Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on May 19, 2015, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Father Peter Funk, A Monk of the Holly Cross Monastery and Director of the Holy Family Retreat Center gave the invocation. Pastor Harland Merriam led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Councilmembers Getz, Wright, Pate, Samuel and Sam. Absent: Mayor Pro Tem Coleman. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. ELECTION OF MAYOR AND COUNCILMEMBERS Consider approval of an ordinance canvassing the results of the May 9, 2015 City General Election The Texas Election Code Section 67.003 requires that the election returns be canvassed, and thereby made official not later than the 11th day after election day. No candidate for Councilmember Ward IV received more than 50% of the votes cast making it necessary to call a runoff election for such position. Said runoff election is to be held between the two (2) candidates who received the greatest number of votes cast in, the May 9, 2015, general election. A runoff election is to be scheduled for June 20, 2015. Administration recommends approval of an Ordinance Canvassing the results of the City of Beaumont General Election which was held on the 9th day of May, 2015 to name a Mayor, four (4) Councilmembers (Ward I, II, III, IV), two (2) Councilmembers-At-Large; and ordering a Run -Off Election to be held in the City of Beaumont, Texas, on the 20 day of June, to determine who shall be Councilmember of Ward IV of the City of Beaumont. Funds are available in the City Clerk's Operating Budget Minutes — May 19, 2015 Councilmember Getz moved to APPROVE AN ORDINANCE CANVASSING THE RETURNS OF THE GENERAL ELECTION OF THE CITY OF BEAUMONT HELD ON THE 9TH DAY OF MAY, 2015, FOR THE PURPOSE OF ELECTING A MAYOR, TWO COUNCILMEMBERS-AT-LARGE, COUNCILMEMBERS WARDS I, II, III AND IV; AND ORDERING A RUN-OFF ELECTION IN THE CITY OF BEAUMONT, TEXAS, ON THE 20TH DAY OF JUNE, 2015, TO DETERMINE WHO SHALL BE THE COUNCILMEMBER IN WARD IV. PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. Councilmember Sam seconded the motion. Harland Marriam Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. None Minutes — May 19, 2015 CONSENT AGENDA Approval of minutes - May 12, 2015 Confirmation of committee appointments - None A) Approve a resolution approving the City of Beaumont Investment Policy— Resolution 15 - 092 B) Approve a contract with Daddio's Burger/Novrozsky's for the 2015 Summer Food Service Program — Resolution 15 - 093 Councilmember Samuel moved to approve the Consent Agenda. Councilmember Wright seconded the motion. AYES: MAYOR AMES, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE, SAMUEL AND SAM NAYS: NONE MOTION PASSED COUNCILMEMBER COMMENTS COUNCILMEMBER GUIDROZ - STATED THAT IT WAS A PRIVILEGE TO BE A PART OF COUNCIL, HAS A LOT TO LEARN AND APPRECIATES ALL OF COUNCIL GUIDING HIM THROUGH THE PROCESS COUNCILMEMBER GETZ - ANNOUNCE THE DOWLEN/WEST NEIGHBORHOOD ASSOCIATION MEETING ON TUESDAY, MAY 19, 2015, PRIVILEGED TO HAVE CHRIS BOONE, COMMUNITY DEVELOPMENT DIRECTOR SPEAK AT THE MEETING, THE MEETING WILL BE AT 7:00 P.M., AT ROGERS PARK COMMUNITY CENTER COUNCILMEMBER WRIGHT - THANKED ALL CITIZENS OF BEAUMONT,- THAT HAD CONFIDENCE IN HER TO RETURN HER TO COUNCIL, APPRECIATES IT VERY MUCH AND IS VERY HUMBLE, ENJOYS WORKING WITH AND LOVES EVERYONE ON COUNCIL, COMMENTED ON THE IEA PROGRAM THAT IS BENEFICIAL TO OUR YOUTH COUNCILMEMBER PATE - WELCOMED CLAUDE GUIDROZ AS WARD I COUNCILMEMBER, STATED THAT HE KNOWS THAT COUNCILMEMBER GUIDORZ IS GOING TO WORK VERY HARD, ALL OF COUNCIL APPRECIATES THE OPPORTUNITY TO REPRESENT ALL OF THE CITIZENS, ALSO COMMENTED ON THE CHILDREN'S MUSEUM GALA FUND RAISER Minutes —May 19, 2015 COUNCILMEMBER SAM - THANK YOU COUNCILMEMBER SAMUEL - COMMENTED ON THE IEA PROGRAM THAT HE ATTENDED ON LAST WEEK, STATED THAT IT IS A GREAT PROGRAM AND WHAT A GREAT JOB THEY DO, THANKED COUNCIL FOR ALL THAT THEY ARE INVOLVED IN, ALSO GAVE CONDOLENCES TO THE FAMILY OF RONALD BISHOP WHO WORKED ON THE POLICE ADVISORY BOARD AS WELL AS WITH THE NAACP CITY ATTORNEY COOPER - CONGRATULATED ALL OF COUNCIL, ESPECIALLY WELCOMED COUNCILMEMBER CLAUDE GUIDROZ, STATED THAT HIS DOOR IS ALWAYS OPEN CITY MANAGER HAYES - CONGRATULATED ALL OF COUNCIL ON THEIR ELECTION MAYOR AMES - ASKED THAT EVERYONE REMEMBER MEMORIAL DAY AND REMEMBER A VETERAN WHEN YOU WAKE UP ON MONDAY MORNING Public Comments (Persons are limited to three minutes) Landry Rountree 1565 S. Major Dr. Beaumont TX Congratulated Mr. Guidroz on his election to Ward I, as well as Rev. Harland Merriam on his retirement, stated that if anyone on Council would like to talk to him they could, stated that on December 3, 2013, his company had its permit revoked fortwo years after 33 years of serving the City of Beaumont, commented on other towing companies that were not permitted Jamie Brown 4050 E.
