines actions of Beaumont Preservation Partners, LLC in providing access to the parking garage at 505 Orleans for the purpose of sheltering vehicles assigned to members of the City of Beaumont Emergency Management Operations Center and the Beaumont Police Department. This memorandum is developed in the event of disaster or in the confirmed anticipation thereof, particularly with regard to anticipated hurricane strikes to this region. This written memorandum supplements ongoing verbal agreements, supports preparedness, and facilitates available reimbursement for this support during the recovery phase. 2. AUTHORITY: Approval by Ted Moore III, the Beaumont Police Department Chief of Police and the City of Beaumont City Manager. 3. GENERAL: a. SCOPE: This Memorandum of Agreement provides documentation for support between the City of Beaumont on behalf of the Beaumont Police Department (BPD) and Beaumont Preservation Partners, LLC, the current owner of the Orleans Plaza Building parking garage located at 505 Orleans. Actions and agreements herein apply only to the participating parties and are not intended to supersede existing regulations or agreements. Further, it does not mandate sheltering vehicles in the parking garage, but only provides availability for sheltering appropriate vehicles for up to 72 hrs. If a term of this agreement is inconsistent with higher authority, then that term shall be invalid, but the remaining terms and conditions of this agreement shall remain in full force and effect. b. ASSUMPTIONS: (1) BPD will shelter personal and city vehicles as space allows. (2) BPD will provide entry control for the parking garage as necessary; allowances shall include the free ingress and egress of building owners and building management. (3) BPD personnel and equipment will be allowed unrestricted and unescorted entry to the parking garage. (4) Notification by BPD personnel of intent to initiate shelter operations using this parking garage will be made as early as the need becomes evident, or when mandatory evacuation is announced for hurricane -related disasters. (5) Beaumont Preservation Partners, LLC will allow access to the parking garage as needed, in accordance with Section 3.b.4, supra. (6) In the event BPD assistance is desired, contact may be made in person, or through the EXHIBIT "A" police dispatch emergency line, 832-1234, or non -emergency line, 880-3865 if communication lines are operational. Specific points of contact are listed below. (7) Beaumont Preservation Partners, LLC will make provisions to minimize employee use and transit of the parking garage while police vehicles are stored therein to the extent possible by existing contracts with tenants. 4. RESPONSIBILITIES: a. FINANCIAL MANAGEMENT: No expenditures or purchases will be encumbered by any party through this agreement. b. LOGISTIC SUPPORT: No logistical support is anticipated for this agreement. c. OPERATIONAL SUPPORT: No operational support is anticipated at this time. d. AGREEMENT AND ADMINISTRATION: All parties place this Memorandum of Agreement in full force and effect upon signature. This is a binding contract, which shall remain in full force and effect for an indefinite period; however, for the purposes of unforeseen termination, a `month-to-month' termination clause shall remain in full force and effect throughout. This clause shall be executed via a (30) day written notice from either party. e.
