Darran Dollarhide is the owner of record of the structure. The request from Mr. Dollarhide was submitted to all city departments and utility companies with one objection from Planning and Zoning. The Planning Manager would approve the License to Encroach Agreement only if the Board of Adjustment were to approve the variances to the side and rear building setbacks. The original building plans were approved for a one story building outside of the easement. However a two story building that encroaches into the easement was constructed. At the City Council meeting on January 29, 2013, City Council tabled action on the license to encroach until after the Board of Adjustment considered the setback variances. On March 7, 2013, the Board of Adjustment denied Mr. Dollarhide's variance request as submitted after Mr. Dollarhide stated that he was going to remove the second floor of the structure. The removal of second floor makes the need for any variances unnecessary. However, Mr. Dollarhide would still like to encroach into the 10 foot wide utility easement along the rear of his property. If the license to encroach is approved, the accessory structure would-be setback from the rear property line a distance of 7.84 feet. The License Agreement protects the City from liability and provides a thirty(30) day cancellation clause. FUNDING SOURCE There is a one time non-refundable fee of$500 from Darran Dollarhide for the License to Encroach. RECOMMENDATION Approval of resolution. RESOLUTION NO. WHEREAS, Darran Dollarhide has requested that the City of Beaumont grant a License to Encroach into one (1) utility easement at 1030 21St Street, which is described as being out of Lot 16, Block 19, Calder Place Addition, to the City of Beaumont. The encroachment being an existing structure overlapping 2.03' to 2.16' into the 10' utility easement, as described in Exhibit"A"and shown in Exhibit"B,"attached hereto and made a part hereof for all purposes; and, WHEREAS, City staff has expended considerable time and effort in investigating the effect of such encroachment upon the City easement and utilities therein; and, WHEREAS, it appears that it would be equitable to allow such encroachment at this time; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the City Manager be and he is hereby authorized to execute a License to Encroach to Darran Dollarhide to encroach into one(1)utility easement at 1030 21St Street, which is described as being out of Lot 16, Block 19, Calder Place Addition, to the City of Beaumont. The encroachment being an existing structure overlapping 2.03' to 2.16' into the 10' utility easement, as described in Exhibit "A" and shown in Exhibit "B," attached hereto and made a part hereof for all purposes for a one-time fee of Five Hundred Dollars ($500.00) for the License to Encroach. Substantial improvements shall not be made upon any encroachment without first obtaining the written consent of Licensor and giving notice to Licensor in writing of how,when and to what extent such improvements are to be made. A copy of this license shall be attached to such notice. Substantial improvement means any repair, construction,or improvement of a structure, the cost of which equals or exceeds twenty-five percent(25%) of the market value of the structure either: (1)before the improvement or repair is started;or (2)if the structure has been damaged and is being restored,before the damage occurred. For the purposes of this definition, "substantial improvement" is considered to occur when the first alteration of any portion of the structure commences,whether or not that alteration affects the external dimensions of the structure. The term does not,however, include any projects or improvements of a structure to comply with existing state or local health, sanitary, or safety code specifications which are solely necessary to protect the health, safety and welfare of the public, inhabitants, or users of such structure. Paget of 3 EXHIBIT "A" In the event the City of Beaumont,by resolution of the City Council, determines it needs the subject property, or any part thereof, for the benefit of the City or to protect the health, safety or welfare of the public, and it terminates this license or any part thereof, Licensee shall not receive any compensation and the City of Beaumont shall not be liable therefore, whether for the value of property taken, damage to the abutting or remaining property or improvement, loss of business or profit, loss of access, or otherwise. Licensee shall at all times indemnify and hold harmless Licensor and any franchised entity of licensor against, and pay in full, for all claims, losses,damages, law suits, attorney's fees, costs,judgements or expenses, that Licensor and any franchised entity of Licensor may sustain, incur,be required to pay or become liable for, resulting in any manner from the construction,maintenance,use, state of repair, or presence of such encroaching structure. Licensor, and any franchised entity of Licensor,reserves the right to make improvements,perform maintenance and construction to the right-of-way or premises covered by this license where such is deemed necessary for the health,welfare and safety of the community. In doing so, Licensor and any franchised entity of Licensor shall not be liable to Licensee