Duplant, Chief Financial Officer MEETING DATE: October 2, 2007 AGENDA MEMO DATE: September 26, 2007 REQUESTED ACTION: Council consider a contract for the purchase of wastewater treatment polymer. RECOMMENDATION Administration recommends award of a one (1) year contract to Ashland, Inc. of Greensboro, North Carolina for purchasing polymer at a unit cost of $1.04 per pound, with an estimated total contract expenditure of $28,600. BACKGROUND Bids were requested for a one (1) year contract for polyacrylamide cationic emulsion liquid polymer for use by the Water Utilities Department. The chemical is used in the dewatering of municipal sewer waste sludge produced by the City's filter plant at Water Reclamation. Six (6) vendors were notified with two (2) responding with bids as follow: Vendor Product Price Estimated Annual Cost Polydyne, Inc. Ashland Praestol K28OBC-G $1.04 /lb. $28,600 Greensboro, NC After the bid opening, belt press trials are held in the City's Water Reclamation Plant to test each bidder's product for specification compliance. Given a feed flow of aerobically digested biological Contract for wastewater treatment polymer September 26, 2007 Page 2 sludge, the proposed polymers being tested must condition the sludge for dewatering so that it meets certain conditions during a two (2) hour trial. Each proposed product is tested at least twice. The product proposed by Polydyne failed to meet performance standards and was disqualified. The product bid by Ashland has been utilized previously by Water Reclamation and meets all performance requirements. The prior contract price was $1.12 per pound. The prior year usage was approximately 27,500 pounds. BUDGETARY IMPACT Funds are available for this expenditure in the Water Utilities Fund. RESOLUTION NO. WHEREAS, bids were received for a one (1) year contract for the purchase of wastewater treatment polymer for use by the Water Utilities Department; and, WHEREAS, Ashland, Inc., Greensboro, North Carolina, submitted a bid at a unit cost of $1.04 per pound for an estimated cost of $28,600; and, WHEREAS, City Council is of the opinion that the bid submitted by Ashland, Inc., Greensboro, North Carolina, should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the bid submitted by Ashland, Inc., Greensboro, North Carolina, for a one (1) year contract for the purchase of wastewater treatment polymer for use by the Water Utilities Department at a unit cost of $1.04 per pound for an estimated cost of $28,600 be accepted by the City of Beaumont. Tohme, Water Utilities Director 1447' MEETING DATE: October 2, 2007 AGENDA MEMO DATE: September 26, 2007 REQUESTED ACTION: Council approval of a resolution authorizing the City Manager to increase the Proposed 2 MG Elevated Water Tank at Dishman Road Project amount for "extra work." RECOMMENDATION Administration recommends approval of increasing the Proposed 2 MG Elevated Water Tank at Dishman Road Project amount by $22,400.00. The proposed changes to the original contract will install additional electrical equipment associated with the construction of the second and third floors and make water and sanitary sewer provisions for the construction of future bathroom facilities on the second and third floors. In addition, the gate valve will be replaced by a butterfly valve. The proposed change order will increase the total contract amount by 0.81 %. The total of all of the extra work to date, including this proposed recommendation, will represent 10.58% ofthe original contract amount. BACKGROUND The City of Beaumont was cited by TCEQ for not having sufficient elevated storage capacity for the number of customers served. The City is required to eliminate the deficiency before August 2008. The proposed improvements will provide the water system with additional elevated storage capacity required to meet State and Federal regulations. In addition, the new elevated tank will increase the water pressure in the area and provide adequate water supply for future development. This change order will provide electrical and water and sanitary sewer connections to accommodate the housing facility for Water Utilities and other City employees during a natural disaster. Previous actions include: Resolution 06-185 in the amount of $2,778,000.00 was passed by City Council on June 14, 2006. Resolution 06-290 in the amount of $114,489.00 was passed by City Council on September 26, 2006. Resolution 06-387 in the amount of $147,700.00 was passed by City Council on December 19, 2006. Change order No. 3 in the amount of $9,400 on May 15, 2007. This Change Order is recommended for approval by the City Manager and the Water Utilities Director. BUDGETARY IMPACT Funds for the project are available in the Capital Program. Replace the 30" gate valve on the 30" water transmission line with a 30" ($2,400.00) butterfly valve. RECOMMENDATION