I hereby certify, in the performance of the functions of my office, that the attached
instrument is a full, true, and correct copy of the City of Beaumont Ordinance No. 25 T, passed
by the City Council on December 28, 1948, as the same appears of record in my office and that
said document is an official record from the public office of the City Clerk of the City of Beaumont,
Jefferson County, State of Texas, and is kept in said office.
I further certify that I, Susan Henderson, am the City Clerk, of the City of Beaumont, that
I have legal custody of said record, and that I am a lawful possessor and keeper and have legal
custody of the records in said office.

AN ORDINANCE
AN ORDINANCE AUTHORIZING THE VACAT114G AND ABANDON-
ING OF AN ALLEY IN BLOCK ELEVEN (11) OF THE OAKS
ADDITION TO THE CITY OF BEAUMONT, RESERVING, HOW-
EVER, THE RIGHT OF THE CITY OF BEAUMONT TO CONSTRUCT
AND MAINTAIN IN SAID ALLEY 3LIVE,; LINES, WATER LINES,
AND OTHER UTILITIES, AND RESERVING THE RIGHT OF THE
CITY OF BEAUMONT TO GRANT A FRANCHISE RIGHT TO
OTHERS TO CONSTRUCT AND MAINTAIN THE UTILITIES HERE-
INBF.FORE MENTIONED THROUQH AND ALONG SAID ALLEY, AND
PROHIBITING THE OBSTRUC ION OF SAME BY ANY BUILDING
OR STRUCTURE.
WHEREAS, a petition signed by all the
property owners of
the lots in Block Eleven (11) of the Oaks Addition to The City
of Beaumont has been presented to the City Council of The City
of Beaumont, requesting that the alley running through Block
Eleven (11)'of said Addition be vacated and abandoned; and
`'WHEREAS, said petition has been referred to the City Plan-
ning Commission for examination and approval and the same has been

5 . approved by the said Commission; and,
WHEREAS, said petition has been duly canvassed and examined
by the City Council and has been found to have been signed by all
the property owners in said Block, and it appearing to the City
Council that the request of said property owners should be granted

:¢ and that an ordinance should bo enacted vacati; g and abandoning
Said alley,;reserving, however, to The City of Beaumont the right
to construct and maintain all necessary public utilities in said
alley onto grant a franchise for the construction and maintenance
of such utilities in said alley;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT:
That the, alley running through Block }.leven (11) of the Oaks Addi-
tion to The City of Beaumont, Texas, he+and; the same is hereby

phone, telegraph or electric lines, wires, poles and cables, or

abandonment of said alley affect the right of The City of Beau-
mont.to grant a franchise to any person, firm or corporation
authorizing the placing and maintaining in said alley of such
Sewer, gas or water lines, telephone, telegraph or electric lines,
or other public utility service, all of which rights are hereby
expressly reserved; and the vacating and abandonment of said alley
ahall not be construed as authorizing or permitting any person,
.party corporation or legal entity whatsoever to erect, construct,