for any damage occasioned thereby and Licensee shall not be entitled to prosecute or maintain a claim against such parties for any such damage sustained by Licensee to said encroaching structure or any abutting or attached structures, improvements or land caused by the removal or alteration of any encroachment. In addition, Licensee shall reimburse Licensor and any franchised entity of Licensor any additional costs resulting from the encroachment. Licensee shall not permit trees, shrubs,plants, or any object to be placed on the subject property in such a manner as to obstruct the view of traffic. As part of the consideration for this agreement, Licensee shall pay to Licensor the sum of Five Hundred Dollars ($500.00). Said sum being non-refundable. This license shall be recorded in the Real Property Records in the Office of the County Clerk of Jefferson County, Texas by Licensor. This agreement is terminable by either party by giving written notice to the other specifying the date of termination. Said notice shall be given not less than thirty(30) days prior to the termination date, therein specified, and shall be recorded in the Real Property Records in the Office of the County Clerk of Jefferson County, Texas by Licensor. This license is neither assignable nor transferable except in conjunction with, and as part of, Licensee's conveyance of all the abutting property this license serves,through probate or warranty deed or lease. In any such event, Licensor shall be notified of such occurrence by being delivered a copy of the document or documents conveying or leasing the same. RECOMMENDATION Administration recommends approval of a resolution authorizing the City Manager to execute an agreement with Workforce Solutions Southeast Texas to provide the City of Beaumont with temporary workers and provide on the job opportunities to clients of Workforce Solutions Southeast Texas. BACKGROUND Workforce Solutions Southeast Texas is offering the City of Beaumont an opportunity through its Paid Workers Experience/Unpaid Worker Experience program to employ temporary workers to assist with job duties currently being performed by full-time employees or to handle duties that would require the hiring of additional staff. These job assignments will also provide training for these temporary workers that will equip them for full-time employment. Workforce Solutions Southeast Texas will be compensating these employees with funds received through the Workforce Investment Act. There will be no out-of-pocket expense to the City of Beaumont. This program is expected to end September 30, 2013 unless otherwise noted. BUDGETARYIMPACT None. The Worksite agrees to: • Provide meaningful work experience and adequate supervision at all times; • Provide safe working conditions; • Assure that the placement of the participant on the worksite does not result in the displacement of any currently employed worker(including partial displacement such as reduction in the hours of non-overtime work,wages,or employment benefits); • Insure that the work of participants is performed within the Child Labor Laws if participants are under the age of 18; • Promptly report to the Workforce Solutions Southeast Texas/Power Zone-Beaumont any injuries sustained by participants while on the worksite; BSU 001 Page 1 0212008 • Maintain appropriate records;submit time sheets and other pertinent information as necessary; • Cooperate fully with the Workforce Solutions Southeast Texas/Power Zone-Beaumont Representative assigned to the Worksite in respect to resolve any conflicts that may arise; • Assure that all work performed by participants is within the scope of their written training outline; • Assure that participants will not be paid for any holidays, sick leave,or time off,or for time not worked; • Assure that sufficient work is available to occupy the participants during work hours; • Assure that the worksite will have sufficient equipment and/or materials to do the job, • Notify the Workforce Solutions Southeast Texas/power Zone-Beaumont immediately if the Worksite no longer desires to work with a client; • Assure that each participant must sign their time sheets; • Assure that each participant will receive at least one break daily for a six(6)hour day; • Comply fully with the Nondiscrimination and Equal Oppdrtunity provisions of the Workforce investment Act (WIA) of 1998, the Nontraditional Employment for Women Act of 1991; the Disabilities Act of 1990; Title VI of the Civil Rights Act of 1964, as amended; Section 504 of the Rehabilitation Act of 1973, as amended; the Drug-Free Workplace Act of 1998 and with all applicable requirements imposed by or pursuant to regulations implementing those laws; • Assures that the business,branch,division or department of the business does not and will not knowingly employ an undocumented worker as defined in Texas Government Code, 2264.001(4 and • Provide each supervisor involved with the Work Experience program with a copy of this agreement and : all applicable attachments. H. Workforce Solutions Southeast Texas/Power Zone-Beaumont agrees to: • Process employees time sheets for payment(if applicable); • Prepare and issue checks for participants(if applicable); • Ensure Workmen's Compensation Insurance is provided to participants; • 