Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on October 9,2012, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda item 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Anjelita Dirden of Wesley Student Center, Lamar University gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Coleman, Councilmembers Getz, Wright, Pate, Samuel and Smith. Absent: Kyle Hayes, City Manager. Also present were Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Get Your Red On Week" - October 8 - 13, 2012 - Proclamation read by Councilmember Pate; accepted by Dr. Jimmy Simmons, six Lamar University Ambassador Students, ten members of the Marching Band and four Cheerleaders "Breast Cancer Awareness Month" — October, 2012 — Proclamation read by Mayor Ames; accepted by Norma Sampson with Julie Rogers "Gift of Life" Program Presentation - Robin Troy, Chairman of DogtoberFest, made remarks regarding DogtoberFest on October 13, 2012 Public Comment: Persons may speak on scheduled agenda item 1/Consent Agenda. Jason Mashburn 1070 Monterrey Beaumont TX Spoke regarding Item #1 on the Agenda; related to the Mobile Food Units CONSENT AGENDA Approval of minutes — October 2, 2012 Confirmation of committee appointments - None A) Approve a resolution amending the current lease with Landlord Jacquelyn Cake for Minutes—October 9,2012 EMS Med 1 operations — Resolution 12 - 239 B) Approve a resolution authorizing the granting of a Pipeline License Agreement within City of Beaumont limits for use in the Water Department — Resolution 12 - 240 C) Approve a resolution authorizing the granting of a Utility Crossing Agreement within City of Beaumont limits for use in the Water Department— Resolution 12 — 241 Councilmember Smith made a motion to approve the Consent Agenda. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE, SAMUEL AND SMITH NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider an ordinance amending the Code of Ordinances related to Mobile Food Units. At the Work Session held October 2, proposed amendments to the Code of Ordinances related to mobile food units were reviewed and discussed with the City Council. These amendments will allow a mobile food unit operated by a City-permittee under the supervision of a certified food manager to forgo the additional food sales permit, require that wastewater tanks be emptied every 48 hours, and remove the requirement related to the proximity to a commercial restroom. The proposed amendments will allow locally permitted food establishments to offer the public a wider variety of food service options. Approval. Councilmember Pate moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 10, ARTICLE 10.02, SECTION 10.02.001(B), SUBSECTIONS 229.169 (A)(1)(B) AND 229.169(A)(1)(G), ADDING SUBSECTIONS 229.169(B)(3), AMENDING SUBSECTIONS 229.169 (C)(1)(H),AND 229.169(c)(1)(1), REPEALING AND RENUMBERING SUBSECTION 229.169(C)(1)(J) AND REPEALING THE EXISTING SUBSECTION 229.169(C)(1)(K) OF THE CODE OF ORDINANCES OF BEAUMONT,TEXAS,TO MAKE CHANGES AND ADDITIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. AYES: MAYOR AMES, MAYOR PRO COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE, SAMUEL AND SMITH NAYS: NONE MOTION PASSED Ordinance 12 - 076 Minutes—October 9,2012 COUNCILMEMBER COMMENTS COUNCILMEMBER SMITH - THANKED ATTORNEY TYRONE COOPER AND COUNCILMEMBER AUDWIN SAMUEL ALONG WITH THE CHIEF OF POLICE, THEY PLAYED IN THE FRATERNITY OMEGA PSI PHI FUND RAISER, THE FRATERNITY RAISED ABOUT $9,000.00,ALSO STATED THAT THIS SATURDAY,OCTOBER 13,2012,AT THE MELTON FAMILY LIFE RESOURCE CENTER FROM 9:00 A.M.TO 12:00 P.M.,HE WOULD BE SPONSORING A ZUMBA