Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on January 22, 2013, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Karen Dorris of First United Methodist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Coleman, Councilmembers Getz, Pate and Smith. Absent: Councilmembers Wright and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Councilmember Wright was absent due to being out of the City. Councilmember Samuel was absent due to Jury Duty. Proclamations, Presentations, Recognitions "Beaumont Crime Stoppers Month"-January,2013-Proclamation read Councilmember Pate; accepted by Doug Landry, President of Beaumont Crime Stoppers and former Judge Vi McGinnis Public Comment: Persons may speak on scheduled agenda items 1/Consent Agenda. None CONSENT AGENDA Approval of minutes— January 15, 2013 Confirmation of committee appointments — None Minutes—January 22,2013 B) Approve a resolution authorizing the City Manager to apply for and receive funding through the U.S. Department of Homeland Security, 2013 Emergency Management Performance Grant program — Resolution 13 - 017 C) Approve a resolution authorizing the City Manager to approve Change Order No. 2 to the contract with Horseshoe Construction, Inc. related to the Sanitary Sewer Rehabilitation of Small Diameter Mains Contract XXII — Resolution 13 - 018 Councilmember Pate made a motion to approve the Consent Agenda excluding Item A. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, PATE AND SMITH NAYS: NONE MOTION PASSED A) Approve a resolution endorsing the "Let's Move! Cities, Towns, and Counties" program of the National League of Cities to combat childhood obesity— Resolution 13 - 016 Mayor Pro Tern Coleman made a motion to approve Item A of the Consent Agenda. Councilmember Smith seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN,COUNCILMEMBERS GETZ, PATE AND SMITH NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution approving the renewal of an annual software maintenance agreement for use by Police, Fire and EMS. SunGard Public Sector software is used by Police, Fire, and EMS for dispatching of emergency personnel, records management for police, miscellaneous reporting, case management, and numerous other essential functions for Public Safety. This purchase is exempt from competitive bidding since it is available from only one (1) source having exclusive rights to modify and maintain the software. The software maintenance agreement provides twenty-four/seven unlimited telephone support for 911 dispatching; Monday — Friday, 8 — 5 support for mobile computers, electronic field reporting, and all records management applications, and provides annual software upgrades. General Fund — Information Technology and Confiscated Goods— Police. Approval of resolution. Minutes—January 22,2013 Councilmember Getz moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY,AUTHORIZED TO PAY AN(NOVICE IN THE AMOUNT OF$230,508.92 TO SUNGUARD PUBLIC SECTOR FOR THE RENEWAL OF AN ANNUAL MAINTENANCE AGREEMENT FOR POLICE,FIRE AND EMS PUBLIC SAFETY SOFTWARE SUPPORT BEGINNING JANUARY, 2013. Mayor Pro Tern Coleman seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN,COUNCILMEMBERS GETZ, PATE AND SMITH NAYS: NONE MOTION PASSED Resolution 13 - 019 PUBLIC HEARING * Dangerous Structures Public Hearing Open — 1:45 p.m. Public comments were made by the following citizens who personally appeared and requested additional time to make repairs to their property. Consider an ordinance declaring certain structures to be dangerous structures and ordering their removal within 10 days or authorizing the property owner to enroll the dangerous structure in a work program. These structures have been inspected by the Building Codes Division and found to be unsafe structures as defined by the