'Provide necessary technical assistance to insure compliance with this agreement; • Provide counseling and other related services on an as needed basis to participants;and • Place and/or remove employees from the Worksite upon consultation with the Worksite Supervisor. III. This agreement can be terminated for any of the following reasons: • A 30 day written request by either the Workforce Solutions Southeast Texas/Power Zone-Beaumont or the Worksite Representative; • Failure to comply with the terms of this agreement by either party; • Failure to take corrective action;or ; • Unsafe or unsanitary working conditions. . BACKGROUND The State of Texas Statewide Communications Interoperability Plan(SCIP), adopted by the Governor's Office on November 26, 2007 and approved by the U.S. Department of Homeland Security on April 4, 2008 requires Texas agencies to be fully"Project 25 compliant(P25)by January 1, 2015. Project 25 implements a digital "suite of standards" for radio systems that ensures any P25 radio can talk to any P25 radio system regardless of manufacturer. Our current system is not capable of P25 compliance and will require upgrades to meet the new standard. We have been working towards compliance for several years and have a plan in place to attain compliance by the January 1, 2015 deadline. While in the past,the Homeland Security Grant Program, Port Security Grants, and other Communication grants have been the primary funding source, Federal and State budgets are now tightening up and grant program resources continue to get smaller and smaller. Dedicating $30,700,000 annually to the 2011 Texas Enacted House Bill 442 for public safety communications would help agencies across Texas work towards the goal of P25 compliance by 2015. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of resolution. RESOLUTION NO. WHEREAS, more than 5,800 fire, police, emergency management and emergency medical service agencies respond daily to emergency and life threatening incidents throughout Texas; and, WHEREAS, the ability for public safety agencies from various jurisdictions in the counties, region and the state to communicate expediently can mean the difference between life and death—for citizens and/or First Responders; and, WHEREAS, House Bill 442 acknowledged the critical need for public safety communications in Texas by establishing a fund dedicated to sustaining and furthering the interoperable communications strides made in Texas; and, WHEREAS,dedicating$30,700,000 annuallytothe 2011 Texas Enacted House Bill 442 for public safety communications will make for a safer Texas—for our citizens and the First Responders responsible for protecting them; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the City of Beaumont is in support of the State of Texas dedicating $30,700,000 annually to the 2011 Texas Enacted House Bill 422 for public safety communications. Miz B's also provides supervision of home schooled children. The home school supervision will take place Monday through Thursday from 9 a.m. to noon, while the tutoring sessions will be from 4 p.m. to 9 p.m., Monday through Thursday. Impact on the adjacent properties is anticipated to be light, and is in keeping with the nature of the existing uses already in the area. There are seven parking spaces located on the property to accommodate employees. The students' parents typically drop off their children at the facility. The applicants have supplied written permission from the owner of the parking lots indicating that the use of his parking lots is acceptable. At a Joint Public Hearing held March 18, 2013, the Planning Commission recommended approval 9:0 of the specific use permit with the following condition: 1. BACKGROUND As a result of the Deepwater Horizon Incident,a$57 million fund,known as the Gulf Tourism and Seafood Promotional Fund was established to promote tourism and the seafood industries in the Gulf States. It is difficult to quantify the impact that the Deepwater Incident had on our area's seafood and tourism industries and the broader economy. However,because of our proximity to the Gulf and our location on the primary east-west gulf highway(Interstate 10),it would follow that Beaumont felt some degree of impact. The availability of the these development funds offers a unique opportunity ity to seek assistance to develop a plan to further enhance the public's access to our waterfront as well as other fishing, birding and recreational activities within tremendous natural areas along the Neches River. The grant application would seek up to$250,000 to fund a consultant to study and design enhancements for better access to these tremendous natural resources. FUNDING SOURCE Gulf Tourism and Seafood Promotional Fund. RECOMMENDATION Approval of the resolution. Gulf Tourism and Seafood Promotional Fund Purpose As part of the Settlement Agreement, a$57 million fund,the Gulf Tourism and Seafood Promotional Fund("Promotional Fund"), has been established to promote tourism and the seafood industries in Gulf Coast areas impacted by the Deepwater Horizon Incident. In particular,one of the primary purposes of this Promotional Fund is for the support of programs directed to advertising,promotion and/or marketing which supports Gulf tourism and the seafood industries. In 2012,the