Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on June 16, 2015, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation - Pledge of Allegiance Presentations and Recognition Public Comment: Persons may speak on scheduled Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Roll Call agenda items 1 and 2/Consent Associate Pastor Terrell Wilson, of Cathedral of Faith Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Councilmembers Guidroz, Getz, Wright, Pate, Samuel and Sam. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions None Public Comment: Persons may speak on scheduled agenda items 1 and 3/Consent Agenda. None CONSENT AGENDA Approval of minutes — June 9, 2015 Confirmation of committee appointments — Resolution 15 - 110 Glen Johnson would be reappointed to the Police Department Community Advisory Committee. The current term would expire January 10, 2017. (Councilmember Claude F. Guidroz) Gene Bush would be reappointed to the Police Department Community Advisory Committee. The current term would expire January 17, 2017. (Councilmember Claude F. Guidroz) Minutes — June 16, 2015 A) Approve an annual contract for painting and related services to BRC Painting, Inc. of Beaumont for use by the Facilities Maintenance Division — Resolution 15 -111 B) Authorize the execution of a License to Encroach Agreement with the Texas Commission on Environmental Quality related to a storage tank site located at 8235 Broussard Road — Resolution 15 - 112 C) Authorize the City Manager or designee to sign any and all documents necessary to execute four Memorandums of Understanding with the South East Texas Regional Planning Commission — Resolution 15 - 113 Councilmember Getz moved _to approve the Consent Agenda. Councilmember Wright seconded the motion. AYES: MAYOR AMES, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE, SAMUEL AND SAM NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider amending Section 14.04.005 (g) Bicycles of the Code of Ordinances to allow the riding of a bicycle on sidewalks. Section 14.04.005 (g) Bicycles currently states, "No person shall ride a bicycle on other than a vehicular road or path designed for that purpose. A bicyclist shall be permitted to wheel or push a bicycle by hand over any grass area or wooded trail or any pathway reserved for pedestrian use. Bicyclists shall at all times operate their machines with a reasonable regard for the safety of others, signal all turns, pass to the right of any vehicle they are overtaking and pass to the right of any vehicle they may be meeting." A work session was held on June 9, 2015 to discuss amending the Code of Ordinances to allow the riding of a bicycle on sidewalks. The Administration recommends deleting all of the current language in (g) Bicycles and adding the following new wording: "Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give an audible signal before overtaking and passing any pedestrian." Approval of the amended ordinance. Councilmember Getz moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 14, PUBLIC WAYS AND PLACES, ARTICLE 14.04, PARKS AND RECREATION, SECTION 14.04.005(G), OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, TO ALLOW THE RIDING OF BICYCLES ON SIDEWALKS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Guidroz seconded the motion. Minutes — June 16, 2015 AYES: MAYOR AMES, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE, SAMUEL AND SAM NAYS: NONE MOTION PASSED Ordinance 15 - 017 2. Consider a resolution awarding an annual contract for maintenance and repair services to Bruce's General Construction, Inc., of Beaumont, as needed by the Facilities Maintenance Division. Bids were requested for an annual contract to provide on demand repair, maintenance, and light construction services as needed by the Facilities Maintenance Division. The contract does not include demolition services, or projects which are reasonably anticipated to approach or exceed $75,000. Six (6) vendors were notified and three (3) responses were received. Specifications requested hourly labor rates for carpenters, helpers, concrete finishers, equipment operators and general laborers together with percentage markup for materials and equipment rentals. Bids were evaluated on total annual cost based upon estimated labor hours