Cooper, City Attorney Kyle Hayes,City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on May 21,2013, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items on Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor James Fuller of Calder Baptist Church gave the invocation. Aurora Williams, granddaughter of Councilmember Wright led the Pledge of Allegiance. Roil call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Coleman, Councilmembers Getz, Wright, Pate, Samuel and Smith. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. ELECTION OF MAYOR AND COUNCILMEMIBERS GENERAL BUSINESS 1. Council consider approval of an ordinance canvassing the results of the May 11,2013, City General Election. The Election Code, Section 67.003, states that each local canvassing authority shall convene to conduct the local canvass at the time set by the canvassing authority's presiding officer not earlier than the eight day or later than the eleventh day after Election Day. Council shall meet and canvass the returns and officially declare the results. Election officials will be sworn in and take office in their respective positions. Approval of Ordinance Councilmember Smith moved to ADOPT AN ORDINANCE ENTITLED AN ORDNANCE CANVASSING THE RETURNS OF THE GENERAL ELECTION HELD IN THE CITY OF BEAUMONT ON THE 11'DAY OF MAY,2013,FOR THE PURPOSE OF ELECTING A MAYOR,FOUR(+4)WARD COUNTERS(WARDS I, 11, 111 AND IV) AND TWO COUNCILMEMSER8 AT-LARGE; AND PROVIDING FOR SEVERASILrTY. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE,SAMUEL AND SMITH Minutes—May 21,2013 NAYS: NONE MOTION PASSED Ordinance 13 - 028 Judge Craig Lively, Chief Magistrate, Beaumont Municipal Court administered the Oath of Office Council recessed at- 1:47 p.m. Council reconvened at - 2:07 p.m. Proclamations, Presentations, Recognitions "Hurricane Awareness Week" - May 26, 2013 through June 1, 2013-Proclamation read by Councilmember Samuel; accepted by Tim Ocnascheck, Emergency Management Coordinator and Officer Carol Riley "American Cancer Society Day"—May 22,2013—Proclamation read by Councilmember Smith; accepted by Tammy Droste, Community Manager of Health Initiatives High Plains Division and other members of the American Cancer Society "EMS Week" — May 19 — 25, 2013 — Proclamation read by Mayor Ames; accepted by Sherry Ulmer and the City of Beaumont EMS paramedics Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. None CONSENT AGENDA Approval of minutes - May 14, 2013 Confirmation of committee appointments - None A) Approve a resolution transferring a solid waste franchise from IESI TX Corporation to Progressive Waste Solutions of TX, Inc. — Resolution 13 - 114 B) Approve a resolution authorizing the granting of a Utility Crossing Agreement- Resolution 13 - 115 C) Approve a resolution authorizing the granting of a Pipeline License Agreement— Resolution 13 - 116 Mayor Pro Tern Coleman made a motion to approve the Consent Agenda. Councilmember Wright seconded the motion. MAYOR PRO TEM COLEMAN- CONGRATULATED HIS FELLOW COUNCILMEMSERS AS WELL AS THE MAYOR ON THEIR RE-ELECTION,MENTIONED STEVE RICHARDSON, THE PLANNING SECRETARY WHO WILL BE RETIRING, HE ATTENDED HIS LAST PLANNING AND ZONING MEETING ON YESTERDAY, THE CHILDREN'S MUSEUM GALA WAS A SUCCESS ON LAST WEEK, ALSO BAPTIST HOSPITAL HAD A RIBBON CUTTING FOR A NEW PEDIATRIC EMERGENCY ROOM, ANNOUNCED THE MOONLIGHT BICYCLE MADNESS THIS FRIDAY AT ROGERS PARK, REGISTRATION WILL BE FROM 7:OOP.M. TO 9:OOP.M., RIDING WILL START AT 10:00P.M. CITY ATTORNEY COOPER- NONE CITY MANAGER HAYES- NONE MAYOR AMES- CONGRATULATED ALL OF HER FELLOW COUNCILMEMBERS, TOLD THEM THAT SHE LOOKS FORWARD TO WORKING WITH THEM FOR THE NEXT TWO YEARS, ALSO THANKED ALL THE VOTERS FOR THEIR OVER SUPPORT,SHE SHARED A LETTER SHE RECEIVED FROM A CITIZEN REGARDING HER AND THE COUNCIL FOR ALL THAT THEY DO FOR THE CITY Minutes-May 21,2013 Public Comments (Persons are limited to three minutes) Vernon Durden 2110 Westbury Beaumont TX Congratulated Council on their re-election,commented on the Police Department and what a great job they are doing, would like to see the city do something about the slabbing, thinks that Council will get a lot of support for this, a slabbing ordinance should be on the line of no shirt, no shoes, no service, the businesses as well as the public will certainly support this Open session of meeting recessed at 2:55 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: J.A.I.