first round of grants was presented. The amount available for the final round of promotional grants is$12,764,370. Administration of the Fund The Promotional Fund is administered and directed by the Claims Administrator, Patrick A.Juneau.Applications for Promotional Fund Awards shall be considered by a three- person panel,consisting of the Claims Administrator or his designee,a designee of Lead Class Counsel, and a designee of the BP Parties. Spindletop MHMR was awarded an 811 grant in the amount of$1,521,200 from the Department of Housing and Urban Development for this project, estimated to cost$2,085,133. With Spindletop's match of$200,000,the provision of$363,211 in HOME funds would substantially fill this funding gap,making the project viable. Although this grant would use most of the HOME funds for 2012,the only other request for these funds have come from developers of Low Income Housing Tax Credits(LIHTC)projects on Major Drive. One of these developers has withdrawn their application to the State and the other is located outside of the city limits. The reallocation of $53,000 from the 2011 Program Year to this project would come from unused funds budgeted for the Briarbend LIHTC project, located off of Concord. Background on Spindletop Center and Qualifications Since 1973, Spindletop Center has provided services and programs to individuals with chronic mental diseases,substance abuse disorders, intellectual development disabilities,or a combination of these disorders who live in the four-county catchment area of Chambers, Hardin,Jefferson,and Orange Counties, in Southeast Texas. In 2000,the former Life Resource and the former Beaumont State Center, each originally formed in 1973, consolidated all programs and staff to become the newly created organization Spindletop MHMR Services. In 2011, Spindletop MHMR Services assumed the name Spindletop Center. Spindletop Center is now the primary provider of services for low income and low- to-moderate income individuals in these counties. Spindletop promotes independence, self-advocacy, recovery,and enhanced quality of life of its target populations.Critical to the success of its vision, Spindletop Center provides an array of services to its consumers, including outpatient and residential support services. In FY 2011,the center was contacted by 10,960 persons who may have needed services and provided at least one face-to-face service to 6,303 of these consumers. The Center employs 427 staff, and the staff includes psychiatrists,psychologists, licensed professional counselors, licensed social workers,registered nurses,and marriage and family therapists. Of the staff, 56 are qualified mental health professionals(QMHP)who provide case management and rehabilitative services. These services include programs for assistance in transition from homelessness(PATH),mental health treatment, substance abuse treatment, clinical services and living skills programs, in-home family resource support,respite care, vocational services, emotional and behavioral youth services, and early childhood intervention for children with developmental delays or medical conditions likely to result in Flmring impair&A call a delay. During its nearly 40 years of service, Spindletop Center has also developed strong 1-800.735-2989(MD) working relationships with other community organizations and partners to provide services 1-800-735-2988(VOICE) to Spindletop Center's consumers and housing residents. Equal Entplayment Opportxniry AffirntativeAction Employcr Spindletop Center firmly believes that safe, affordable housing provides the foundation of success for individuals in the target populations who desire to achieve long term mental health recovery and stability. Because of its major role in the continued success of consumers,affordable community housing has become an important initiative for Spindletop Center. Within the Center's housing initiative, staff coordinate and provide services to residents, such as job training, fitness programs, medical support,as well as assistance with food, clothing, and transportation. Spindletop Center also currently owns and maintains 7 residential facilities for individuals with mental disorders and intellectual development disabilities. Two of the Center's housing facilities,The Studios at Spindletop(12-units)and The Courtyard at Spindletop(14- units),are available for consumers who are also eligible for housing in the newly planned Section 811 Spindletop Apartments. In conjunction with the Housing Authority of the City of Beaumont, Spindletop Center provides housing vouchers for consumers living in the Studios at Spindletop.The two existing Spindletop housing facilities are classified as transitional housing for residents for up to 18 or 24 months.The planned Section 811 apartments will have no time limit and will provide permanent housing for consumers who wish to establish long term housing stability in their lives. The construction of the Section 811 Spindletop Apartments is an important step in expanding the Spindletop Center's long term housing initiative. Description of Project, Why it is Important, What Spindletop Center Hopes to Achieve To advance its mission,the Spindletop Center applied for and secured funding from the U. S.Department of Housing &Urban Development under