WHEREAS, the claim styled City of Beaumont v. Sunland Construction, Inc. and
TransCanada Keystone Pipeline, LP has been discussed in an Executive Session properly
called and held Tuesday, March 25, 2014; and,
WHEREAS, the City Attorney is requesting authority to settle this claim;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT the City Attorney be and he is hereby authorized to settle the claim styled City
of Beaumont v. Sunland Construction Inc. and TransCanada Keystone Pipeline, LPforthe
receipt of the sum of One Hundred Fifty Thousand and XX/100 Dollars ($150,000); and,
BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby
authorized to execute all documents related to settlement of the claim.