City of Beaumont's Code of Ordinances, Chapter 24, Article 24.04 Unsafe Substandard Structures, Division 1, Sec. 14.04.001 of the 2009 Minutes—January 22,2013 International Property Maintenance Code. Additionally,these structures have deteriorated to a condition that they are no longer considered suitable for repair. City may incur the cost of demolition. Sources may include General funds and Community Development Block Grant (CDBG) funding. Administration recommends approval. COuncilmember Pate made a motion to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AS WELL AS TO ALLOW PROPERTY OWNERS OF ITEMS #19, 25 AND 27 TO ENTER INTO A 150 DAY WORK PROGRAM FROM THE DANGEROUS STRUCTURE LIST AND EXCLUDING ITEM#35; PROVIDING FOR SEVERABILITY AND PROVIDING A PENALTY. Councilmember Smith seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, PATE AND SMITH NAYS: NONE MOTION PASSED Ordinance 13 - 005 COUNCILMEMBER COMMENTS MAYOR PRO TEM COLEMAN - GREAT DAY IN BEAUMONT COUNCILMEMBER GETZ- HAD THE OPPORTUNITY TO PARTICIPATE IN THE MLK PARADE, IT WAS WELL ATTENDED WITH THE NEW ROUTE, STATED THAT THERE WAS A CITIZEN ON THE NEWS THAT EXPRESSED HIS CONCERN THAT THE PARK WASN'T BEING UTILIZED AND THE PARK NOT BEING ON THE PARADE ROUTE, ALSO EXPRESSED CONCERNS THAT WITH IT BEING MILK DAY IT WOULD BE NICE TO UTILIZE THE PARK SINCE IT'S HIS NAME SAKE,ALSO APOLOGIZED FOR MISSING THE WILLOW CREEK NEIGHBORHOOD ASSOCIATION MEETING COUNCILMEMBER WRIGHT- ABSENT COUNCILMEMBER PATE- STATED THAT HE HAD THE OPPORTUNITY TO PARTICIPATE IN THE MLK DAY PARADE, GLAD FOR THE TURNOUT AND THE NEW ROUTE AS WELL AS THE STAFF AND OTHER ORGANIZERS THAT HELP PUT THE PARADE TOGETHER COUNCILMEMBER SAMUEL- ABSENT Minutes—January 22,2013 COUNCILMEMBER SMITH- COMMENTED ON THE MLK DAY PARADE AND THE GREAT TURNOUT AS WELL AS THE GOSPEL SYMPHONY ON THURSDAY, HAD A CONCERN REGARDING A MOBILE HOME HOOKED TO A TRAILER ON THE CORNER OF WALDON AND TYRELL PARK ROAD, CALLED BACK IN NOVEMBER, THE MOBILE HOME AND TRAILER WAS TO BE MOVED AND HAS NOT BEEN WOULD LIKE TO GET THIS RECTIFIED BECAUSE IT'S AN EYE SORE IN THE NEIGHBORHOOD CITY ATTORNEY COOPER- NONE CITY MANAGER HAYES- NONE MAYOR AMES- CONGRATULATED THE EMPLOYEES THAT HAVE MADE 25 THROUGH 40 YEARS OF SERVICE,THERE WAS A BREAKFAST TO HONOR THEM THIS PAST WEEK, ALSO COMMENTED ON THE MLK PARADE AND THE PARADE ROUTE AND HOW WELL ATTENDED THE PARADE WAS, JUDGE RANSOM "DUCE" JONES WAS IN CHARGE OF THE ROUTE ALONG WITH THE POLICE DEPARTMENT, STATED THAT SHE DIDN'T SEE THE CITIZEN THAT VOICED CONCERNS ABOUT THE MLK PARK NOT BEING ON THE PARADE ROUTE, SPOKE WITH JUDGE DUCE JONES AND BELIEVES THAT THE MLK PARK WAS NOT ON THE PARADE ROUTE BECAUSE THE PARK IS ON AVERY BUSY STREET AND THERE WAS A CONCERN AS TO THE SAFETY OF THE CHILDREN Public Comments (Persons are limited to three minutes) Stephen Howard 3210 Lampassas Beaumont TX Wanted to get clarification as to the extension of the home on Lampassas, they are receiving a grant and not requesting a work program John Wilson 1465 Wellington Oaks Beaumont TX Thanked council for the Capital Improvements that they have done within the City, has a concern regarding Dowlen Road, there are no sidewalks in front of Marshall Middle School, heard that there is a new law that was implemented that when a new business has been built there has to be sidewalks, would like to see sidewalks all along Dowlen Road if possible With there being no Executive Session, Council adjourned at 2:06 p.m. EXECUTIVE SESSION - CANCELLED Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Rashee Guillory vs. The City of Beaumont; No. E-188,778 Minutes—January 22,2013 Audio available upon request in the City Clerk's Office. :10, IAA%%�?�1 Be ky A ty MaW • y ��r t Tina Broussard, City Clerk h Minutes—January 22,2013