the Section 811 program to construct a 15-unit affordable housing community to house individuals who are homeless or at risk of becoming homeless and who have mental disabilities, substance abuse disorders, or a combination of these disorders. In February 2012, Spindletop Center was awarded$1,521,200 HUD Section 811 funds to construct 15 new one- bedroom apartments for consumers in Southeast Texas who are homeless,or at risk of becoming homeless, and who have a mental illness, an intellectual developmental disability disorder,a substance abuse disorder, or a combination of these disabilities. Of this amount, $278,500 must cover legal,geotechnical,topographical, land appraisal,cost analysis, filing, and architect fees. This leaves$1,242,700 to construct the apartments. HUD provided an additional,separate award of$149,100. These funds are not a part of the construction costs and must be used for 3-year rental subsidies,or vouchers for residents. The HUD funds represent 69%of the estimated final,total costs to complete the construction of this major addition to housing for disabled Southeast Texans. Since the announcement of the award of the funds, Spindletop Center and its experienced development team have been developing the architectural plans,negotiating contractor pricing, and seeking the additional funding necessary to make this project a reality. This project is important because it will provide affordable housing opportunities to Beaumont and Southeast Texas residents with serious mental disabilities or substance abuse disorders,whose income is at or below 50%of the median income("very-low income"). In Beaumont,the need for housing for this population is evident.According to the 2005 Consolidated Plan for the City of Beaumont,there are at least 200 people with mental illness and 500 people with alcohol or other addictions that are in need of supportive housing. There is currently only one 14-unit Section 811 housing facility in the City of Beaumont(Jefferson County). Compounding the shortage of available housing, Beaumont is located in an area where the housing stock was affected by recent disasters, including Hurricanes Rita and Ike. The majority of affordable housing that remains is unavailable due to long waiting lists. Even though most of the affordable rental communities may be a good option for some low-income individuals and families,unfortunately these facilities lack the adequate security and support needed by the Center's consumers. The new Section 811 housing project will offer more secure and supportive units for these individuals. The proposed project is comprised of five single-story residential buildings and one community building configured around a courtyard setting. Each of the 1-bedroom 1-bathroom units(the development includes 1 residential manager unit)is 540 square feet and has a private patio area.As shown in the attached unit floor plans,the interior design provides usable space with individual areas for living,eating, sleeping, and cooking. Each kitchen includes a refrigerator,range(with front controls),double sink,pantry, and sufficient cabinet space. The community building is comprised of an entry lobby with seating,the administrative office, a community room with party kitchen, and a laundry room. Communal green space is also an important aspect of this project. In addition to private patios in the units,the residential buildings will form an interior courtyard that will be landscaped to encourage residents to enjoy that space and to promote social interaction. The design for this housing and the incorporation of the supportive services are intended to facilitate the integration of the residents into the surrounding community and promote the ability of the residents to live as independently as possible. The proximity of the housing facility to the Beaumont Outpatient Clinic and to Spindletop's supportive housing staff will assist residents with rehabilitation and integration into the surrounding community. The site's proximity to several amenities will also foster independent living and the integration of the residents into the surrounding community. Description of the People Expected to Benefit and Ways in which They Will Benefit Eligible residents will be 18 years of age or older who qualify as disabled under the Section 811 HUD program and whose income is at or below 50%of the area's median income("very-low income).These individuals must also be able to live independently. This housing has been designed specifically to accommodate persons with severe and persistent mental illness or substance abuse disorders,and makes available the support services necessary for these individuals to become self- sufficient as they work to accomplish a personalized treatment plan. Residents in this housing development who meet the existing eligibility requirements for mental health treatment set by the Texas Department of State Health Services (DSHS)will be enrolled in Spindletop's mental health treatment program and will receive a complete assessment, including a medical assessment by a psychiatrist,medical medication management, and ongoing support. Spindletop Center housing staff will help residents establish and maintain a plan for self-sufficiency that will include work skills development,enrolling in