CONSENT AGENDA Approval of minutes—October 29, 2013 Confirmation of committee appointments A) Approve Compensation for the Chief Magistrate B) Approve a resolution approving the purchase and installation of playground equipment at Rogers Park C) Approve a resolution authorizing the acceptance of a ten foot (10") wide Exclusive Water Line Easement located at 1555 West Cardinal Drive A November 5, 2013 Approve Compensation for the Chief Magistrate 1-he Chief Magistrate, Craig Lively, will receive a 3% increase to base wages. He will also receive a car allowance of$200 per month. All other benefits extended to civilian employees will continue to be provided as well. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the base wages of the Chief Magistrate, Craig Lively, will be$10,039.42 per month. A car allowance will be $200.00 per month. NOTWITHSTANDING the foregoing compensation and benefits, all other compensation, benefits, terms and conditions of employment with the City of Beaumont shall be pursuant to City policy and the Charter of the City of Beaumont, as with other civilian employees. BE IT FURTHER RESOLVED that the hourly rate for the part-time Magistrate position shall be $300.00 per session. This resolution shall be effective immediately upon passage. PASSED BY THE CITY COUNCIL of the City of Beaumont this the 5th day of November, 2013. - Mayor Becky Ames - B RICH WITH OP'PORTUNIT'Y' r C ► T • E • x • A • s City Council Agenda Item TO: City Council FROM: Kyle Hayes, City Manager PREPARED BY: Laura Clark, Chief Financial Officer MEETING DATE: November 5, 2013 REQUESTED ACTION: Council consider a resolution approving the purchase and installation of playground equipment at Rogers Park from Kraftsman Commercial Playgrounds and Water Parks of Spring, Texas in the estimated amount of$61,635.81. BACKGROUND Playground structures at Rogers Park which were built in the 1980's can no longer be maintained in a safe and usable condition. These old structures and some portions of the concrete safety zones will be removed and replaced with the new structures and equipment. Parks Division personnel will remove the old structures and prepare the site for the new installations. A new Custom Quest Playground Unit for ages 2-12 will be installed. Additional equipment including a Merry Go-Round, Shaded Swings and four (4) Independent Play Units will also be installed. Pricing was obtained through the Texas Association of School Boards (BuyBoard), a cooperative purchasing association providing cities and political subdivisions with the means to purchase specialized equipment at volume pricing. BuyBoard complies with State of Texas procurement statutes. Manufacturer's warranties on various equipment are provided for up to fifteen (15) years. Kraftman provides a one year warranty on installation. FUNDING SOURCE Proceeds from the sale of Fair Park property in the amount of $123,000 that were received in 2012 are required to go back into the Park system. The remainder of funds were utilized at Ida Reed Park for playground improvements. RECOMMENDATION Approval of the resolution. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Council hereby approves the purchase and installation of playground equipment at Rogers Park from Kraftsman Commercial Playgrounds and Water Parks, of Spring, Texas, in the amount of $61,635.81 through the Texas Association of School Boards (BuyBoard) Cooperative Purchasing Program. BACKGROUND Duff Real Estate, LLC has agreed to convey a ten foot (10') wide exclusive Water Line Easement to the City of Beaumont. The easement is described as being a 0.0795 acre tract out of and part of Block 115, Gladys City Oil. Gas & Manufacturing Company Subdivision situated in the John A. Veatch Survey. Abstract No. 55. The water line easement is for a new building located at 1555 West Cardinal Drive. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of resolution. RESOLUTION NO. WHEREAS, Duff Real Estate, LLC has agreed to convey one (1)ten foot (10')wide exclusive water line easement, said easement being a 0.0795 acre tract out of and part of Block 115, Gladys City Oil, Gas & Manufacturing Company Subdivision situated in the John A. Veatch Survey, Abstract No. 55, as described in Exhibit"1" and shown on Exhibit "2," attached hereto, to the City of Beaumont for the purpose of facilitating the construction of a new building located at 1555 West Cardinal Drive; and, WHEREAS, the City Council has considered the purpose of said conveyance and is of the opinion that the acceptance of said conveyance is necessary and desirable and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the easement conveyed by Duff Real Estate, LLC, as described in Exhibit"1" and shown on Exhibit"2," be and the same is hereby, in all things, accepted for the stated purposes.
