HomeMy WebLinkAboutORD 16-014ORDINANCE NO. 16-014 ENTITLED AN ORDINANCE CONSIDERING AN APPEAL OF THE HISTORIC LANDMARK COMMISSION'S DECISION TO DENY THE REQUEST FOR A CERTIFICATE OF APPROPRIATENESS TO ELIMINATE SIX (6) WINDOWS FROM A HOUSE LOCATED AT 2628 NORTH STREET IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, Sam P. Davis has requested a Certificate of Appropriateness to eliminate six (6) windows from the house located at 2628 North Street and replace with siding; and, WHEREAS, Mr. Davis claims the activity next door, to the west, is disturbing to tenants and the removal of the windows is necessary for privacy; and, WHEREA, the house is listed in the 1991 Survey and Preservation Analysis of Resources and Environment (SPARE) Beaumont Historic Survey; and, WHEREAS, on February 8, 2016, the Historic Landmark Commission voted 8:0 to deny the Certificate of Appropriateness for the elimination of six (6) windows from a house located at 2628 North Street and replace with siding; and, WHEREAS, the City Council is of the opinion that the Historic Landmark Commission's decision to deny the request for a Certificate of Appropriateness to eliminate six (6) windows from the house located at 2628 North Street and replace with siding is not in the best interest of the City of Beaumont and its citizens; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this ordinance are hereby, in all things, approved and adopted; and, THAT an appeal of the Historic Landmark Commission's decision to deny the request for a Certificate of Appropriateness to eliminate six s(6) windows from the house located at 2628 North Street and replace with siding is hereby granted to Sam P.