FUND RAISER FOR RELAY FOR LIFE SINCE IT IS BREAST CANCER AWARENESS MONTH, STACY LEWIS WILL BE THE INSTRUCTOR,ENCOURAGE EVERYONE TO COME OUT, THEY WILL STILL HAVE TIME TO ATTEND DOGTOBERFEST, THANKED DR.COLEMAN FOR THE DENTAL FAIR,HE WAS THE FACILITY CHAIRMAN,THE PROGRAM WAS FALLING SHORT ON FUNDING, HE RAISED $30,000 TO MAKE SURE THE EVENT WAS A SUCCESS COUNCILMEMBER SAMUEL - COMMENTED ON THE FUND RAISER THAT HE ATTENDED SPONSORED BY OMEGA PSI PHI FRATERNITY,ALSO ON LAST SUNDAY HAD AN OPPORTUNITY TO MEET WITH A NUMBER OF BUS DRIVERS WITH THE BEAUMONT MUNICIPAL TRANSIT, THEY WILL BE MEETING AGAIN ON THIS SUNDAY, OCTOBER 14, 2012 AT 5:30 P.M. AT THE NORTH END COMMUNITY CENTER TO ADDRESS A NUMBER OF CONCERNS,THERE IS AN INVITATION FOR THE CITY MANAGER TO ATTEND ALONG WITH ANY COUNCILMEMBERS THAT WOULD LIKE TO JOIN,LOOKING FORWARD TO A GREAT WEEKEND WITH LAMAR UNIVERSITY HOMECOMING, ENCOURAGED EVERYONE TO "GET YOUR RED ON" FOR THE HOMECOMING, WILL ALSO BE WITH HIS FAVORITE PET AT DOGTOBERFEST COUNCILMEMBER PATE - APPRECIATES THE GREAT JOB THAT CAROL AND THE TEAM DID AT THE FIRE MUSEUM REGARDING SAFETY,COMMENTED ON DOGTOBERFEST ENCOURAGE EVERYONE TO ATTEND, ALSO COMMENTED ON LAMAR UNIVERSITY FOOTBALL, SOFTBALL,VOLLEYBALL,THE CROSS COUNTRY TRACK TEAM AND SOCCER THAT CITIZENS CAN ATTEND COUNCILMEMBER WRIGHT- TALKED ABOUT THE ELECTED OFFICIALS THAT ARE ON COUNCIL THAT ARE DOING GOOD WILL, NOT JUST THE CITY COUNCIL BUT ALL ELECTED OFFICIALS AND ALL THAT THEY DO TO RAISE MONEY FOR DIFFERENT PROGRAMS, THESE FUNDRAISERS ARE DONE BY THEM TO PROMOTE THINGS FOR THE CITY, HAPPY TO LET EVERYBODY KNOW THAT THEY ARE EAGER TO PROMOTE THE CITY, STATED THAT THEY HAVE A WONDERFUL COHESIVENESS IN WORKING TOGETHER Minutes—October 9,2012 COUNCILMEMBER GETZ - ANNOUNCED THAT ON FRIDAY,OCTOBER 12,2012,AT 6:00 P.M., THE CHAMBERS HOUSE WILL BE CELEBRATING THE 100TH BIRTHDAY OF FLORENCE CHAMBERS, FOR THOSE THAT MAY NOT KNOW THE STORY OF THE SISTERS THAT LIVED IN THAT HOUSE,THEY WERE RAISED IN A VERY FRUGAL LIFE STYLE, WHEN THEY PASSED AWAY PEOPLE WERE SURPRISED TO FIND OUT THAT THEY HAD A FORTUNE THAT WAS USED TO RESTORE THE HOUSE, THEY WILL RELIVE FLORENCE'S SEVENTEENTH BIRTHDAY PARTY,PEOPLE WILL BE IN COSTUMES THIS IS FREE TO THE PUBLIC, ENCOURAGE CITIZENS TO COME OUT AND TOUR THE FACILITY AND SEE HOW NICE IT IS MAYOR PRO TEM COLEMAN - ANNOUNCED THERE WILL BE A 5KWALK/RUN ON SATURDAY, OCTOBER 20, 2012 AT LAMAR UNIVERSITY, ENCOURAGE CITIZENS TO PARTICIPATE IN OBSERVANCE OF BREAST CANCER AWARENESS MONTH, COMMENTED ON THE TEXAS DENTAL ASSOCIATION SMILE FOUNDATION THAT SPONSORED A TEXAS MISSION OF MERCY AT THE BEAUMONT CIVIC CENTER, THERE WERE 28 GOLDEN TRIANGLE DENTISTS, 42 TEXAS DENTISTS, 20 HYGIENISTS AND 100'S OF VOLUNTEERS, 659 PATIENTS WERE SEEN, THERE WAS $438,800 OF DENTAL SERVICES DONATED, THANKED SOUTHEAST TEXAS DONORS,THANKED HIS FELLOW DENTISTS, SHERRY ULMER AND HER STAFF AS WELL AS EVERYONE WHO PARTICIPATED CITY ATTORNEY COOPER- NONE CITY MANAGER HAYES - ABSENT MAYOR AMES - COMMENTED ON ALL THE EXCITING EVENTS THAT OCCURRED IN DOWNTOWN BEAUMONT THIS PAST WEEKEND, THE DENTAL FAIR WHICH WAS A GREAT EVENT, THE COPS AND KIDS FESTIVAL WAS EXCELLENT, THE PINK RIBBON WALK FOR THE JULIE ROGERS GIFT OF LIFE FOR BREAST CANCER AWARENESS MONTH, THE FIRE PREVENTION AND FIRE SAFETY FESTIVAL WHICH ALSO HAD A CHILI COOK OFF, MENTIONED UPCOMING EVENTS SUCH AS DOGTOBERFEST, THE POINTER SISTERS, THE SABINE AREA RESTAURANTS WILL HAVE THEIR CHEFS DELIGHT CULINARY EVENT ON TONIGHT THAT BENEFITS SCHOLARSHIPS FOR THE CULINARY STUDENTS AT LAMAR UNIVERSITY, "GO BIG RED" STATED SHE WILL BE DOING THE TRADITIONAL WALK WITH DR.