Administration recommends authorizing the City Manager to enter into a contract with the Center for Safe Communities and Schools to participate in the Texas Tobacco Prevention Initiative Community Law Enforcement Program. BACKGROUND The Beaumont Police Department has participated in the Texas Tobacco Prevention Initiative Community Law Enforcement Program for the past 6 years. This program targets establishments that sell tobacco to minors through inspections and controlled buys. These efforts have resulted in increased compliance with tobacco laws and a reduction in the use of tobacco by minors in the area and statewide. These programs are required for the State of Texas to continue receiving certain types of federal funding which is based upon statewide tobacco law compliance. BUDGETARY IMPACT An additional $2,333.00 in funding for tobacco law compliance enforcement with no cash match. RESOLUTION NO. Section A - Enforcement of Tobacco Laws Contractor shalt: 1. Conduct 15 On-site compliance inspections of tobacco retailers, not using minors as decoys, that may result in the issuance of warnings and/or citations for violations in accordance with the Health and Safety Code, Chapter 161 - Subchapters H and K, and Tax Code violations, Chapter 154- 2. Conduct 30 On-site controlled buys/stings of tobacco retailers using minors as decoys, to determine compliance with applicable laws in accordance with Health and Safety Code, Chapter 161 -Subchapter H. 3. Follow-up inspections of retail outlets found to be in violation of state and local laws. Follow-up inspections shall be conducted within two to ten (2-10) days of original inspection and in the same manner as the original inspection. 4. Enforce state tobacco possession laws for minors (MIP), tobacco possession on school property, at school events, and providing tobacco to a minor in accordance with Health and Safety Code 161- Subchapter N. 5. Contractor shall base the selection of retailers for controlled buys and inspections on the most recent list from the State Comptroller of Public Accounts, and from local historical perspective of previous sales to minors. 6. Participate in any and all ongoing technical assistance offered by the Center for Safe Communities & Schools (CSCS), Texas State University -San Marcos. 7. Assign a minimum of one (1) agency representative to the implementation of the activities of this contract, and provide the name(s) of any key personnel changes that impact the requirements of this contract. Section B - Reporting Requirements: Contractor shall: 1. Submit a monthly activity summary report for the enforcement activities conducted using the appropriate reporting forms provided by the Center for Safe Communities & Schools, Texas State University -San Marcos. 2. For enforcement activities, the monthly activity summary report shall include the number of compliance inspections, controlled buy/stings, follow-up inspections, and Minor in Possession (MIP) citations issued. 3. Max S. Duplant shall be deleted as signatory effective October 15, 2007. RECOMMENDATION The administration requests approval to add Laura Clark as authorized signatory on all city accounts effective October 2, 2007 and delete Max S. Duplant effective October 15, 2007. MATTEL shall have no duty to manufacture and/or sell any LICENSED PRODUCTS or to otherwise exploit the rights granted herein. 4. In the event that :MATTEL does manufacture LICENSED PRODUCTS, then, in full consideration for the rights granted to MATTEL hereunder, MATTEL agrees to furnish LICENSOR with twelve (12) units of each of such LICENSED PRODUCTS, except one (1) sample of any ride -on vehicle LICENSED PRODUCT, at no charge, shipping and handling included. MATTEL shall not be required to furnish to LICENSOR units of any SKU (Stock -keeping Unit, the identification number assigned to individual products) of any LICENSED PRODUCTS unless MATTEL has completed a full and final production run for such SKU. No inadvertent failure of MATTEL to provide any such LICENSED PRODUCTS to LICENSOR shall be deemed a breach of this Agreement, provided that, to the extent reasonably possible and provided that such LICENSED PRODUCTS are currently being manufactured, MATTEL shall retrospectively provide such LICENSED PRODUCTS upon notice from LICENSOR of MATTEL'S failure to do so. 5. MATTEL agrees that the LICENSED PRODUCTS shall be of a standard of quality as high as that of other similar MATTEL products as of the date of this Agreement. 6. In the event that MATTEL does manufacture LICENSED PRODUCTS, then MATTEL shall submit to LICENSOR electronic "e -sheet" (e.g. jpeg) samples of each LICENSED PRODUCT (including packaging and artwork) for approval. LICENSOR shall have ten (10) business days to approve or disapprove the electronic "e -sheet" samples, which LICENSOR shall not unreasonably delay. In any event, the failure by LICENSOR to provide written approval/disapproval within ten (10) business days shall be deemed approved. Upon request and subject to availability and in reasonable quantities, LICENSOR shall have the right to purchase additional quantities of the LICENSED PRODUCTS from MATTEL at MATTEL'S best wholesale price. 