M: • �e���i1►1� The defibrillators are used by Emergency Medical Services (EMS) and the Fire Department as a complete acute cardiac care response system designed for basic and advanced life support. In order for first responders to provide a quicker response to the patients, EMS and the Fire Department utilize the same type of equipment that is manufactured, warranted, and maintained, by Physio -Control. Pricing was obtained from Physio -Control, Inc. as a sole source provider. Three units in EMS and two in the Fire Department will be replaced due to age and wear. Five units will be traded -in at a credit of $4,000 per unit toward the cost of the new units. FUNDING SOURCE Capital Reserve Fund. RECOMMENDATION Approval of resolution. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Council hereby approves the purchase of five (5) LP15V4 Monitor/Defibrillators for use by Emergency Medical Services (EMS) and the Fire Department from Physio -Control, Inc., of Redmond, Washington, a sole source provider, in the amount of $137,871.50. 2015. BACKGROUND The lawsuit styled Justin Jackson vs. City of Beaumont; Cause No. B-195,252 was presented and discussed in Executive Session held on April 14, 2015. The City Attorney is requesting authority to settle this suit in the amount of $43,000. FUNDING SOURCE General Liability Fund. RECOMMENDATION Approval of resolution. RESOLUTION NO. WHEREAS, the lawsuit styled Justin Jackson vs. City of Beaumont; Cause No. B- 195,252 was discussed in Executive Session properly called and held Tuesday, April 14, 2015; and, WHEREAS, the City Attorney is requesting authority to settle this lawsuit; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the City Attorney be, and he is hereby, authorized to settle the lawsuit styled Justin Jackson vs. City of Beaumont; Cause No. B-195,252 for the sum of Forty -Three Thousand and XX/100 Dollars ($43,000.00); and, BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby authorized to execute all documents related to settlement of the lawsuit. 2015. Singletary, Chief of Police MEETING DATE: April 21, 2015 REQUESTED ACTION: Consider a resolution authorizing the City Manager to execute a Memorandum of Understanding between Immigration and Customs Enforcement and the Beaumont Police Department. BACKGROUND The Memorandum of Understanding between Immigration and Customs Enforcement ("ICE") and the Beaumont Police Department is to share. radio frequencies that would benefit both the safety and well being of each party and their personnel. ICE will purchase six to ten new portable 80OMHZ radios to use locally during joint operations so that both agencies are able communicate with one another. FUNDING SOURCE Not Applicable. RECOMMENDATION Approval of resolution. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager, or his designee, be and they are hereby authorized to execute a Memorandum of Understanding between the City of, Beaumont and Immigration and Customs Enforcement (ICE) for the Beaumont Police Department to share radio frequencies that would benefit both the safety and well being of each party and their personnel. The Memorandum of Understanding is substantially in the form attached hereto as Exhibit "A" and made a part hereof for all purposes. 2015. PASSED BY THE CITY COUNCIL of the City of Beaumont this the 21 st day of April, - Mayor Becky Ames - MEMORANDUM OF UNDERSTANDING SHARED FREQUENCIES THIS MEMORANDUM OF UNDERSTANDING is entered into this day of '2015, by and between Beaumont Police Department ("BPD'), and Immigration and .Customs Enforcement ("ICE"), a principal department of the Department of Homeland Security of the United States of America, (each also sometimes referred to, individually as "Party" and, collectively, as "Parties)." RECITALS WHEREAS, BPD owns and operates an 800 MHz trunked radio system for public safety communications purposes ("Radio System"); and WHEREAS, ICE may operate and may provide services in the BPD jurisdiction that require communications with and coordination among public safety response personnel of ICE and BPD; and WHEREAS, mutual aid communications between the Parties using the Radio System will benefit the safety and well -being of each Party's personnel and constituents; and WHEREAS, this Memorandum of Understanding is entered into to provide for the use of the Radio System, on a limited basis, in conformance with Federal Communications Commission ("FCC") regulations (particularly 47 C.F.R. § 90.179) regarding shared use of radio stations and the technical protocols hereinafter developed. NOW, THEREFORE, in consideration of the premises and mutual covenants contained herein, BPD and ICE agree to the following terms and conditions. TERMS AND CONDITIONS 1. NON-PROFIT PUBLIC SAFETY USE. BPD agrees to share its Radio System with ICE on -a non-profit basis for public safety purposes. No fee will be charged for the use of the Radio System. 2. METHOD OF OPERATION. Before ICE begins to transmit on the Radio System, BPD and ICE shall establish written protocols to govern the operation of the Radio System, including the issuance of identification numbers and the assignrnent of talk groups., Protocols will include common standards of operation to simplify communication when using shared talk groups, including methods of self - identification, and the use of "plain language" rather than "lingo" or codes. Each Party will. appoint a radio coordinator and furnish the name and 24-hour contact information, in writing, to the other Party. Page 1 of 3 EXHIBIT "A" COMPONENTS TO BE SHARED. BPD will share its licensed frequencies, talk groups (police template, Fed), and those components of its Radio System required for inter jurisdictional communication. Each Party will bear its own costs and be responsible for providing the equipment necessary to use the Radio System. The Parties may, however, by a separate writing, agree to loan or provide specific items of equipment. 