for each skill category and condition. Low bid was received from Bruce's General Construction, Inc., of Beaumont who has held this contract for several years. Total bid represents approximately a one-half percent reduction over the previous contract's estimated amount at the time of award. Various funds depending on location of work. In FY 2014, the City spent $114,894 under the existing contract. Approval of resolution. Councilmember Sam moved to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY BRUCE'S GENERAL CONSTRUCTION, INC. OF BEAUMONT, TEXAS FOR AN ANNUAL CONTRACT FOR MAINTENANCE AND REPAIR SERVICES AS NEEDED BY THE BUILDING SERVICES DIVISION IN THE ESTIMATED AMOUNT OF $210,050 BE ACCEPTED BY THE CITY OF BEAUMONT. Councilmember Pate seconded the motion. AYES: MAYOR AMES, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE, SAMUEL AND SAM NAYS: NONE MOTION PASSED Resolution 15 — 114 Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Minutes —June 16, 2015 COUNCILMEMBER COMMENTS COUNCILMEMBER GUIDROZ - STATED THAT HE IS CONTINUING TO GROW INTO HIS POSITION, GETTING TO KNOW THE COUNCILMEMBERS, THE CITY STRUCTURE AND THE WAY IT FUNCTIONS, STATED THAT THEY ARE BLESSED IN BEAUMONT BECAUSE EVERYONE COMES TOGETHER TO REASON THINGS OUT AND DEAL WITH PRINCIPLES RATHER THAN PERSONALITIES TO GET THINGS DONE FOR THE BETTERMENT OF THE CITY, PRIVILEGED TO BE A PART OF THAT COUNCILMEMBER GETZ - PRIVILEGED TO PARTICIPATE IN THE CALDER 5K ON FRIDAY, THE TURNOUT WAS GREAT, IT WAS A WONDERFUL EVENT THAT THE CITY WAS ABLE TO SPONSOR ALONG WITH THE SEA RIM STRIDERS, STATED THAT THEY DID RUN LOW ON T-SHIRTS, THOSE THAT DIDN'T GET T-SHIRTS CAN CALL HIS OFFICE OR CALL CITY HALL'S EXECUTIVE OFFICE SO THAT THEY MAY GET ONE COUNCILMEMBER WRIGHT - CONDOLENCES TO MAYOR AMES AND HER HUSBAND RODNEY ON THE LOSS OF HIS BROTHER, ANNOUNCED THE JUNETEENTH CELEBRATION ON SATURDAY, JUNE 20, 2015, AT TERRELL PARK COUNCILMEMBER PATE - CONDOLENCES TO MAYOR AMES AND HER HUSBAND RODNEY ON THE LOSS OF HIS BROTHER, ALSO ENCOURAGED EVERYONE TO HONOR THEIR FATHERS THIS FATHER'S DAY, ALSO COMMENTED ON THE DIFFERENT FUNCTIONS THAT ARE GOING ON OVER THE SUMMER FOR THE KIDS TO DO THROUGHOUT THE CITY COUNCILMEMBER SAMUEL - TRULY APPRECIATIVE TO LIVE IN A COUNTRY THAT IS BUILT ON THE FOUNDATIONS OF OUR FOREFATHERS BASED ON OUR BELIEFS OF GOD, IN THIS COUNTRY WE ALLOW INDIVIDUALS THEIR OWN BELIEFS, THEY HAVE A RIGHT TO THEIR BELIEFS AND THE PRINCIPALS THAT ARE SET FORTH, VERY THANKFUL FOR ALL THINGS THAT WORK TOGETHER FOR THE GOOD OF THOSE THAT LOVE THE LORD ACCORDING TO HIS PURPOSE AND FOR THAT HE IS THANKFUL, GAVE CONDOLENCES TO THE MAYOR AND HER HUSBAND ON THE LOSS OF HIS BROTHER COUNCILMEMBER SAM - CONDOLENCES TO THE MAYOR AND HER HUSBAND RODNEY ON THE LOSS OF HIS BROTHER, ALSO TO THE FAMILY OF JODY GLENN, ANNOUNCED THE NAACP FREEDOM FUND BANQUET ON FRIDAY, JUNE 19, 2015, AT 7:00 P.M., ALL THAT CAN ATTEND PLEASE DO SO CITY ATTORNEY COOPER - NONE Minutes — June 1.6, 2015 CITY MANAGER HAYES - NONE MAYOR AMES - THANKED COUNCIL FOR THEIR COMMENTS, ALSO REMINDED EVERYONE THAT TUESDAY, JUNE 16, 2015, IS THE LAST DAY TO VOTE IN THE WARD IV RUN-OFF, SATURDAY, JUNE 20, 2015, IS RUN-OFF ELECTION DAY, ALSO THERE WILL BE A GRAND OPENING TODAY FOR FIRE STATION NO. 2 AT 4:00 P.m., 4990 HELBIG RD. Apt 225 Beaumont TX Complimented the City as to the way that it is run, it's very well run and applauded Council on a wonderful job they are doing, commented on the cross -walk lights that are timed too short, the lights are located at Lucas and Concord as well as Lucas and Pine Burr Talsha Davis 3710 Magnolia Apt 1002 Beaumont TX Spoke to Council in regards to citizens in Beaumont that are trying to bring peace to the streets, stated that the citizens understand that the Police Department is doing all that they can, knows that there is no peace without justice, as citizens of Beaumont they have come up with a group called Peace on Every Street BMT, they have done several rallies and have held praise and worship at a church downtown, what they would like to see from the City Council as a whole is some kind of backing, it would be greatly appreciated Open session of meeting recessed at 1:53 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: City of Beaumont vs. Joseph D.