7. MATTEL and its subsidiaries may sublicense or assign among themselves and to their subsidiaries the rights to manufacture, import, distribute and sell the LICENSED PRODUCT. MATTEL shall remain directly and primarily obligated under all the provisions of this Agreement and any default of this Agreement by its subsidiaries shall be deemed a default by MATTEL hereunder. 8. In addition to the other rights licensed to MATTEL herein, LICENSOR herein grants to MATTEL the right to use the name, nickname, likenesses and visual or identifying representations of the LICENSED PROPERTY in connection with the marketing and sale of the LICENSED PRODUCTS, including in advertising, selling, packaging and promotional and publicity materials relating to the LICENSED PRODUCTS. 2 M 9. MATTEL acknowledges that nothing contained in this Agreement is intended as an assignment or grant to MATTEL of any right, title or interest in or to the LICENSED PROPERTY or the goodwill attached thereto. 10. LICENSOR shall at all times remain the owner of any and all of the LICENSED PROPERTY created by LICENSOR and used by MATTEL in connection with the LICENSED PRODUCTS. MATTEL shall own all intellectual property rights embodied in the LICENSED PRODUCTS excluding the LICENSED PROPERTY. 11. MATTEL agrees to affix a legal notice on the packaging and other materials that incorporate the LICENSED PROPERTY in order to denote LICENSOR's trademark and/or copyright in materials that incorporate the LICENSED PROPERTY. The legal notice when used on the LICENSED PRODUCTS may be abbreviated in accordance with legal requirements and as space permits. Subject to LICENSOR's exclusive rights to the LICENSED PROPERTY, MATTEL is expressly permitted to apply to the LICENSED PRODUCTS any trademarks, artwork and designs that it selects and to apply appropriate patent, trademark and/or copyright notices. All such trademark and copyright notices shall be in the name of MATTEL, subject to the LICENSOR's exclusive rights to the LICENSED PROPERTY. 12. LICENSOR represents and warrants to MATTEL that, to the best of LICENSOR'S knowledge, it has the full power and authority to enter into this Agreement. 13. MATTEL agrees to indemnify LICENSOR against all third party claims arising out of its marketing or sale of the LICENSED PRODUCTS, including claims for personal injury, except that LICENSOR shall be solely responsible for any claims based upon use of the LICENSED PROPERTY as permitted by this Agreement. MATTEL shall have the right to control the defense and settlement of any such third party claims. 14. Either party may terminate this Agreement in the event that the other party materially breaches the terms of this Agreement or any of the warranties or representations made herein, provided that the non -breaching party provides the breaching party with written notice of such default and sixty (60) days within which to remove or cure such default. If there is no removal or cure of the default within such period, the Agreement: may then be immediately terminated by the non -breaching party. 15. Upon expiration or earlier termination of this Agreement, MATTEL agrees to discontinue all use of the LICENSED PROPERTY, except that MATTEL shall continue to have the right to sell off all existing inventory bearing the LICENSED PROPERTY, whether completed or in the process of manufacture, for a period of six (6) months after expiration or early termination. 16. All notices wherever required in this Agreement shall be in writing and sent by facsimile, certified mail or overnight delivery and shall be deemed given when sent or mailed. 17. If any provisions of this Agreement are for any reason declared to be invalid, the validity of the remaining provisions shall not be affected thereby. 18. This Agreement and each and every one of its provisions shall be interpreted under the laws of the State of California. 