Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on September 1, 2015, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on the Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor "Big Jim" Salles of West End Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Getz, Councilmembers Guidroz, Wright, Pate, Samuel and Mouton. Absent: Tyrone Cooper, City Attorney. Also present were Kyle Hayes, City Manager; Sharae Reed, Assistant City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Collin Cummings Day" - September 1, 2015 - Proclamation read by Mayor Ames; accepted by Collin Cummings and his parents Presentation Coach Ray Woodard, Lamar University Football Coach made a presentation to Council for opening of football season Public Comment: Persons may speak on the Consent Agenda. None CONSENT AGENDA Approval of minutes — August 25, 2015 Confirmation of committee appointments — Resolution 15 —182 Minutes — September 1. 2015 Eldon Steward would be appointed to the Community Development Advisory Committee. The term would commence September 1, 2015 and expire August 31, 2017. (Councilmember Claude G u id roz) Richard James would be appointed to the Convention and Tourism Advisory Board. The term would commence September 1, 2015 and expire August 31, 2017. (Councilmember Claude Guidroz) A) Authorize the City Manager to accept the Delaware Street Asphalt Resurface Project Phase - I, approve Change Order No. 1 and release the final payment — Resolution 15 - 183 B) Approve a three year contract for emergency catering services to Novrozsky's of Beaumont, to be used by all departments during an emergency event — Resolution 15 - 184 Councilmember Samuel moved to approve the Consent Agenda. Councilmember Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM GETZ, COUNCILMEMBERS GUIDROZ, WRIGHT, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED WORKSESSION Review and discuss a possible Ambulance Supplemental Payment Program Sherry Ulmer, Public Health Director discussed the Texas Ambulance Supplemental Payment Program that is sponsored by the Health and Human Services Commission of Texas. This program offers Governmental EMS providers in the State of Texas the opportunity to receive additional funds above standard Medicaid reimbursement rates to supplement transport cost for Medicaid patients and for uninsured patients. The City charges for the ambulance responses and for Medicaid patients, the City will only be reimbursed for a certain amount. The Federal Government has taken a pot of money through the 1115 Waiver which will give back to the states to help offset some of those losses with Medicaid reimbursement and with those patients that are uninsured. This funding is outside of the normal reimbursement billing revenue, it's only a percentage of the City's losses and not the whole loss. To be eligible for the program the City must enroll and become approved, due to the City being a Governmental EMS provider, the City would probably be approved. The City would have to develop a Cost Allocation Model, when developing this model the City would take a look at how much it would cost to send out an ambulance, look at the cost of administrative, human resource, finance, dispatch, supplies, repairs and maintenance of the ambulance unit. A Cost Allocation report would have to be prepared and submitted as well. The City has been approached by a company that would help with the creation of this model, there is a fee that would be incurred in amount of Minutes — September 1. 2015 $5,000.00 to help the City with this task. All revenue that is received will be reimbursement for the City's losses, there will be a 10% cost to the company for that amount. If the City saw a loss of $1.2 million, the City could see a $346,000 reimbursement from Medicaid. Review and discuss subdivision regulations within the City of Beaumont's Extraterritorial Jurisdiction (ETJ) Chris Boone, Planning and Zoning Director, discussed the subdivision regulations within the City of Beaumont's Extraterritorial Jurisdiction (ETJ). Mr. Boone reviewed the lot sizes, proper streets and lot layout, access to adequate water and sewer, public safety and schools, areas not subject to flooding and adequate improvements. The process for ETJ's were also discussed, such as the plat being submitted to the City and reviewed by all parties and the Planning Commission, any needed changes that would need to be made to the plan, improvements (streets, sidewalks, street lights, etc.) are made by the developer. In the City, improvements are accepted by the City Council, in the County, the developer guarantees improvements for one year and then accepted by County Commissioners Court. The plat is recorded, with any needed changes and lots can then be sold to the public. Current issues were discussed, subdivisions well beyond the City limits and area of probable annexation, maintenance issues for the County. The County proposed that they be allowed to regulate all subdivisions within a five -mile ETJ. The considerations of the proposal would be cost disadvantage to developing within and just outside the City and possible loss of growth, likely future annexations would bring in infrastructure at these reduced standards. The staff recommendation was to identify a "Planning Area" of two miles and continue to apply City standards to this area, while allowing County standards beyond the two-mile "Planning Area", the City would continue to review and approve all subdivisions with the ETF. ELDON STEWARD WHO HAS AGREED TO SERVE ON THE COMMUNITY DEVELOPMENT ADVISORY COMMITTEE, LOVE MEETING CITIZENS LIKE HIM WHO ARE VERY INTERESTED IN IMPROVING OUR CITY, IF ANYONE IS INTERESTED IN SERVING ON A COMMITTEE CHECK WITH YOUR COUNCILMEMBER THERE MAY BE A NEED FOR YOUR SERVICE, STATED THAT ON HIS WAY TO COUNCIL MEETING HE HEARD THAT ANOTHER POLICE OFFICER HAD BEEN SHOT, STATED THAT APPROXIMATELY 3% OF THE POPULATION IS A DANGER TO US AND THE OTHER 3% OF THE POPULATION HAS A SEVERE ILLNESS, THESE ARE PEOPLE THAT NEED PROPER CARE IN A FACILITY AND NOT A PRISON ASSISTANT CITY ATTORNEY REED - NONE CITY MANAGER HAYES - NONE MAYOR AMES - ASKED IF ANOTHER CONTRACTOR HAD BEEN HIRED BY TXDOT TO COMPLETE THE CONCORD ROAD PROJECT Public Comments (Persons are limited to three minutes) Rodney Denclau 3030 French Rd. #425 Beaumont TX Made comments in regards to sidewalks for the handicap, stated that sidewalks need to be more in the wheelchair prone areas, would like to take his family with him down the road but they can't due to no sidewalks, also commented on French Road with all the curves, requested that there be a caution light around the curve or one speed bump in the curve Vernon Durden 2110 Wesbury Rd. Beaumont TX Spoke to Council in regards to the policeman that was shot, commended the City of Beaumont Police Chief for all that he does for our police officers, also gave condolences to Judge Ransom "Deuce" Jones who lost his sister Lynette, asked that Council keep him and Minutes — September 1, 2015 his family in their prayers, also commented on the ETJ, stated that Council needs to take a look at Gentrification, that would be a good indication on whether or not the City would need to increase the boundaries or increase services, also stated that Council needs to look at creating a Jr. Council who's voices that Council isn't listening to, these young people will the voice of the future With there being no Executive Session, Council adjourned at 2:50 p.m. udio available upon req AlRe—y A Vel, a y o r Tina Broussard, City Clerk in the City Clerk's Office.
