Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on April 1, 2014, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor James Blackwell former Pastor of South Park Baptist Church gave the invocation. Mayor Ames announced the passing of Carolyn Chaney who served as a federal advocate since 1981 for the City of Beaumont. The Mayor asked that everyone have a moment of silence on her behalf. The Vietnam Veterans of America Southeast Texas Chapter 292 led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Wright, Councilmembers Coleman, Getz, Pate, Samuel and Smith. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions Recognitions Kerwin Stone, President of Chapter 292 will address Council about the Dedication of the Texas Capitol Vietnam Veterans Monument, and thanked the City of Beaumont for its support and the sponsors and citizens of Beaumont for contributing $70,000 to the Monument "Sixty -Six Neches River Festival Week" —April 1-13, 2014 - Proclamation read by Mayor Ames; accepted by Bernie Daleo, President of Neches River Festival, and Social Chairs Kara Wied and Sue Golias Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda. None CONSENT AGENDA Approval of minutes - March 25, 2014 Minutes — April 1, 2014 Confirmation of committee appointments - None A) Approve a resolution authorizing the City Manager to renew the WIC Division Lease Agreement — Resolution 14 - 068 B) Approve a resolution accepting the donation of property for the development of Northwest Parkway Project (14.553 acres situated in W. B. Dyches Survey, Abstract No. 17) — Resolution 14 - 069 D) Approve a resolution authorizing the City Manager to execute all documents necessary for an affiliation agreement between The City of Beaumont's EMS Division and San Jacinto College — Resolution 14 - 071 E) Approve a resolution authorizing the execution of a License to Encroach Agreement with Terry Chilton — Resolution 14 - 072 F) Approve a resolution authorizing the settlement of the claim styled City of Beaumont v. Sunland Construction, Inc. and TransCanada Keystone Pipeline, LP — Resolution 14 - 073 Councilmember Getz moved to approve the Consent Agenda excluding Item C. Mayor Pro Tem Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS COLEMAN, GETZ, PATE, SAMUEL AND SMITH NAYS: NONE MOTION PASSED C) Approve a resolution authorizing eminent domain proceedings to acquire property for the Northwest Parkway Project (1.961 acres of land, situated in the W. B. Dyches Survey, Abstract No. 17) — Resolution 14 — 070 Councilmember Coleman moved that the City of Beaumont authorize the use of the power of eminent domain to acquire a fee simple title interest in 1.961 acres of land, situated in the W. B. Dyches Survey, Abstract No. 17 Beaumont, Jefferson County, Texas, for the purpose of the Northwest Parkway Road Improvement Project. Councilmember Pate seconded the motion. Consider a resolution approving the award of a contract for the purchase of firefighter protective clothing from Casco Industries, Inc. of Houston. The Fire Department has tested several brands of fire protective clothing over the past year. They have determined that the line from Globe Manufacturing Co., offers ease of movement, excellent protection for fire fighters, and best value to the City. The clothing is made of fire retardant materials to provide protection from burns and exposure to hazardous chemicals during fire fighting operations, and provides protection from blood- borne pathogens. The Globe equipment tested has proven superior in performance to other manufacturers equipment, and at a cost approximately $35.00 less per set. Casco Industries, Inc., of Houston is the exclusive and sole source vendor for Globe Manufacturing in Texas and surrounding states. Councilmember Smith moved to APPROVE A RESOLUTION THAT THE CITY MANAGER HEREBY APPROVES THE AWARD OF A CONTRACT TO CASCO INDUSTIRES, INC., OF HOUSTON, TEXAS, THE SOLE LOCAL SOURCE FOR GLOBE MANUFACTURING CO. EQUIPMENT, FOR THE PURCHASE OF AN ESTIMATED QUANTITY OF 60 SETS OF FIRE PROTECTIVE CLOTHING FOR FIREFIGHTERS AT $2,125 PER SET FOR AN ESTIMANTED TOTAL COST OF $127,500. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS COLEMAN, GETZ, PATE, SAMUEL AND SMITH NAYS: NONE MOTION PASSED Resolution 14 — 074 Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. COUNCILMEMBER COMMENTS COUNCILMEMBER SMITH - THANKED PASTOR KENNEDY WITH HARVEST OF LOST SOULS WHO IS ORGANIZING A GROUP FOR THE TEXAS TRASH OFF ON SATURDAY, APRIL 5, 2014, PRAYERS GO OUT TO Minutes — April 1, 2014 THE FAMILY OF CAROLYN CHANEY AND THOSE SHE WORKED WITH COUNCILMEMBER SAMUEL - LOOKING FORWARD TO THE BEAUMONT TRASH OFF ON SATURDAY, APRIL 5, 2014, EXTENDED HEARTFELT CONDOLENCES TO THE CHANEY FAMILY ON THE LOSS OF CAROLYN CHANEY COUNCILMEMBER PATE - CONDOLENCES TO THE CHANEY FAMILY, CAROLYN WAS A WONDERFUL PERSON AND DID A WONDERFUL JOB FOR THE CITIZENS OF BEAUMONT, EXCITED ABOUT THE TEXAS TRASH OFF AS WELL AS THE NECHES RIVER FESTIVAL ON SATURDAY, APRIL 5, 2014, REMINDED EVERYONE THAT THE TEXAS STATE FAIR IS STILL GOING ON, ENCOURAGED EVERYONE TO GO OUT TO THE FAIR MAYOR PRO TEM WRIGHT - HEARTFELT CONDOLENCES TO THE CHANEY FAMILY, ENCOURAGED EVERYONE TO VISIT THE TEXAS STATE FAIR, MENTIONED THE NECHES RIVER FESTIVAL AND THE TEXAS TRASH OFF ON SATURDAY, APRIL 5, 2014, THANKED EVERYONE FOR THE GET WELL WISHES DURING HER ILLNESS COUNCILMEMBER GETZ - CONDOLENCES TO THE CHANEY FAMILY, CAROLYN DID A WONDERFUL JOB ADVOCATING FOR THE CITY, ENCOURAGED EVERYONE TO ATTEND THE TEXAS STATE FAIR, THEY HAVE HAD A RECORD NUMBER IN ATTENDANCE, STATED THAT THERE IS A GROUP OF CITIZENS THAT HAVE TAKEN THE TIME TO RAISE MONEY FOR SCHOOL SUPPLIES, IT APPEARS THAT THE SCHOOL DISTRICT CURRENTLY DOESN'T HAVE FUNDING TO GIVE THE TEACHERS THE MATERIAL THEY NEED FOR THEIR CLASSROOM INSTRUCTIONS, IF ANYONE IS INTERESTED IN MAKING A DONATION PLEASE CONTACT HIM SO THAT HE MAY DIRECT THEM APPROPRIATELY COUNCILMEMBER COLEMAN - CONDOLENCES TO THE CHANEY FAMILY, ENCOURAGED EVERYONE IN WARD 1 TO GET OUT ON SATURDAY FOR THE TEXAS TRASH OFF, GAVE THE LOCATIONS FOR THE TRASH OFF, MENTIONED THE NECHES RIVER FESTIVAL AS WELL CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - STATED THAT THERE WAS A FORECLOSURE SALE FOR HOTEL BEAUMONT AT THE JEFFERSON COUNTY COURT HOUSE AT 1:00 P.M., THE CITY WAS THE HIGHEST BIDDER, THE CITY WILL BE MOVING FORWARD WITH SELLING THE BUILDING THROUGH CONVENTIONAL MEANS, WOULD LIKE TO SET A MINIMUM OF $1.1 MILLION, OFFERS WILL BE ACCEPTED ABOVE THAT AMOUNT, ONCE THE AMOUNTS HAVE BEEN ACCEPTED IT WOULD BE BROUGHT TO COUNCIL FOR CONSIDERATION Minutes — April 1; 2014 MAYOR AMES - ANNOUNCED ON SATURDAY, APRIL 5, 2014, THE BEAUMONT TRASH OFF THAT STARTS AT 8:00 A.M., THE NECHES RIVER FESTIVAL PARADE WILL START AT 10:00 A.M., DOWNTOWN, BREAKFAST WITH THE BISHOP WHICH IS A FUNDRAISER FOR CATHOLIC CHARITIES WILL START AT 9:00 A.M., TEA OUT AT THE BOTANICAL GARDENS, THE 7T" DAY ADVENTIST CHURCH HAS A FESTIVAL ON THEIR GROUNDS, AS WELL AS THE TEXAS STATE FAIR, MENTIONED THAT ON LAST WEEK THE TEXAS ENERGY MUSEUM CELEBRATED THEIR ANNUAL FUND RAISER, THE SPEAKER WAS ROBERT S. MULLER III, FORMER FBI AGENT Public Comments (Persons are limited to three minutes) David R. Pete 4390 Corley Ave Beaumont TX Commented on a pamphlet that he received, read about certain projects that the city has engaged in, asked Council where the money is coming from, stated that Council speaks of projects on Washington Blvd, MLK, and other areas, stated that the projects have not been done yet, there are still a lot of streets that are torn up, stated that the money is not being allocated in the proper way, more money is being spent in the West End, the streets are paved with curbs and in other areas the streets are just done with tar overlay and being patched, stated that streets should be the same throughout the City not just in the West End Open session of meeting recessed at 2:03 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Robert Louis Patillo vs. The City of Beaumont; Case No. A-194,989 The U.S. Department of Housing and Urban Development's Small Business Revolving Loan Fund As authorized by Section 551.087 of the Government Code, to discuss and deliberate economic development negotiations regarding a business entity proposing a Ford Park Convention Hotel and Water Park There being no action taken in Executive Session, Council adjourned.