3 19. This Agreement represents and expresses the entire agreement of the parties and supersedes all prior agreements, representations and understandings (whether written or oral) between the parties concerning the subject matter hereof. An amendment or modification of a term or condition of this Agreement must be in writing duly executed by both parties. The 88 -page visitors guide is a free publication, consisting of information on museums, attractions, lodging, dining, shopping, and annual events in our area. The primary goals of the project are to restore the integrity of the sanitary sewer lines, restore the carrying capacity, provide customers with uninterrupted and adequate service and meet the Sanitary Sewer Overflow Initiative agreement requirements with the Texas Commission on Environmental Quality. BACKGROUND Three of the four complexes at the Athletic Complex on Langham Road have not been refurbished since their original construction. For the past thirty years, soil materials have been continually added to alleviate drainage issues and prepare fields for play. Play on the fields has become limited during inclement weather as water does not drain quickly to render the fields playable. This contract includes grading each field in accordance with standard baseball field design regulations, installing storm water drainage inlets, and seeding. The proposed improvements were designed by the local engineering firm, Fittz and Shipman, Inc. The contract specifies that the work must be complete by the end of February 2008 so that spring tournament play will not be affected. RECOMMENDATION Administration recommends that Council award to Aetna a two-year contract effective January 1, 2008 for Basic Life and Accidental Death and Dismemberment (AD&D), Supplemental Life and Accidental Death and Dismemberment (AD&D) and Dependent Life Insurance. BACKGROUND Currently, the City provides basic life and accidental death and dismemberment (AD&D) insurance for approximately 1,221 employees. The City sponsored basic life and accidental death and dismemberment insurance is provided at no cost to the employee. The amount of basic life/AD&D insurance is 100% of the employee's annual base salary rounded to the next highest $1,000 to a maximum benefit of $50, 000. Employees may elect to purchase supplemental life and accidental death and dismemberment and dependent life at a group rate. The group rate is usually more cost effective than an individual policy for the employee. Supplemental life, which includes AD&D and dependent life, is offered to all employees with approximately 934 currently participating. This coverage has been provided through Aetna since January 1, 2006. In August 2007, City staff began analyzing the City's life insurance cost. Staff also began working with the City's benefit consultant, Holmes Murphy & Associates to solicit bid proposals on the City's behalf. Requests for Proposal (RFPs) were sent to twenty-five carriers and agents. Holmes Murphy received six proposals including the incumbent's quote for basic life and AD&D, supplemental life and AD&D, and dependent life insurance. Six declined and there was no response from thirteen. The proposers were Aetna, AC Newman, Fort Dearborn, Lincoln Financial, Minnesota Life, and Unimerica. Upon receipt and review of the proposals, Holmes Murphy worked with City staff to determine the top three — Aetna, Fort Dearborn and Lincoln Financial. Upon further negotiation and clarification, Fort Dearborn and Lincoln Financial were eliminated from consideration. Neither was able to match all current benefits nor contract language required from the City, such as portability, actively -at -work, and existing AD&D provisions. After final negotiations, Aetna lowered their original basic life renewal rate per $1000 from $0.14 to $0.13 and lowered their voluntary life/AD&D rate from $0.25 to $0.24. BACKGROUND Entergy -Gulf States, Inc. (EGSI), as well as the other Entergy operating companies such as Entergy Arkansas, Inc., Entergy Louisiana, Entergy Mississippi, Inc., and Entergy New Orleans, Inc., operates as a single unit under the Entergy system agreement. The system agreement governs the rights and duties among the Entergy operating companies. As a condition to participating in a system agreement, each operating company has to be put in roughly the same position as the rest of the operating companies so that each company enters the agreement on equal terms and no company has any advantage relative to the others. One factor in the equalization of the operating companies is the relative cost of producing energy. Basically, those operating companies who can produce energy at lower costs make payments to those operating companies that require higher costs for the production of energy. This adjustment is done through what is called the "Entergy Service Schedule MSS -3." After making these adjustments, the production costs for each Entergy operating company should be roughly the same. Currently, there is one case before the Federal Energy Regulatory Commission (FERC) involving EGSI that will affect the rates of Texas customers in which Cities should intervene. In December of 2005, FERC: issued an order in a case filed by the Louisiana Public Service Commission regarding the rough production cost equalization allocation. FERC determined that the Entergy system was no longer in rough production cost equalization and revised the method for determining such allocations. Under the resulting calculation, Entergy