education and training programs, and personal and family assessment and treatment. The housing site is conveniently located across the street from the Center's Beaumont Outpatient Mental Health Clinic that also provides an outpatient substance abuse treatment program. The specially-designed housing and the coordination of services offered to its residents will ensure that needs of the residents will be appropriately and holistically addressed. The project will also relieve residents of their high rental costs,which will free more of their personal funds for other life necessities, such as food,clothing, and medication. Expenditure Budget and How and When Requested Funds are to be Spent The total development costs are$1,806,633. The construction costs were determined by the project contractor based on architectural drawings and a round of value engineering to further reduce the cost of the project. Other costs included in the budget are based on either real project expenditures to date, or on well-researched estimates of what outstanding expenditures will be. Spindletop Center was awarded$1,521,200 HUD Section 811 funds to construct 15 new one-bedroom apartments for consumers with disabilities in Southeast Texas. Of this amount, $278,500 must cover legal,geotechnical, topographical, land appraisal,cost analysis,filing,and architect fees.This leaves$1,242,700 to construct the apartments.Not including the appraised cost of Center-owned land donated to the project,which is valued at$150,000, the Spindletop Center governing board of trustees committed$200,000 in sponsor contribution funds.This leaves a budget gap of$363,933. We are requesting a grant from the 2013 City of Beaumont HOME funds to bridge this remaining amount and allow the project to move forward. We propose to use the requested funds for hard construction costs. If awarded,these funds will be used within 12 months from the time that they are made available to Spindletop Center. Other Sources of Funding As discussed,this project has received a commitment from HUD in the amount of$1,521,200. Of this amount, $278,500 must cover legal,geotechnical,topographical, land appraisal, cost analysis,filing,and architect fees.The Spindletop Center has committed$200,000 of the total cost. Spindletop Center will contact other foundation fund sources for the remainder of funding required. Amount of Grant Spindletop Center requests a grant in the amount of$363,933. Time Schedule Final drawings have been prepared and the project is ready to begin construction, once initial closing has occurred. The requested capital gap funds will enable the project to proceed without interruption.To demonstrate readiness of the development team,renderings and a site plan have been provided. Should this grant request be approved,we anticipate that construction will begin in February 2012,with a construction period of no more than 12 months.The first residents will able to occupy units in February 2013. How the Project Will he Sustained Because this project received funding under HUD's Section 811 program, it will receive project based rental assistance on an ongoing basis.This will help the project to meet its operating expenses. HUD provided an additional,separate award of$149,100.These funds are not a part of the construction costs and must be used for 3-year rental subsidies,or vouchers for residents.Although the project residents will pay 30%of their income in rent,HUD will subsidize the project by paying the difference between what the resident pays and the contract rent. Phase 1 of our housing initiative included the renovation of a Center- owned building on Center-owned land into The Studios at Spindletop to provide 12 single housing units.The Studios opened October 1,2010, and cost$637,981 to complete. Of this, $610,000 was provided by a social services block grant from the Texas Department of State Health Services(DSHS)and$27,981 was provided by a social services block grant from the South East Texas Regional Planning Commission(SETRPC). The funds came from special Hurricane Ike and Hurricane Dolly recovery funds made available from DSHS and SETRPC to support organizations with their ongoing recovery from the damages caused by the storms. Helping make the Studios a success are the HUD vouchers made available by the Housing Authority of the City of Beaumont. The housing authority designated the vouchers as"project based vouchers."This designation means the vouchers are attached to the rooms in the Studios, and residents must meet HUD eligibility requirements for the voucher. Early in the discussion and planning of the Studios, staff of the housing authority were extremely helpful in providing Spindletop Center with excellent suggestions and recommendations. During the forming of this successful partnership,the housing authority agreed to assign HUD vouchers to the Studios facility. This enabled the residents to more quickly move into the Studios and begin work on their long term recovery. In September 2005,the area was hit by Hurricane Rita,the fourth- most intense Atlantic hurricane ever recorded and the most intense tropical cyclone ever observed in the Gulf of Mexico. The storm caused a mandatory evacuation from the area.In 2007,Hurricane Humberto,a category 1 hurricane, struck the area and