HomeMy WebLinkAboutR&R 103.09 NEW 2-2011_Jury DutyEffective: Revised: Replaces: 2/5/2011 103.011 103.09 — Jury Duty Leave I. Guiding Philosophy Jury duty is a serious responsibility of citizenship. We do our best to balance and fulfill our civic duties with our mission of being effective emergency services providers. II. Purpose The purpose of this policy is to define the standard system of administering jury duty leave within Beaumont Fire -Rescue Services. III. Goals The goals of this policy are to: A. Communicate a statement of intent relative to regulatory parameters. B. Set the standards related to administration of jury duty leave, associated documentation and behavioural expectations, and the consequences of non- compliance. IV. Definitions A. Jury Duty — Obligation of a citizen to serve on a jury when called. One of the highest duties of citizenship, it accrues from the constitutional right to be tried by a panel of one's peers and involves direct participation in the administration of justice. When summoned for a jury duty, a citizen must appear before the court or be tried for contempt of court. V. Statement of Intent A. Jury duty leave is regulated by City Policy 2.8 -Jury Duty, unless otherwise specified in these regulations. B. Members will not be paid for jury duty leave unless they provide adequate documentation in accordance with this policy. VI. Administration of Jury Duty Leave A. The member will notify his/her Deputy Chief of his/her: 1. Summons for jury duty on his/her first shift at work after receiving the summons. 2. Interim selection for jury duty as soon as possible after he/she is made aware of the selection. B. If a member requests postponement of or exemption from jury service for work- related reasons, he/she should contact the Fire Chief's office for appropriate documentation. C. When participating injury duty from on duty, the member will complete the Jr Service Information form and return it to his/her Division/Deputy Chief at the end of the jury duly period. D. The Deputy/Division Chief will sign the form and forward it to Fire Administration no later than the following business day. E. Time on jury duty leave for civil service members will be coded JP in both the Firehouse and HTE payroll systems. VII. Consequences of Non -Compliance A. Because abuse of jury duty leave is a serious offense, supervisors will initiate appropriate actions to investigate and document whether abuse has occurred. B. Members with knowledge of abuse of jury duty leave are obliged to report infractions through their chain of command. C.
