HomeMy WebLinkAboutRES 13-075RESOLUTION NO.13 -075 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be and he is hereby authorized to grant a Utility Crossing Agreement to Crosstex NGL Pipeline, LP, substantially in the form attached hereto as Exhibit "A," to install a twelve inch (12 ") pipeline which will cross one (1) eight inch (8 ") sanitary sewer force main located near Club Oaks Road, one (1) four inch (4 ") sanitary sewer force main on Tolivar Canal Road and crossing Bunns Canal belonging to the City of Beaumont for the purpose of transporting natural gas, said pipeline is to be constructed in compliance with City requirements. 2013. HDD approach to pipeline construction has no surface impacts between the entry and exit points of a pipeline drill. Crosstex employs the HDD method of pipeline construction in the sensitive areas, such as wetlands, waterways, forested preserves, historical preservation sites, and other areas as may be designed by a jurisdictional federal, state, and/or local authority. The HDD technology uses bentonite slurry, a fine clay material as a drilling lubricant. An inadvertent return of a drilling lubricant to the surface, referred to as "frac -out', is a potential concern for HDD method of construction. While the bentonite is non -toxic and commonly used in farming practices, its fine constituents may pose a suffocating effect on aquatic plants and fish when accidently discharged into a waterway. The primary areas of concern for Frac -outs are at the entrance and exit points where the drilling equipment is at depths of 12 to 20 feet. The likelihood of a frac -out decreases as the depth of the pipe HDD increases. In addition to a visual observation, lowered pressure reading on the drilling equipment will be treated as an indicator of a potential frac -out. The purpose of this Frac -out Contingency Plan is to: ❑ Minimize potential for a HDD frac -out ❑ Provide for timely detection of frac -outs ❑ Provide for immediate notification and mobilization of appropriate response resources in case of a frac -out ❑ Provide for proper documentation of the incident and its response The following measures will be implemented to minimize potential for frac -out: 1. The drilling entry and exit sites will be foot - surveyed to confirm that there are no cultural and /or biological sensitive resources present on the surface 2. Each entry and exit site will be marked appropriately so their boundaries can be easily seen by a working crew 3. Barriers (e.g., straw bales or sedimentation fences) will be erected between the bore site and nearby sensitive resources prior to drilling, as appropriate, to prevent released material from reaching the resource A Frac -Out Contingency Plan Horizontal Directional Drill, Pipeline Construction Activities A CROSSTEX 4. Access and egress locations will be designated and clearly marked 5. Working crews will be briefed on the proximity of sensitive habitats to the working area, as appropriate 6. Necessary response equipment and/or third -party resources will be made available at a construction site or at a readily accessible locations 7. Response equipment will be maintained in sufficient quantities and in good working order at all times 8. All members of working crews will be instructed to notify of a suspected frac- out immediately 9. The immediate notification will be directed to the Crosstex - appointed construction inspector available onsite 10. Crosstex - appointed construction inspector* will make immediate notification to Crosstex Operations Control Center (OCC) to report a suspected frac -out OCC: 1- 866 - 394 -9839 *Anyone working for Crosstex and /or on a Crosstex site is authorized to call OCC to report an incident. The following measures will be taken in response to a frac -out: 1. Stop HDD work immediately, including the recycling of drilling mud/lubricant to prevent further discharge of drilling mud into the sensitive area 2. Determine the location of the frac -out by using a GPS or other type of geographic location pointer 3. Notify Company Inspector or Representative immediately 4. Inspector will call OCC to report a "Frac -out" incident 5. OCC will send an immediate alert (MIR3) notification to a pre-determined response group (Environmental, Safety, DOT Regulatory, Engineering, etc. departments) 6. Crosstex Environmental representative will make the notifications to agencies having the jurisdiction over the area where the frac -out occurred (contact numbers provided at the end of this document) 7. Determine the extent of the frac -out (estimated quantity discharged, approximate area impacted) B. If the frac -out is terrestrial, isolate the area with hay bales, sand bags, or silt fencing surrounding and containing the drilling mud 9. Depending on a landowner's preferences and /or instructions from the Jurisdictional ♦ Frac -out Contingency Plan IV Horizontal Directional Drill, Pipeline Construction Activities CROSSTEX authority the discharged drilling mud may have to be removed from the affected area or left in place. Ensure that clear instruction is received from the Crosstex Environmental Department prior to making the final decision. 10. Once the excess drilling mud is removed, the area may be re- seeded and/or replanted, as appropriate, or allowed to re -grow from the existing vegetation 11. The affected area will be inspected to ensure that new vegetative cover is successfully re- established 12. If the frac -out is aguatic/wedands. ensure that USACOE has been notified within 24 hours 13. Monitor the frac -out for 4 hours to determine if the drilling mud congeals (bentonite will usually harden, effectively sealing the frac -out location) 14. Upon consent of the landowner and USACOE, if the drilling mud congeals, take no other action that would potentially suspend sediments in the water column 15. If drilling mud does not congeal, erect isolation/containment structures to constrain the mobility of the mud. Third -party contactor may be called upon to remove the discharged mud 16. The HDD work may resume after the frac -out area has been secured and no further discharges of drilling mud are expected or possible. The following steps will be taken to close out the frac -out incident: 1. After frac -out is stabilized and any required removal is completed, document post - cleanup conditions with photographs 2. Prepare frac -out incident report describing time, place, actions taken to remediate the affected area 3. Record the measures taken to prevent recurrence of such incidents 4.
