HomeMy WebLinkAboutORD 80-01 ORDINANCE NO.-.q)-J ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING A 0. 885 ACRE TRACT OUT OF THE JAMES VEATCH SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-2 TO C-2; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 30-4 thereof, is hereby amended by changing the zoning classification of a tract of land described in Exhibit "A" and attached hereto and made a part hereof, presently zoned R-2 (Two Family and Multiple Dwelling) to C-2 (Control Commercial) , and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended. Section 3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. Any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. "01 of Mayor - EXHIBIT "A" A PORTION QF 31JOCK 14, SPINDLETOP HEIGHTS ADDITION BEAU-MONT, TEXAS BEING a 0.885 acre tract of land out of the southwest portion of Block 14, Spindletop Heights Addition, James Veatch Survey, Beaumont, Jefferson County, Texas, plat of said Spindletop Heights Addition being recorded in Volume 1, Page 27, Map Records, Jefferson County, Texas, the said 0.885 acre tract of land being that certain 1.00 acre tract as conveyed by A. K. Johnson to L. Burleigh as recorded in Volume 309, Page 27, Deed Records, Jefferson County, Texas, SAVE & EXCEPT that portion of said 1.00 acre tract heretofore conveyed to the State of Texas for highway purposes as recorded in Volume 457, Page 338, Deed Records, Jefferson County, Texas, the said 0.885 acre tract of land being described by metes and bounds as follows: BEGINNING at an iron pipe which marks the intersection of the east right- of-way line of the Old Port Arthur Road and the north right-of-way line of Spindletop Road, and for the purposes of this description, the direction of the Old Port Arthur Road is considered to be north and south, the Old Port Arthur Road being a southward extension of Railroad Avenue; THENCE North 450 15' 16" East along the north right-of-way line of Spindletop Road and the south line of said Block 14 a distance. of 265.60' to a pipe for corner at the southeast corner of the Burleigh 1.00 acre tract; THENCE North 380 27' 07" West along the east line of the said Burleigh 1.00 acre tract a distance of 146.31' to a 3" metal post 4' high for corner, at the northeast corner of the said Burleigh 1.00 acre tract; THENCE South 440 48' 51" West along the north line of the said Burleigh 1.00 acre tract a distance of 133.01' to a pipe for corner at an angle point; THENCE South 450 11' 01" West continuing along the north line of the said Burleigh 1.00 acre tract a distance of 134.01' to an iron rod for corner in the east line of the aforementioned tract of land heretofore conveyed to the Texas Highway Department, said corner being in the east right-of-sway line of the Old Port Arthur Road; THENCE South 380 57' 13" East along the east line of the said highway tract and along the east line of the Old Port Arthur Road a distance of 145.00' to the place of beginning.
