Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on March 4, 2014, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Casey Zimmerman with Friendship Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Councilmembers Coleman, Getz, Pate and Samuel. Absent: Mayor Pro Tern Wright and Councilmember Smith. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Mayor Pro Tem Wright was absent due to illness. Councilmember Smith was absent due to work. None CONSENT AGENDA Approval of minutes - February 25, 2014 Confirmation of committee appointments - None A) Approve a resolution approving the purchase of exercise equipment for the Fire Department — Resolution 14 - 052 B) Approve a resolution approving a change order to the contract with Allco, LLC, related to the Grit Pump Replacement — Wastewater Treatment Plant Project — Resolution 14 - 053 C) Approve a resolution authorizing the City Manager to apply for and receive funding through the TexTreasures Grant Program to help member libraries make their special collections more accessible to researchers across Texas and beyond — Resolution 14 - 054 D) Approve a resolution authorizing the City Manager to submit an application to the Texas Department of Transportation for temporary use of State of Texas right-of-way for the Gusher Marathon — Resolution 14 - 055 E) Approve a resolution approving a contract with Texas Liqua Tech Services, Inc. for the replacement of the roof on Fire Station No. 9 — Resolution 14 - 056 F) Approve a resolution approving a change order to the contract with Allco, Inc. for the South Park Drainage Improvement Project — Resolution 14 - 057 Councilmember Samuel moved to approve the Consent Agenda. Councilmember Coleman seconded the motion. AYES: MAYOR AMES, COUNCILMEMBERS COLEMAN, GETZ, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution approving the award of a bid to N & T Construction Company, Inc. of Beaumont for the construction of the new Beaumont Public Health Facility. A grant from the Texas Community Development Block Grant (CDBG) Disaster Recovery Program for areas impacted by Hurricane Ike was awarded for the construction of the new Beaumont Public; Health Facility. The 30,000 sq. ft. facility will be constructed on property owned by the City at 3040 College. The building on this site, the former Texas National Guard Armory, will be demolished. Minutes — March 4, 2013 This new facility will consolidate the department's four buildings located or) Washington Boulevard and Laurel Avenue into one facility. The facility was designed by the Labiche Architectural Group of Beaumont. The two story facility includes Health and EMS administrative offices, Women's Infants and Children (WIC) clinic, Immunization clinic, Tuberculosis (TB) medical clinic, Sexually Transmitted Disease (STD) clinic, Environmental Health, and Vital Statistics. The facility will also have meeting and conference rooms, waiting rooms, employee break rooms and storage for bulk medical supplies,. A back up generator will also power the building's critical areas in the event of a power failure. The low bidder, N & T Construction is scheduled to complete the project in 425 days. N & T Construction is, a state certified HUB vendor. Additionally, the contractor will be required to comply with the City's Section 3 policy regarding the hiring of low income individuals from the affected area. The Supplemental Disaster Grant is in the amount of $6,710,000. Engineering and Project Management fees were also included in this total. The balance of grant funds available for construction total $5,872,600. The balance of $797,400 is available in the Capital Program. Councllmember Coleman moved t0 APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO N&T CONSTRUCTION COMPANY, INC., OF BEAUMONT, TEXAS, IN THE AMOUNT OF $6,670,000 FOR CONSTRUCTION OF THE NEW BEAUMONT PUBLIC HEALTH DEPARTMENT. Councilmember Pate seconded the motion. AYES: MAYOR AMES, COUNCILMEMBERS COLEMAN, GETZ, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 14 - 058 2. Consider a resolution approving the award of a design build contract to Allco Construction of Beaumont for the construction of four open air tennis courts, four covered tennis courts and a viewing loggia. Four (4) proposals were accepted for design build services to construct eight new tennis courts of which four will be covered at the Athletic Tennis Complex on College Street. This is the final phase of the tennis complex upgrades proposed in the Capital Program. Phase I included the construction of eight (8) new courts in 2010, Phase II included the construction of a tennis clubhouse and Phase III includes the construction of four covered courts, four open courts and a viewing loggia. A design build project consists of an engineer, architect, landscape architect and construction contractor working together under a single contract. In this type of agreement, the design build contractor designs and constructs the project and assumes all risks. Four companies submitted proposals for this project. They were Allco Construction, N & T Construction Company, Brystar Construction, and H. B. Neild Construction all of Beaumont. Minutes — March 4, 2014 3 Allco's design team includes Burdett Land and Placement Consultants of Conroe, Hellas Sports Construction of Austin and Allco Construction of Beaumont. Staff reviewed and ranked each proposal's technical approach as well as their experience. Following an in person interview with their team, staff determined that Allco provided the most qualified team for this project. Upon award of the contract, staff will begin working with the team to design the court cover, tennis courts and loggia. Allco was also awarded the contract for the construction of the new clubhouse which began January 29, 2014. Allco