S r71, A 2 f Y� • �t ORDINANCE NO. 4'5 ENTITLED AN ORDINANCE CANVASSING THE RETURNS OF THE REGULAR CITY ELECTION WHICH WAS HELD ON THE 14TH DAY OF MAY, 1974, AND ORDERING A RUN-OFF ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 28TH DAY OF MAY, 19743 TO DETERMINE WHO SHALL BE COUNCILMAN IN WARD II; NAMING THE PLACES WHERE SAID ELECTION SHALL BE HELD; APPOINTING OFFICERS TO PRESIDE OVER SAID ELECTION; PROVIDING FOR THE FORM OF NOTICE THEREOF; PROVIDING FOR THE FORM OF BALLOT FOR USE IN SAID ELECTION; AND PROVIDING THE MANNER OF HOLD- ING SAID ELECTION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. That in accordance with the provisions of the City Charter of the City of Beaumont and the laws of the State of Texas relating thereto, there shall be held in the City of Beaumont on the 28th day of May, 1974, a run-off election for the purpose of electing an officer frr the office of Councilman from the 2nd Ward. Section 3. That legally qualified voters presiding within the corporate limits within the City of Beaumont shall be entitled to a vote at said election. Section 4. That said election shall be held in the City of Beaumont at the following places and the following named persons are appointed presid- ing judges and alternates for their respective voting boxes, with the authority to select and appoint their own clerks, to -wit: (See Exhibit "A") The presiding judge for each election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper conduct of the election, provided that not more than a total of five clerks shall be appointed for any precinct, who shall be selected from different political parties when practicable. Section 5. That said election shall be held under, and the qualifications of those voting thereat, shall be controlled by, the provisions of the State Laws governing elections. Section, 6. Notice of said election shall be given by publishing this ordi- nance in a newspaper of general circulation inthis citylone time, not more than twenty-five (25) days nor less than ten (10) days before said election. Section '7. The form of ballot which shall be'used in said General Municipal -3- Election shall be substantially as follows: GENERAL ELECTION CITY OF BEAUMONT JEFFERSON COUNTY, TEXAS ,MAY 28, 1974 FOR COUNCILMAN WARD IT (Vote for One) Section 8. In accordance with the provisions of the laws of the State of Texas, Myrtle Corgey is hereby appointed Presiding Judge of the Central Counting Station and Tom Lawrence is hereby appointed Manager of said Central Counting Station. Section 9. That in accordance with the provisions of the laws of the State of Texas, an electronic voting system shall be used for voting on,the day of election and also for the casting of absentee votes by personal appearance at the City Clerk's office. In accordance with the provi- sions of the laws of the State of Texas, absentee votes by mail shall be counted by a special canvassing board, which shall be composed of Hardy D. Akin, Charles R. Dollinger, Jr. and Roy Gibbs. Hardy D. Akin is hereby appointed Presiding Judge of said Special Canvassing Board and Charles R. Dollinger, Jr. and Roy Gibbs are hereby appointed as Clerks. Section '10. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held invalid, such invalidity shall in no way affect the remaining portions of this ordinance and to such end the various portions and provisions of this ordinance are declared to be severable. -Section 11.