caused damage to much of the community.In August 2008,the area was hit by Tropical Storm Edouard,which caused additional damage to the community,and in September 2008,Hurricane Ike,the third costliest hurricane to ever make landfall in the United States,struck the area,causing another mandatory evacuation.Hurricane Ike struck the area just one week after Hurricane Gustav made final landfall just east of the community.The projected path of Gustav was close enough to Southeast Texas to force another mandatory evacuation. In the mandatory evacuations caused by Hurricanes Rita,Gustav,and Ike,the Center was forced to close all operations until staff were allowed to return to their home towns.During these evacuations,the Center experienced significant loss of revenue because staff could not provide services to consumers that were covered by the reimbursable Texas general revenue funds and the Medicaid behavioral health program.In addition,the storms also caused significant damage to many of the Center's program facilities that was not covered by the Center's high insurance deductible or reimbursed by the Federal Emergency Management Agency(FEMA). These major storms severely damaged one community in our service area,Bridge City.In Bridge City,Hurricane Ike damaged nearly every single-family home,as well as a facility that housed some of the area's mental health consumers, including some who were enrolled in Spindletop Center programs.After these storms,these damaged housing facilities were slow to recover,and many have not yet completed repairs. In addition,many of the major petrochemical industrial plants in the area began major plant expansions.These significant construction projects represent a total investment of approximately$12 billion and created a major increase in temporary construction labor in the area.This has been estimated to total approximately 3,000 new jobs.These newly arriving temporary construction workers rapidly filled rooms in the area hotels and motels,as well as available rental housing. This contributed to the severe shortage of available rental housing,making it even more difficult for the Center's consumers with mental illness to find safe,affordable housing.These major impacts on the area housing availability created a need for Spindletop Center to begin a comprehensive housing initiative to provide safe and affordable housing for the targeted consumers. Spindletop Center plans to be the primary service provider for the residents of these housing units by offering a broad range of community based services.These services include case management,psychosocial rehabilitation,employment and educational support,and medication services.In addition,the Center has excellent relationships with other community service agencies,and the Center will facilitate referrals to these agencies when the residents need these other services. Persons with severe and persistent mental illness frequently suffer from physical illnesses,such as diabetes or high blood pressure,as well as co-occurring substance abuse disorders.These consumers have suffered with severe and persistent mental illness for many years,with a minimum of two years duration.Many have had multiple hospitalizations.The lack of affordable housing in the community plays a major role in the continued stability of these consumers.Typical characteristics of these consumers include recurring difficulty in coping with the tasks of daily living, such as finding and retaining work and housing,money management, shopping,and food preparation.These consumers are often unable to form and maintain relationships,and sustain their physical and mental health.This is often complicated by self- medication with legal and illegal substances. A valuable resource the staff use to help with transitioning from the Studios facility to permanent housing includes the various housing sites operated by the Housing Authority of the City of Beaumont.The executive leadership of this housing authority has officially agreed to provide housing vouchers for consumers living in the Studios at Spindletop facility,and a sliding scale fee arrangement has been established for residents of The Courtyard at Spindletop facility. HUD has a built-in 3 year voucher program for residents of the Section 811 apartment complex. Consumers living in the Section 811 facility,the Studios at Spindletop,and the Courtyard at Spindletop require significant assistance with meeting their needs for stable income,mental health treatment,food and clothing,and with obtaining successful permanent housing. Center staff also ensure that consumers who qualify receive mental health treatment from the Center,and assist consumers with obtaining necessary food and clothing from area community agencies.The Center has received letters of support of its housing initiative from various community service agencies,churches,and private businesses.The Center's supported housing staff ensure that the services of these agencies are made available to the consumers living in the Center's 3 living facilities.These services include job training,fitness programs,medical support, as well as assistance with food,clothing,and transportation. In order to effectively meet the needs of this population,an array of supportive services is required.The key to