Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on May 10, 2016, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-2/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor "Big" Jim Salles of West End Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Getz, Councilmembers Guidroz, Pate, Samuel and Mouton. Absent: Councilmember Wright. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney, Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "National Transportation Month" - May 17-23, 2016 - Proclamation read by Councilmember Samuel; accepted by Jay Shutter, President of the Sabine District Transportation Club "National Mental Health Month" - May, 2016 - Proclamation read by Councilmember Guidroz; accepted by Monique Sennet with Spindletop Center "Sales Management and Professional Day" - May 12, 2016 - Proclamation read by Mayor Pro Tem Getz; accepted by Paul Skinner "Jim Gilligan Days" - May 13-15, 2016 - Proclamation read by Councilmember Pate; accepted by Coach Jim Gilligan; as well as players Will Hibbs and Travis Moore, and head coach in waiting Will Davis "Public Service Recognition Week" - May 9-13, 2016 - Proclamation read by Councilmember Mouton; accepted by Lillie Babino, Human Resource Director and Public Service Recognition Committee Members Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Minutes — May 10, 2016 Public Comment: Persons may speak on scheduled agenda items 1-2/Consent Agenda. None CONSENT AGENDA Approval of minutes — May 3, 2016 Confirmation of committee appointments - None A) Approve a resolution approving the City of Beaumont Investment Policy Resolution 16 - 082 B) Approve a resolution authorizing a contract with Moncla's Inc. of Beaumont for the 2016 Summer Food Service Program — Resolution 16 - 083 AYES: MAYOR AMES, MAYOR PRO TEM GETZ, COUNCILMEMBERS GUIDROZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider a resolution approving the purchase of three transit buses from Creative Bus Sales of Irving for use by Beaumont Municipal Transit. A request for proposal (RFP) was solicited from four (4) bus manufacturing companies. One (1) response was received. A panel of City employees evaluated and scored the vendor's response which is attached. The price per transit bus is $499,975.65. The transit buses are to be delivered to the City in approximately twenty (20) months. The Beaumont Municipal Transit currently operates eighteen (18) buses to provide transit services for the City. The Federal Transportation Administration (FTA) requires buses to be operated until they reach 500,000 miles or twelve (12) years of age. The City is replacing two (2) Nova RTS buses that were acquired in July 2002. The City will also replace a NABI bus that was involved in an accident. The company that built this bus is out of business and there are no replacement parts available for repair. All buses that are removed from service will be placed on auction or disposed of according to grant guidelines. Councilmember Samuel moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH CREATIVE BUS SALES, OF IRVING, TEXAS, FOR THE PURCHASE OF THREE (3) TRANSIT BUSES FOR THE BEAUMONT MUNICIPAL TRANSIT SYSTEM IN THE AMOUNT OF $1,499,926.95. Councilmember Guidroz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM GETZ, COUNCILMEMBERS GUIDROZ, PATE, SAMUEL AND MOUTON Minutes — May 10, 2016 NAYS: NONE MOTION PASSED Resolution 16 - 084 2. Consider a resolution authorizing the City Manager to execute Change Order No. 1 to the contract with Marsh Waterproofing, Inc. related to the Exterior Facade, Masonry, Roof Repairs and Restoration at the Tyrrell Historical Library located at 695 Pearl Street On December 8, 2015, by Resolution No. 15-278, City Council awarded Marsh Waterproofing, Inc. of Vidor, Texas the contract for the Exterior Fagade, Masonry, Roof Repairs and Restoration on the Tyrrell Historical Library in the amount of $297,420.00. Change Order No. 1 is required to perform 100% (approx. 55,000 linear feet) tuck pointing of the masonry mortar joints in lieu of approximately 5000 linear feet included in the original contract. The adjustment of the scope of work is necessary to preserve the integrity of the facility and provide a better means of preventing water intrusion through the mortar joints. This adjustment in the scope of work results in an increase of $90,000.00 (30.26%) and a revised contract value of $387,420.00. Approval of Change Order No. 1 in the amount of $90,000.00 is recommended. Councllmember Pate moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE CHANGE ORDER NO. 1 FOR ADDITIONAL WORK, THEREBY INCREASING THE CONTRACT AMOUNT BY $90,000.00 FOR A TOTAL CONTRACT AMOUNT OF $387,420.000 FOR THE TYRRELL HISTORICAL LIBRARY EXTERIOR FACADE, MASONRY ROOF REPAIRS AND RESTORATION PROJECT. Councilmember Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM GETZ, COUNCILMEMBERS GUIDROZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 16 - 085 COMMENTS Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER MOUTON - NONE COUNCILMEMBER SAMUEL - STATED THAT HE WAS DISTURBED TO LEARN THAT BEAUMONT HAS BEEN RANKED AS THE THIRD MOST DANGEROUS CITY IN THE STATE OF TEXAS, ASKED THAT A WORKSESSION BE DONE IN REGARDS TO A COUNCIL POLICY Minutes — May 10, 2016 TO ADDRESS ISSUES OF ADMINISTRATION WITHIN THE CITY COUNCILMEMBER PATE - COMMENTED ON EVENTS THAT OCCURRED OVER THE WEEKEND, BOYS HAVEN, THE MEDITERRANEAN FESTIVAL, THE MAYPOLE FESTIVAL ETC., ASKED THAT ALL CITIZENS KEEP COUNCIL IN PRAYER, APPRECIATES THE OPPORTUNITY TO SERVE THE CITIZENS COUNCILMEMBER WRIGHT - ABSENT MAYOR PRO TEM GETZ - MADE COMMENTS IN REGARDS TO COUNCILMEMBER SAMUELS COMMENTS, ANNOUNCED THE DOWLEN/WEST NEIGHBORHOOD ASSOCIATION MEETING IS SCHEDULED FOR NEXT TUESDAY, MAY 17, 2016, AT MILLER LIBRARY INSTEAD OF ROGERS PARK DUE TO ELECTIONS COUNCILMEMBER GUIROS - MADE COMMENTS AS TO WHY HE ASK QUESTIONS, IT'S BECAUSE HIS CONSTITUENTS ASKED HIM QUESTIONS AND IT'S HIS JOB TO GET THE ANSWERS AND TO BRING THE INFORMATION BACK TO THEM, ANNOUNCED THE VIVA FESTIVAL WILL TAKE PLACE THIS WEEKEND, THANKED LENNY CABALLERO FOR ALL OF HIS HARD WORK IN REGARDS TO THE FESTIVAL CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - NONE Public Comments (Persons are limited to three minutes) Landry Rountree 1565 S.