plans to have the project completed in seven (7) months. Councilmember Getz moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A DESIGN BUILD CONTRACT TO ALLCO CONSTRUCTION, OF BEAUMONT, TEXAS, IN THE AMOUNT OF $2,200,000 FOR THE CONSTRUCTION OF FOUR (4) OPEN AIR TENNIS COURTS, FOUR (4) COVERED TENNIS COURTS AND A VIEWING LOGGIA AT THE ATHLETIC TENNIS COMPLEX LOCATED ON COLLEGE STREET. Councilmember Pate seconded the motion. AYES: MAYOR AMES, COUNCILMEMBERS COLEMAN, GETZ, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 14 -.059 Consider amending Section 20.03.004, Speed Limits Decreased in School Zones, of the Code of Ordinances that would update the locations and limits of school speed zones. The Public Works Department/Transportation Division has recently received reports of a significant number of students walking from Charlton -Pollard Elementary to the Junior League Resource Center after school. In the interest of the student's safety, it is recommended that schedule A for a reduced speed limit within a school zone listed in the Code of Ordinances be modified to extend the boundaries for the school zone on Irving Avenue as detailed below: Irving Avenue N&S From a point 50 feet north of the centerline of Cuniff Avenue to a point 40 feet south of the centerline of Sherman Street. Councilmember Coleman moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 20, SECTION 20.03.004 SCHEDULE A OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, COUNCILMEMBERS COLEMAN, GETZ, PATE AND SAMUEL NAYS: NONE Minutes — March 4, 2014 MOTION PASSED Ordinance 14 - 010 WORK SESSION Discuss a plan for the Children's Museum of Beaumont to locate and build out exhibits within the Civic Center area currently utilized for meeting rooms Kyle Hayes, City Manager discussed the Children's Museum of Beaumont, he stated that the City of Beaumont has a partnership with the Children's Museum at this time. There is an existing lease agreement with the museum for the Oil City Brass site which will soon be demolished. This will be a future site for them to build on. It has been very difficult for the museum to raise funds at this time with the economic down turn as well as not having a specific building. The Manager stated that he and staff have been exploring ideas to help facilitate the Children's Museum opening downtown in the Central Business district. Lennie Caballero, Director of the Event Facilities, came up with the idea to make some of the meeting space at the Civic Center available to the Children's Museum until they are able to build or move into their own building. The Manager stated that the meeting space at the Civic Center is underutilized at this time. Having the Children's Museum downtown would bring more people, there is also adequate space for buses to bring the kids in. If Council would give a green light to move forward, then a lease agreement of $500.00 a month would be negotiated. Council agreed that negotiations could take place, with an action item to follow. COUNCILMEMBER COMMENTS COUNCILMEMBER SMITH - ABSENT COUNCILMEMBER SAMUEL - STATED THAT HE RECEIVED SEVERAL CALLS REGARDING THE STATUS OF THE QUITE ZONE FOR THE DOWNTOWN AREA, IT HAS COME TO HIS ATTENTION THAT THE CITY IS WAITING TO RECEIVE INFORMATION FROM TXDOT TO BRING TO THE RAILROAD, THIS IS REQUIRED TO MEET THE STATUTORY REQUIREMENTS TO CREATE THE QUITE ZONE, IT'S ANOTHER GREAT DAY IN BEAUMONT AND A GREAT DAY TO GET OUT AND VOTE COUNCILMEMBER PATE - ENCOURAGED EVERYONE TO VOTE, TODAY IS THE LAST DAY, CONGRATULATED LAURA CLARK AND HER STAFF ON A GREAT JOB, EXCITED ABOUT THE CHILDREN'S MUSEUM, ALSO ANNOUNCED THAT THE TASTE OF THE TRIANGLE WILL BE HELD ON TONIGHT (TUESDAY, MARCH 4, 2014) AT 6:30 P.M. AT THE BEAUMONT CIVIC CENTER, ALSO ON THURSDAY NIGHT THERE WILL BE A FUND RAISER FOR THE ART MUSEUM "GO FOR THE GOLD" ENCOURAGED EVERYONE TO ATTEND MAYOR PRO TEM WRIGHT - ABSENT COUNCILMEMBER GETZ - ENCOURAGED CITIZENS TO GO VOTE IF THEY HAVEN'T DONE SO, PLEASED TO SEE THE UTILIZATION OF THE CIVIC CENTER Minutes — March 4, 2014 WITH THE TASTE OF THE TRIANGLE COMING BACK AS WELL AS A HOME SHOW THAT WILL BE COMING BACK TO THE CIVIC CENTER, VERY PLEASED ABOUT THAT, ASKED THAT CITIZENS COME OUT TO THE HOME SHOW COUNCILMEMBER. COLEMAN - THANKED 17 STUDENTS THAT ARE HERE IN BEAUMONT FROM VILLANOVA UNIVERSITY SPENDING THEIR SPRING BREAK WORKING FOR HABITAT FOR HUMANITY, THEY ARE STAYING AT WESLEY UNITED METHODIST CHURCH, STATED IT'S GREAT TO SEE KIDS THAT ARE DOING POSITIVE THINGS ON SPRING BREAK CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - STATED THAT THE TASTE OF THE TRIANGLE IS PUT ON BY THE SABINE AREA RESTAURANT ASSOCIATION, THE MONEY RAISED GOES TO DIFFERENT CHARITIES MOST OF THEM ARE CHILDREN ORGANIZATIONS THROUGHOUT THE CITY, WANTED EVERYONE TO REMEMBER WHERE THE MONEY GOES AND WHY THE TASTE OF THE TRIANGLE WAS STARTED Public Comments (Persons are limited to three minutes) Allison Getz 7950 Phelan Beaumont TX. Thanked Council in regards to the new Tennis Center, thanked the City Manager as well as Brenda Beadle for making it a reality, also spoke as the President of the Children's Museum, thanked the City Manager again as well as Lennie Caballero for coming up with the fantastic idea, they can now be an organization with walls Elizabeth Schreck 995 East Dr. Beaumont TX Spoke to Council as the Vice President of the Children's Museum, gave Council some statistics in regards to Children Museums being a part of a downtown, stated that the the members of the Children's Museum go into schools, library's, home schools, there are no fees required, everything is free There being no Executive Session, Council adjourned at 2:28 p.m. io availa upon request in the City Clerk's Office. „n , r , Mayor U Tina Broussard, City Clerk Minutes — March 4. 2014