4. LICENSEE'S CONTROL. As required by FCC regulations, the shared use of Radio System is under the control of BPD, as the licensee. 5. DISPATCH SERVICES. - BPD is not providing dispatch services pursuant to this Memorandum of Understanding. 6. REGULATIONS. Each Party is responsible for complying with all applicable laws and regulations, including FCC regulations as well as the terms of this Memorandum of Understanding. - 7. MAINTENANCE, REPAIR, PROGRAMMING FACILITIES. Only certified Motorola repair facilities or authorized employees of either Party are permitted to program or repair any radio that is transmitting on the Radio System. 8.. MISUSE, INTERFERENCE, IMPROPER USAGE. Any radio that is found to be: in violation of FCC regulations; operating in violation of the terms and conditions of this Memorandum of Understanding or of any protocols established pursuant Hereto; causing interference; or found to have duplicate ID numbers; shall be inhibited by either one or both of the Parties. Upon inhibiting any radio, the Party taking the action must notify the radio coordinator of other Party as soon as possible, but in any event within twenty-four (24) hours. 9. LOST, STOLEN, DAMAGED UNITS. If any radio that is programmed to operate on the Radio System is lost, stolen, or destroyed, the ID number will be removed from the Radio System. The Party responsible for the radio unit that is lost, stolen, or destroyed shall notify the other Party within twenty-four (24) hours, and, if lost or stolen, file a Police report on same. ID numbers removed from the Radio System in this maturer will stay inactive for a period of at least one (1) year unless the radio unit is accounted for and destroyed or the radio unit is found and returned to service. 10. DURATION OF AGREEMENT, RIGHT TO TERMINATE. This Memorandum of Understanding shall be effective for ten (10) years and may be renewed for an additional like term thereafter, providing both Parties agree in writing to such renewal. Either Party may terminate the Memorandum of Understanding at any time for any reason with thirty (3 0) days' written notice. Page 2 of 3 11. NO DAMAGES. Nothing in this Memorandum of Understanding shall give any Party a cause of action or claim for damages of any type or nature against the other Party. Furthermore, nothing in this agreement shall: (a) give any third party any right or claim nor permit any third party any right or damages; (b) waive any Party's right to assert any form of defense against any claim, including but not limited to government immunity; and/or (c) create or be deemed to create any responsibility or liability for not acknowledging out of jurisdiction units. 12. GRATUITOUS SERVICES AGREEMENT BPD agrees to provide any and all services under this agreement as gratuitous services, with the full understanding that the United States cannot and'will not compensate, provide any financial benefit to, or reimburse BPD, or its agents, in any manner for providing such services. BPD agrees that it has no expectation of receiving any compensation, financial benefit, or reimbursement for such services and that it is unlawful for ICE to accept such services if BPD had any expectation of compensation, financial benefit or reimbursement. BACKGROUND The City of Beaumont Public Health Department would like to enter into an agreement with Jefferson County so that in the event of a Public Health Emergency in the State of Texas; local and regional health and medical infrastructure and associated resources will be quickly committed to providing the necessary supporting strategies of effective management and distribution of the Strategic National Stockpile (SNS). The term of this MOU is five years from the date of execution. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of resolution. RESOLUTION NO. PERCOMOnline, Inc. is requesting an agreement with the City of Beaumont's Emergency Medical Services Division to provide clinical experience to its students majoring in their Emergency Medical Services Program. The responsibilities of PERCOMOnline, Inc. will include but not be limited to the following: - provision of classroom theory; - preparation of students assignments; - continuous communications with Beaumont EMS regarding student performance; and - supervision of students. The responsibilities of Beaumont EMS will include but not be limited to the following: - acceptance and reasonable orientation of students; - coordination of the college's assignment schedule; - assistance in evaluation of each student; - designation of an individual to serve as liaison with the college; - provision of reasonable opportunities for students to observe and assist in various aspects of patient care; and - ultimate control of responsibility of patient care. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of resolution. EMS Agreement for Ambulance Internship This contract and agreement made and entered into this [6th] day of [March 2015] by and between [PERCOMOnline, Inc.] and the City of Beaumont (EMS Division) WHEREAS, it is agreed by the aforementioned parties to be of mutual interest and advantage that the students enrolled in [PERCOMOnline, Inc.] be given the benefit of the educational facilities for clinical practice of EMT's and Paramedics in the care of patients. WHEREAS, [PERCOMOnline, Inc.] on this date authorizes the execution of a contract to cover such services. Therefore [PERCOMOnline, Inc.] effects the following clinical affiliation with the City of Beaumont (EMS Division) for a mutually agreed upon number of students enrolled in [PERCOMOnline, Inc.]. This contract is set up for a 36 month renewal. Either party may terminate this agreement by giving a 90 day notice in writing to the other party by certified mail. Specific Responsibilities of [PERCOMOnline, Inc.] 1. It shall be the responsibility of [PERCOMOnline, Inc.] after consultation with the City of Beaumont (EMS Division) to plan, coordinate and implement the educational program for the internship period. 2. [PERCOMOnline, Inc.] will provide qualified instructors to teach all prescribed classes in the EMS program including clinical laboratory practice. In addition, [PERCOMOnline,, Inc.] will provide direction to qualified City of Beaumont EMS Division personnel who may be assisting with the selected portions of the teaching and/or supervision. 3. [PERCOMOnline, Inc.] will provide administrative functions including admission of student, scheduling of classes and clinical experience, maintaining of attendance records, and maintaining achievement records similar to those maintained for all students at [PERCOMOnline, Inc.] and those by the Texas Department of State Health Services. 4. [PERCOMOnline, Inc.] students and faculty are not to represent themselves as employees of the City of Beaumont at any time. [PERCOMOnline, Inc.] students are to wear [PERCOMOnline, Inc.] uniform with ID badge recognizing the individual as a [PERCOMOnline, Inc.] student. 5. Faculty and students. of [PERCOMOnline, Inc.] will abide by the policies'and procedures of the City of Beaumont EMS Division, while using its facilities and equipment. 6. [PERCOMOnline, Inc.], after consultation with the City of Beaumont EMS Division personnel, will select suitable clinical experience situations to enable students to meet the objectives of the prescribed curriculum. 7. [PERCOMOnline, Inc.] will provide orientation to [PERCOMOnline, Inc.] students for the City of Beaumont EMS Division. 8. [PERCOMOnline, Inc.] will reimburse the City of Beaumont for any loss or damage of any equipment caused by students or instructor's use of said equipment. 9. The Clinical Coordinator of [PERCOMOnline, Inc.] and/or his designee will provide the City of Beaumont EMS Division with the learning objectives for [PERCOMOnline, Inc.] students participating in the clinical training through designated departments. 10. The Clinical Coordinator of [PERCOMOnline, Inc.] or his designee will provide the City of Beaumont EMS Division with a schedule containing days of the week and times of the day to be reserved for [PERCOMOnline, Inc.] students in designated departments. This schedule will be updated monthly or as needed upon agreement of both parties. 11. The Clinical Coordinator of [PERCOMOnline, Inc.] or his designee will provide the City of Beaumont EMS Division with a notification email and the EMS Director's telephone number. 12. [PERCOMOnline, Inc.] faculty and students will be covered by a $1,000,000.00 liability insurance policy. 13. [PERCOMOnline, Inc.] will indemnify and hold harmless the City of Beaumont from acts of negligence occasioned by [PERCOMOnline, Inc.] students and faculty. 14. [PERCOMOnline, Inc.] faculty will coordinate committee meetings between [PERCOMOnline, Inc.] instructors, appropriate City of Beaumont EMS Division personnel and physicians for the purpose of reviewing education goals and progress made in meeting these goals. 15. The Clinical Coordinator of [PERCOMOnline, Inc.] or his designee will coordinate meetings with the EMS Director or his/her designee. 16. The student will be required to provide their own personal medical insurance. The student will be responsible for any injuries that are sustained to his or her persons while on a clinical rotation with the City of Beaumont. Specific Responsibilities of the City of Beaumont EMS Division 1. The City of Beaumont EMS Division shall provide facilities for [PERCOMOnline, Inc.] students to practice in designated areas. 2. Permit the use of cafeteria facilities by students and instructors. 3. Provide equipment and supplies needed for the care of the patient. 4. Maintain high quality patient care and an environment in which progress planning is made. S. Provide [PERCOMOnline, Inc.] copies of policies and procedures that pertain to students. 6. Retain responsibility of patient care. Any student found negligent may be refused permission to practice at the City of Beaumont. 7. Permit [PERCOMOnline, Inc.] to inform the Texas Department of State Health Services or any other governing agencies of the affiliation between both parties. 8. To provide clinical experience for [PERCOMOnline, Inc.] students. 5. Provide PERCOMOnline, Inc. copies of policies and procedures that pertain to students. 