providing services is flexibility in matching the needs of the consumer with available services and to ensure that the services are accessible when needed. Spindletop Center adheres to the Texas Resiliency and Disease Management(RDM)model of service delivery.This model provides evidenced-based services to consumers based on diagnosis and consumer need. These services include psychiatric evaluations,medication management,the provision of medication,counseling,peer support groups,case management,psychosocial rehabilitative services,medication support and education,supported housing,supported employment,and flexible supports,as eligible.In addition, Spindletop Center provides assistance in accessing other consumer benefits,such as Social Security Insurance and Disability Insurance, supplemental nutrition assistance program,and Medicare Part D coverage. Spindletop Center provides its own substance abuse treatment for consumers with chemical dependency and the Center's drug abuse recovery program is an active collaborating partner with the network of providers of substance abuse treatment coordinated by the South East Texas Regional Planning Commission(SETRPC).The Center also coordinates physical health treatment with Ubi Caritas in Beaumont,and the Federally Qualified Health Care(FQHC)clinic in Port Arthur.These efforts ensure that consumers receive the medical services they need. The Center completes a uniform assessment on each consumer upon entering Spindletop Center outpatient services.This uniform assessment is referred to as a TRAG(Texas Recommended Assessment Guideline)and is the standard uniform assessment required by the Texas Department of State Health Services(DSHS).The TRAG covers nine different dimensions,including housing and employment stability.Based on the TRAG score results,a consumer is placed in the package of services that corresponds with their needs.Typically,consumers in the more intensive service packages receive supported housing and supported employment services. BACKGROUND As mandated by the U. S. Department of Housing and Urban Development(HUD),City Council has conducted public hearings and work sessions in previous years prior to adopting the City's Annual Action Plan. Community Development Staff,along with the Community Development Advisory Committee(CDAC),hosted Public Hearings in order to receive public comments on the process and activities related to the Preliminary 2013 Annual Action Plan. Applicants for Public Services, Public Facilities and Improvements and Emergency Solutions Grant funds will have the opportunity at this Hearing to present details of their applications and answer questions from the City Council. Attached is the proposed Preliminary Budget for the 2013 Program Year. The proposed Preliminary Budget reflects allocations of$1,234,943 in Community Development Block Grant(CDBG)funding,an estimated$100,000 in Program Income, $421,000 in HOME funding and$136,039 in Emergency Solutions Grant funding. Prior to its submission to HUD for approval,City Council will consider adopting the final Draft of the Annual Action Plan on or about April 30,2013. FUNDING SOURCE U.S. Department of Housing and Urban Development(HUD)Community Development Block Grant,HOME Investment Partnership grant and Emergency Solutions Program grant funds. RECOMMENDATION Council conduct the Public Hearing. 2013 HUD CONSOLIDATED PLAN Preliminary COMMUNITY DEVELOPMENT BLOCK GRANT(CDBG) 2013 Budget HOUSING MINOR REPAIR 87,955 Funds will be used for the weatherization and painting of approximately 17 homes at$5,000 each for the elderly and disabled. CLEARANCE AND DEMOLITION 100,000 Funds will be used to demolish approximately fortyy(40)unsafe,unsanitary and Uninhabitable residential structures I low to moderate income areas at a cost of approximately$2,500 each. Hotel Beaumont; Crocket Street;Jefferson Theater; Theodore R.Johns,Jr.Ubrary; L.L.Melton YMCA PUBLIC SERVICES 150,000 Public service Organizations Funds will be used for administrative and operating costs for various public service organizations that provide services to low/moderate income citizens. ADMINISTRATION 245,988 Funds will be used for personnel and operating expenses necessary for compliance with the planning,execution, and regulatory requirements associated with the implementation of the HUD Consolidated Grant Program. TOTAL ENTITLEMENT $1,234,943 Program Income 100,000 Small Business Loan Historic Preservation Loan Fund Clearance and Demolition 'Program Income is Estimated TOTAL CDBG $' HOME AFFORDABLE HOUSING PROGRAM Funds will be used to assist a non-profit housing development organization with the development of approximately 19-20 new single family homes. Funds will also be used to assist low/moderate income families with the dosing costs, mortgage buy downs,and down payments needed to purchase homes. Funds will also be used for eligible project costs associated with the development of mufti-family housing Units. HOME ADMINISTRATION 42,100 CHDO OPERATING 6311so CHDO RESERVE 315,750 TOTAL HOME EMERGENCY SOLUTIONS GRANT $136,039 Funds will be used to provide Homeless Provider Grant Funds to assist with operation management,essential services,homeless prevention and administration for an organization that provides services to the homeless population.
