Getz,Ward II Audwin Samuel,Ward III June 18, 2013 Jamie Smith,Ward IV Tyrone E.Cooper,City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on June 18, 2013, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Reverend James Blackwell of South Park Baptist Church gave the invocation. Mayor Pro Tern Wright led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Wright, Councilmembers Coleman, Getz, Pate and Smith. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Councilmember Samuel was out of the City on business. None CONSENT AGENDA Approval of minutes - June 11, 2013 Confirmation of committee appointments — None Approve a resolution approving a change order to the contract with Brystar Contracting, Inc., related to the Wastewater Treatment Plant Holding Pond Project and Dredging of Ponds 1 and 2 Projects — Resolution 13 — 129 Councilmember Smith made a motion to approve the Consent Agenda. Mayor Pro Tern Wright seconded the motion. Minutes—June 18,2013 AYES: MAYOR AMES, MAYOR PRO TEM WRIGHT, COUNCILMEMBERS COLEMAN, GETZ, PATE AND SMITH NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider an ordinance amending Section 2.03.074 of the Code of Ordinances to increase the number of Grade V (Deputy Chief) positions from 3 to 5, Grade III (Captain) positions from 46 to 47, and to reduce the number of Grade IV (District Chief) positions from 12 to 11 and Grade II (Driver/Operator) positions from 72 to 70. Chief Huff is developing leaders within the executive ranks of the Fire Department and believes this change will further enhance the management structure and overall effectiveness of the department. The restructuring also serves to further institutionalize the National Incident Management System (NIMS), in keeping with City policy. The overall number of authorized positions will remain at 234. The additional cost will be approximately $33,000 per year. General Fund. Approval of ordinance. COuncilmember Smith moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 2.03.074 OF THE CODE OF ORDINANCES BY INCREASING THE NUMBER OF GRADE V DEPUTY CHIEF POSITIONS IN THE BEAUMONT FIRE DEPARTMENT FROM THREE (3) TO FIVE (5), INCREASING THE NUMBER OF GRADE III CAPTAIN POSITIONS IN THE BEAUMONT FIRE DEPARTMENT FROM FORTY-SIX (46) TO FORTY-SEVEN (47), DECREASING THE NUMBER OF GRADE IV DISTRICT CHIEF POSITIONS IN THE BEAUMONT FIRE DEPARTMENT FROM TWELVE (12)TO ELEVEN (11)AND DECREASING THE NUMBER OF GRADE II DRIVER/OPERATOR POSITIONS IN THE BEAUMONT FIRE DEPARTMENT FROM SEVENTY-TWO (72) TO SEVENTY (70); PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. Consider an ordinance declaring certain structures to be dangerous structures and ordering their removal within 10 days or authorizing the property owner to enroll the dangerous structure in a work program. These structures have been inspected by the Building Codes Division and found to be unsafe structures as defined by the City of Beaumont's Code of Ordinances, Chapter 24, Article 24.04 Unsafe Substandard Structures, Division 1, Sec. 14.04.001 of the 2009 International Property Maintenance Code. Additionally, these structures have deteriorated to a condition that they are no longer considered suitable for repair. City may incur the cost of demolition. Sources may include General funds and Community Development Block Grant (CDBG) funding. Administration recommends approval. COUncilmember Coleman moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AS WELL AS TO ALLOW PROPERTY OWNERS OF ITEMS#4, 10,17,22,30,39,56,31 AND 32,TO ENTER INTO A 150 DAY WORK PROGRAM ON THE DANGEROUS STRUCTURES LIST,ITEMS#45 AND 54 WERE REMOVED; PROVIDING FOR SEVERABILITY AND PROVIDING A PENALTY. COUNCILMEMBER GETZ- STATED THERE WAS A GREAT TURN OUT AT THE DOWLEN/WEST NEIGHBORHOOD ASSOCIATION, THE NEIGHBORHOOD ASSOCIATIONS ARE THRIVING,IT'S A GREAT WAY FOR CITIZENS TO MEET WITH THEIR COUNCILMEMBERS AS WELL AS REPRESENTATIVES FROM THE CITY AND POLICE DEPARTMENT, ALSO ANNOUNCED THE 4TH OF JULY PICNIC THAT WILL BE HELD FROM 4:00 P.M.TO 6:00 P.M.,AT LDS CHURCH ON WEAVER ST., EVERYONE IS WELCOMED TO ATTEND COUNCILMEMBER COLEMAN - STATED THAT HE WAS INVITED BY KENYA WIDOWS AND ORPHANS MINISTRY OUT OF MIDLAND, TX., TO GO TO KENYA TO PROVIDE DENTAL AND MEDICAL CARE,ALSO THIS WEEK CLEAR LAKE UNITED METHODIST CHURCH HAS 94 HIGH SCHOOL KIDS AND ADULTS HERE IN BEAUMONT STAYING AT WESLEY UNITED METHODIST CHURCH, THEY ARE HELPING BUILD RAMPS AND PAINTING HOUSES FOR OUR PERSONS IN NEED, THANKED THEM FOR COMING OVER AND HELPING, ALSO KIDS FROM BEAUMONT WENT TO THE HOUSTON AREA TO HELP PERSONS IN NEED AS WELL CITY ATTORNEY COOPER- NONE CITY MANAGER HAYES - NONE MAYOR AMES- NONE Public Comments (Persons are limited to three minutes) Tyrone Thompson P.O. Box 1011 Beaumont TX Spoke to Council regarding job seekers who are not computer illiterate, stated help is needed Monday through Friday, suggested that the City do something to offer computer classes to help those that are not computer illiterate, asked that the class not just be an ordinary computer class but one that offers help when it concerns applying for jobs online since most businesses are requiring persons to apply online Wilma Martin 1290 Harriot St. Beaumont TX Spoke to Council in regards to her home at 1290 Harriot St., asked that Council not demolish her home, stated her home did not have much damage there is only damage to her bathroom, the rest of her home is still in good condition Minutes—June 18,2013 EXECUTIVE SESSION - CANCELLED Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Triad Transport, Inc.