6. Retain responsibility of patient care. BACKGROUND The 23rd Street Lift Station was originally built in the late 1950's and rehabilitated in the early 1990's. In 2009, the station was converted from a dry pit/wet well configuration to a submersible wet well station. As part of the 2009 project, a junction box was installed upstream of the wet well. The ground above the line upstream of the junction box recently started to settle indicating a possible misalignment or damage to the pipe. The proposed project shall provide for the repair of the 48 -inch diameter line including, but not limited to the following: install bypass pumping; clean and televise the entire 48 -inch line from the north junction box to the wet well; patch the 48 -inch line to stop any infiltration; apply a geopolymer liner to the pipe; televise the completed repair to ensure no water is infiltrating into the pipe through the repaired area. The contract amount includes a $10,000 allowance for a temporary repair in the north junction box. This temporary repair will reduce the amount of ground water entering the junction box until an assessment of the condition of the upstream line is made and a permanent repair can be made. Pricing was obtained through the Houston Galveston Area Council (HGAC), a cooperative purchasing association providing cities and political subdivisions with the means to purchase specialized equipment at volume pricing. BACKGROUND On March 31, 2015, CenterPoint Energy ("CenterPoint") filed with the City of Beaumont an annual Gas Reliability Infrastructure Program (GRIP) interim rate adjustment notice to increase gas rates in the Beaumont/East Texas Division Service Area. The City of Beaumont maintains exclusive original jurisdiction over the rates, operations and services of CenterPoint as a gas utility operating in the City of Beaumont. The requested increase would ordinarily go into effect sixty (60) days after giving notice of the intent to increase rates. This ordinance is a request to suspend the effective date of CenterPoint's proposed rate increase for a period of forty-five (45) days until July 15, 2015 in order to review the company's filings for compliance with the Gas Utility Regulatory Act and the company's last base rate case. The review of the company's GRIP filing is limited to a ministerial review of the filings for compliance with the Act. BACKGROUND Talon Insurance Agency, of Port Arthur, Texas is the City's broker of record for securing the City's property insurance. The proposed premium is based on a total building value of $225,854,982. The cost of the policy for this year is $1,213,593.13, a 3.8% decrease from last year's premium of $1,490,734.80. The net rate per $100 valuation, based on the insured value decreased from $0.565 to $0.5373329 from last year. Companies providing insurance are layered with exposure limited to the amount of damage. All risk coverage, including Flood and Earth Movement, is provided by AmRisc, LP, First Specialty Insurance, Westchester, Landmark American, Evanston, and Liberty Surplus. BACKGROUND The City of Beaumont receives an annual allocation of HOME Investments Partnerships funds from the U. S. Department of Housing and Urban Development (HUD) and has previously awarded contracts for acquisition or construction of housing to be sold to eligible low -to -moderate income families under lease -purchase agreements. Federal regulations require that a minimum of fifteen percent (15%) of the City's total HOME fund allocation be contracted to Community Housing Development Organizations (CHDO's) for eligible CHDO activities. Legacy Community Development Corporation (Legacy CDC), a certified CHDO, is seeking to stabilize neighborhoods, particularly in the north end, by providing home ownership opportunities for low -to -moderate income families. $400,000 in funding will enable Legacy to acquire approximately five (5) single-family homes that will be offered for sale or lease -purchase to eligible low -to -moderate income families. In addition, $25,000 would be used to acquire buildable lots that would be also be used for affordable housing. Legacy is also requesting $25,000 for the CHDO's daily operating expenses. Operating funds will also be used for homebuyer counseling and neighborhood outreach. Planning & Community Development's Housing Division staff will be responsible for monitoring Legacy for HOME Program compliance FUNDING SOURCE Funding is available from the 2013 and 2014 HOME Programs RECOMMENDATION Approval of resolution. Development Corporation Mr. Johnny Beatty City of Beaumont Housing Program 801 Main Street Beaumont, Texas 77701 I am writing to request CHDO Reserve funding in. the amount of $425,000 and $25,000 in Sub -recipient funding. The Reserve funds will be used to purchase and rehabilitate up to 5 homes for sale and/or lease to qualified buyers, acquire land for the construction of new homes and operating expenses. Legacy's homeownership program will acquire units at affordable prices, rehabilitate them and then make them available to buyers in the price range of $85,000 and below. Over 90% of our buyers pre -qualify for mortgages at $75,000 or below. This benefits the low mod communities, potential buyers_ and the city's down payment assistance program through the timely commitment and expenditure of HUD funds. The Sub -recipient funds will be utilized for the administration of a homebuyer assistance/ credit counseling program. Legacy is partnering with Alliance and the Beaumont Housing Authority to provide counseling and credit repair services to potential buyers of the 82 homes in Regent ll.
