Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on November 6,2012, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Reverend Michael A. Jamail Vicar with the Catholic Diocese of Beaumont gave the invocation. Mike Eherdt, Veteran of the U. S. Army led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Coleman, Councilmembers Getz, Wright, Pate and Samuel. Absent: Councilmember Smith. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Councilmember Smith absent due to Election Day. None CONSENT AGENDA Approval of minutes— October 30, 2012 Confirmation of committee appointments - None A) Approve a resolution authorizing the City Manager to execute an annual agreement with Lamar University for video production services — Resolution 12 - 269 B) Approve a resolution amending a Development and Lease Agreement with the Beaumont Children's Museum — Resolution 12 - 270 C) Approve a resolution amending and approving the Alcohol and Substance Abuse Policy for employees of the Beaumont Municipal Transit system — Resolution 12 - 271 D) Approve a resolution reappointing Dewey J. Gonsoulin to the Civil Service Commission— Resolution 12 - 272 E) Approve a resolution authorizing the City Manager to accept grant funding through the Mamie McFaddin-Ward Heritage Foundation — Resolution 12 - 273 Councilmember Pate made a motion to approve the Consent Agenda. Consider a resolution accepting the Certified Roll Jurisdiction Summary of the tax roll for the tax year 2012 (Fiscal Year 2013). Pursuant to the Texas Property Tax Code, Section 26.09, this recap must be approved by the City Council. On September 25, 2012, Council approved the tax roll as certified by the Jefferson County Appraisal District with a taxable value of $6,906,373,448. There is no change in the taxable value of the Certified Roll Jurisdiction Summary. Approval of resolution. Councilmember Wright moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL,PURSUANT TO THE TEXAS PROPERTY TAX CODE, SECTION 26.09, HEREBY APPROVES THE GRAND RECAP OF THE APPRAISAL ROLL FOR THE TAX YEAR 2012 (FY2013) WITH A TAXABLE VALUE OF $6,906,373,448,WHICH SHALL CONSTITUTE THE CITY'S TAX ROLL. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 12 - 274 PUBLIC HEARING * Receive comments related to a proposal to add a new bus route as a part of the Beaumont Municipal Transit system Open: 2:12 p.m. None Close: 2:12 p.m. * Receive comments related to a proposal to increase the adult fare as a part of the Beaumont Municipal Transit system Open: 2:15 p.m. David Pete 4390 Corley Ave Beaumont TX Commented on the bus increase, asked why there was an increase in the bus fare, as well as an increase in the bus routes, it seems that the timing is not good and a conflict of interest Close: 2:17 p.m. Minutes—November 6,2012 2. Consider an ordinance repealing Article 20.07 of the Code of Ordinances and adopting a new Article 20.07 increasing the adult fare for the Beaumont Municipal Transit system. Currently the Beaumont Municipal Transit(BMT)system is managed by a private company, through a Management Agreement with Beaumont Transit Company of Jacksonville, Florida. Receiving funding and oversight from the Federal Transit Administration (FTA), BMT was recently informed that the fare structure would need to be changed in order to be in compliance with all regulations and requirements. Specifically, regulations require that senior citizens, persons with disabilities and Medicare card holders are to be charged no more than one-half the peak hour fare during off-peak hours. While Beaumont's fare structure does not adjust fares during off-peak times, the issue still exists in that our reduced fare is seventy-five cents, while our full fare is $1.25. As such, in an effort to comply with this requirement, we are proposing to increase the regular adult fare from $1.25 to $1.50. The regular adult fare has not increased since 2003. No increases to daily, weekly or monthly rates are proposed. As a result, the daily, weekly and monthly rates become an even more attractive option to our customers. Attached is the proposed Article 20.07 that controls fares. Additional revenue of approximately $40,000 is projected for the Municipal Transit Fund. Approval of the ordinance. COuncilmember Samuel made a motion to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 20, BY REPEALING EXISTING ARTICLE 20.07 AND ADOPTING NEW ARTICLE 20.07 OF THE CODE OF ORDINANCES OF BEAUMONT,TEXAS,TO MAKE CHANGES AND ADDITIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Pate seconded the motion. Pete 4390 Corley Beaumont TX Spoke in regards to a persistent problem with drainage on his street, next door neighbor had a leak in her driveway, water constantly coming out, she called the City at 7:30 a.m., no one came out until 1:30 p.m., that is unacceptable, other neighbors have also experienced water leaks, the streets in that area need to be taken care of, the City is doing patch work and that as well is unacceptable, there are a lot of issues that need to be addressed, requested that someone from the City come out and talk to the citizens in his neighborhood so that this problem gets solved Minutes—November 6,2012 Vernon Durden 2110 Westbury Rd. Beaumont TX Commended the Beaumont Police Department on the two events that they have held, attended both of them and the functions were very well attended, thanked the City Council as well as the City Manager for putting money in the budget so that these programs can happen, stated that the Chief attends a lot of functions and leading by example, also commented on the new HEB that the City has accepted, asked that the City try to keep the HEB on Lucas and not let HEB take that store out of the neighborhood, if there is anything that Council can do it would be greatly appreciated With there being no Executive Session, Council adjourned at 2:34 p.m. Audio available upon request in the City Clerk's Office.
