Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on July 1, 2014 at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:33 p.m. Pastor "Big Jim" Salles of West End Baptist Church gave the invocation and led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Coleman, Councilmembers Getz, Wright, Pate, Samuel and Smith. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions Presentation — Lynn Huckaby, Senior Services Coordinator with the Best Years Center, introduced volunteer Marian Pekar, who won the National Volunteer Award by the National Association of Activity Professionals, Lynn presented Marian with the award Presentation — Bengy Williams, Operations Manager for the City of Beaumont's Solid Waste Division, introduced employees and supervisor from the Division who competed in the Annual State Road -E -O Competition in the City of EI Paso. The competition is designed to be a competitive driving/operating event meant to measure the operator's skill and safety in performing their daily task Presentation — Doreen Borel, with H -E -B stores presented a State Award, IT'S TIME TEXAS to Mayor Pro Tem Alan Coleman for his works in creating healthy communities. Mayor Pro Tem Coleman traveled to Austin, TX for the IT'S TIME TEXAS Summit Awards recognizing exemplary health champions who work to build and sustain health communities. The H -E -B Foundation is one of the five major sponsors of this effort Public Comment: Persons may speak on scheduled agenda 1-3/Consent Agenda. None Minutes — July 1, 2014 CONSENT AGENDA Approval of minutes - June 24, 2014 Confirmation of committee appointments - None A) Approve a contract for the purchase of automobile batteries — Resolution 14 -141 B) Authorize the City Manager to execute an agreement with Air Comfort, Inc. for the placement of fiber optic cable in the public right-of-way — Resolution 14 - 142 C) Authorize the City Manager to execute all documents necessary for an affiliation agreement between The City of Beaumont's EMS Division and Training Division.com — Resolution 14 - 143 Councilmember Smith moved to approve the Consent Agenda. Councilmember Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE, SAMUEL AND SMITH NAYS: NONE MOTION PASSED Councilmember Smith left the meeting at 1:50 p.m. GENERAL BUSINESS 1. Consider a resolution approving the award of three contracts for temporary personnel Services. Specifications for the contract require temporary staffing agencies to provide pre-screened and qualified individuals on an on-call and as -needed basis. Temporary employees must pass a drug screen and a criminal background search prior to being assigned to the City. The contract specifications requested firm hourly prices inclusive of wages, benefits, testing, screening, workers compensation, taxes, and agency fees. Eight (8) vendors were solicited and four (4) companies submitted bids for an annual contract to provide temporary employees to fill positions in business offices, skilled and unskilled laborers, equipment operators, and Licensed Vocational Nurses (LVN). Three (3) of the four (4) submitted valid bids. The fourth, Jolt Consulting, Inc., of Houston submitted a non -conforming bid and was rejected. Administration recommends awarding of this bid in the Primary, Secondary and Tertiary format as the best value to the City. Administration recommends the award of annual contracts to Lofton Staffing, Inc., of Beaumont, as primary vendor; to Advanced Staffing, Inc. of Beaumont, as secondary vendor; and to Personnel Staffing, Inc., of Beaumont, as tertiary vendor. Total contract Minutes — July 1, 2014 value is based on actual billed hours over the past twelve (12) months for each labor skill group. Funds are available for this expenditure in the user Departments' operating budgets. COuncilmember Pate moved to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY LOFTON STAFFING, INC., OF BEAUMONT, TEXAS, AS PRIMARY VENDOR; THE BID SUBMITTED BY ADVANCED STAFFING, INC., OF BEAUMONT, TEXAS AS SECONDARY VENDOR; AND, THE BID SUBMITTED BY PERSONNEL STAFFING, INC., OF BEAUMONT, TEXAS, AS TERTIARY VENDOR; AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE AN ANNUAL CONTRACT TO PROVIDE TEMPORARY PERSONNEL SERVICES FOR THE CATEGORIES AND HOURLY RATES TO BE ACCEPTED BY THE CITY OF BEAUMONT. Mayor Pro Tem Coleman seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 14 - 144 2. Consider a resolution authorizing the award of a bid to Allco, Inc. of Beaumont for the concrete repair of sections of Tyrrell Park Road. During installation of a pipeline on the Keystone Project in the fall of 2013 sections of Tyrrell Park Road were damaged from heavy equipment being used. The contractor Sunland Construction, Inc., made an agreement with the City of Beaumont to pay $150,000.00 for damages to the road. The proposed improvements include replacing the damaged sections of the concrete with new 8" thick reinforced concrete. On Thursday, June 19, 2014 bids were solicited for furnishing all labor, materials, equipment and supplies for the rehabilitation/repair of concrete sections of Tyrrell Park Road. April 9, 2014 Sunland Construction, Inc., paid the City of Beaumont $150,000.00 for damages caused to Tyrrell Park Road during the installation of the pipeline. Funds are available for the balance in the Capital Program. COuncilmember Wright moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO ALLCO, INC., OF BEAUMONT, TEXAS, IN THE AMOUNT OF $223,040.62 FOR FURNISHING ALL LABOR, MATERIAL, EQUIPMENT AND SUPPLIES FOR THE REHABILITATION/REPAIR OF CONCRETE SECTIONS OF TYRRELL PARK ROAD. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE Minutes — July 1, 2014 MOTION PASSED Resolution 14 - 145 3. Consider a resolution authorizing the award of a contract to Conroe Pipe, Inc. for the purchase of Precast Concrete Box Culverts. Drainage District 6 has proposed that the City of Beaumont participate in a joint effort to improve the drainage capacity of ditch 119 to eliminate flooding during heavy rain events. Drainage ditch 119 provides drainage for more than thirty residential streets. Please see "Attachment A" for an illustration of the drainage area. Drainage District 6 has performed a drainage study of the area and determined that ditch overflows onto Howell Street can be avoided by installing drainage box culverts with larger capacities under the roadway pavement at Belvedere and Howell Street crossings. See "Attachment B" for an illustration of the overflow observed at Howell Street on October 31, 2013. Previous overflows have undermined the integrity of the base under Howell Street resulting in pavement failures. Drainage District 6 has agreed to provide the equipment and labor to install the proposed box culverts and construct the concrete transitions from the boxes to ditch 119 provided the City of Beaumont supplies the proposed box culverts. On May 29, 2014 the City of Beaumont received one (1) bid for the Purchase of Precast Box Culverts in the amount of $199,944.00. The estimated cost prior to receipt of bids was $200,000.00. Funds are available in the Capital Program COuncilmember Getz moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO CONROE PIPE, INC., OF CONROE, TEXAS, FOR THE PURCHASE OF 180 LINEAR FEET OF 9'X5' PRECAST CONCRETE BOX CULVERTS AND 180 LINEAR FEET OF 10'X3' PRECAST CONCRETE BOX CULVERTS TO BE INSTALLED AT GRAVITY DRAINAGE DISTRICT 6 DRAINAGE DITCH 119 TO ELIMINATE FLOODING DURING HEAVY RAIN EVENTS IN THE AMOUNT OF $199,944. Beaumont TX Commented on the constitution and the due process of law, stated that there was a execution of a citizen on June 2, 2014 in the City of Beaumont, asked if anyone thinks they have been denied their rights of due process, asked that he be contacted or contact the Texas Tea Party headquarters at 2915 San Jacinto St, in Beaumont Robert Peavey 715 Chamberlin Dr. Beaumont TX Spoke to Council in regards to BISD and what it has done to the Community, wanted Council to know the pain that he feels where BISD is concerned, stated that he owns PumpTex Inc., his problem is that he is having a huge problem recruiting people from New York to California to come to his branch to work since it's specialized, most of the people that he tries to recruit won't come to Beaumont due to the school district, asked that everyone including Council work together to restore Beaumont Minutes — July 1, 2014 Drew Loker 1750 Rikisha Beaumont TX Encouraged each Councilmember to get involved in BISD in the effort to restore confidence in the school and the City, the two are one in the same, if the district fails the City fails it's that simple, thanked Councilmember Getz in his effort to save the school district, others have been passive in this matter and it's killing the City, it is a dire situation as people are fleeing, stated that parents are paying for their children to go to private school or schools surrounding Beaumont, the issue with BISD, as a teacher at West Brook High School is that it's affecting the dynamics inside the classroom as well as the City as a whole, at this time he requested that the City get involved as more teachers will be a part of a RIF next year, also addressed streets within the City of Beaumont and asked that there be no more overlays done Brian Muldrow 2002 Park St. Beaumont TX Spoke to Council in regards to his building on Park St., stated that he was told that the only person that can't speak with him about the property he speaking about is the City Manager due to it being a legal matter, doesn't understand why any of Council will not respond to him, stated that he would appreciate if Council would respond to him when he proceeds to contact them in the next two to three weeks There being no Executive Session, Council adjourned at 2:10 p.m. o available upon reques"i the City Clerk's Office.
