ENTITLED AN ORDINANCE SUSPENDING THE
OPERATION OF' PROPOSED RATE SCHEDULES
OF ENTER, INC . ; CALLING A PUBLIC
HEARING THEREON; AUTHORIZING
EMPLOYMENT AND PAYMENT OF
CONSULTANTS; ASSESSING THE EXPENSES
THEREOF AGAINST ENTER, INC ; AND
PROVIDING FOR SEVERABILITY.
WHEREAS, on December 7 , 1982 , Entex, Inc . filed its
Statement of Intent to change rates for natural gas service to
residential and small commercial customers within the City of
Beaumont effective January 11 , 1983 ; and,
WHEREAS, the proposed rate increase will generate
additional annual revenues to Entex in Beaumont of approximately
$656 ,448; and,
WHEREAS, in order to study thoroughly the proposed
change, the City Council believes that additional time is required
beyond the proposed effective date of the change;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1 .
That, pending hearing and decision by the City Council ,
the effective date of the proposed change in the rates of Entex,
Inc. within the City of Beaumont, is hereby suspended for a period
of 120 days from and after January 11 , 1983 .
Section 2 .
That the City Council shall hold a public hearing on the
proposed rate change at 1 : 15 p.m. , Tuesday , February 15 , 1983 , in
the City Council Chambers, City Hall , Beaumont, Texas.
Section 3 .
That the City Attorney is authorized and directed to
employ the firm of Touche, Ross & Company to review the proposed
rate increase and to pay said firm for its services an amount not
to exceed $25 ,000.
Section 4 .
That the costs of consultant services and all other
expenses incurred by the City of Beaumont in connection with the
review of the proposed rate increase are assessed against Entex,
Inc . pursuant to Section 24 of the Public Utility Regulatory Act,
TEX.CIV.STAT.ANN. art. 1446c .
Section 5 .
That the City Clerk is hereby directed to serve a
certified copy of this ordinance upon the local manager of Entex,
Inc.
Section 6 .
That if any section, subsection, sentence, phrase or
clause of this ordinance, or the application of same to a
particular set of persons or circumstances, should for any reason
be held to be invalid , such invalidity shall not affect the
remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be
severable.