Arkansas is to pay an estimated $293 million to $385 million per year to the other Entergy operating companies. In 2005, the yearly payment to EGSI for 2006 forward was estimated to be in the range of $196 million to $264 million. The current case before FERC was filed pursuant to the above -referenced order to determine the rates that will result from the FERC's previous decision. Among the issues Cities have a stake in are the allocation of these payments among the Entergy operating companies and the allocation of EGSI's share of the payments between Texas and Louisiana customers. On January 23, 2007, by Resolution No. 07-025, the City Council authorized participation with other Entergy service area cities in matters concerning Entergy -Gulf States, Inc., before the Public Utility Commission of Texas. This authority, however, does not provide for participation with the Cities' Steering Committee in matters before the Federal Energy Regulatory Commission. This action is a request for authority to participate with the Cities' Steering Committee representing Entergy service area cities in matters before the Federal Energy Regulatory Commission. BUDGETARYIMPACT All reasonable expenses associated with rate matters will be reimbursable by the company as they have been in the past. RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, AUTHORIZING PARTICIPATION WITH OTHER ENTERGY SERVICE AREA CITIES IN MATTERS CONCERNING ENTERGY GULF STATES, INC., AT THE FEDERAL ENERGY REGULATORY COMMISSION FILED IN 2007 AND 2008. WHEREAS, Entergy Gulf States' (EGSI) implementation of customer choice has been delayed due to lack of competition; lack of independent market structures and organizations in its service territory to implement fair competition; and because EGSI's ability to control the market in its region has not been evaluated, EGSI will continue to be regulated; and WHEREAS, cases filed at the Federal Energy Regulatory Commission ("FERC") regarding EGSI could have a substantial impact on the rates charged to Texas customers and the effective regulation of EGSI's rates by Texas regulatory authorities; and WHEREAS, Cities have a duty to set fair and reasonable rates for both the Company and ratepayers within Cities; WHEREAS, Cities have exclusive original jurisdiction over rates, operations and services of an electric utility in areas in the municipality pursuant to Tex. BACKGROUND The structure at 320 College Street, known as the Waldman Smallwood Building, was damaged during Hurricane Rita. City staff identified the structure as being in need of repair in June 2006. Council deferred the issue to the property owner in September 2006 allowing time to consider repair options. In December 2006, Council issued an order to the owner to raze or repair the structure within 150 days. On July 23, 2007, City staff inspected the property and found no repairs had been completed by the property owner. New structural cracks had formed on the north end of the building and the brick facade was in imminent danger of collapse. Rain was the probable cause of the continued shifting of the structure. There was also evidence that people were accessing the interior of the building. The structure had become a public; hazard and required immediate demolition. State of Texas statutes provide an exemption to competitive bidding if the procurement is necessary to preserve or protect public health and safety. BUDGETARY IMPACT Funds are available for this expenditure in the FY 2007 General Fund Budget. BACKGROUND House Bill 621, which takes effect January 1, 2008, amends the Tax Code and the Government Code to add an exemption from ad valorem taxation for "goods -in -transit". The exemption applies to tangible personal property that is acquired in or imported into Texas, detained at a location in Texas in which the property owner does not have a direct or indirect ownership interest, used for assembling, storing, manufacturing, processing, or fabricating purposes, and transported to another location in Texas or out of state not later than 175 days after the property was acquired in or imported into Texas. "Goods -in -transit" does not include oil, natural gas, petroleum products, or any types of equipment to which special inventory taxes apply such as automobiles, mobile homes, heavy equipment, etc. Local taxing units may elect: not to participate in the exemption. However, in order to do so, the taxing unit must hold a public hearing and adopt a resolution to continue taxing "goods -in -transit". BUDGETARY IMPACT Because this is a new exemption, the potential loss in revenue due to the exemption cannot be estimated. However, based on conversations with the Jefferson County Appraisal District, it is anticipated that a significant reduction in ad valorem taxes and industrial payments could result if the exemption is allowed.
