Cooper, City Attorney Kyle Hayes,City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on July 3, 2012, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Councilmember Coleman gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Smith, Councilmembers Coleman, Getz, Wright, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Mayor Ames announced the festivities for the 4th of July Festivities, invited everyone to come out and enjoy the 4th of July. Proclamations, Presentations, Recognitions Recognition—Councilmember Coleman recognized Vivian Tally who will be honored by her relatives,family and friends at the celebration of her 100th birthday on Saturday,July 7, 2012 at Calder Baptist Church in Beaumont,Vivian Tally was born in Dallas,Texas on July 7, 1912 to the parents of Nora and Faye Cantrell, she married Carl Tally, they were blessed with one son Larry who married his wife Wayden, she has four grandsons and 8 grandchildren, she enjoys playing the piano daily and was the church organist for 70 years, she is the member of the Hall of Fame Piano Guild and plans to play a short recital for her guest at her 100th celebration at Calder Baptist Church on July 7, 2012 from 2:00 p.m. to 7:00 p.m. Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda. None Minutes—July 3,2012 CONSENT AGENDA Approval of minutes - June 25, 2012 Confirmation of committee appointments - None Mayor Arises read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. GENERAL BUSINESS 1. Conduct an election of Mayor Pro Tempore. Article III, Section 6 of the City charter states "The City Council shall elect one of its members as Mayor Pro Tempore for a one (1) year term. The Mayor Pro Tempore shall perform the duties of the Mayor in case of the absence or inability of the Mayor to perform the duties of his office, and, if a vacancy occurs, shall become mayor for the unexpired term." Councilmember Wright moved to APPROVE A RESOLUTION THAT COUNCILMEMM COLEMAN IS ELECTED MAYOR PRO TEMPORE FOR A ONE(1)YEAR TERM. Mayor Pro Tern Smith seconded the motion. AYES: MAYOR AMES,MAYOR PRO TEM SMITH,COUNCILMEMBERS COLEMAN,GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 12 - 142 2. Consider approving a resolution authorizing the City Manager to apply for and accept funding through the FY2012 Assistance to Firefighter's Grant and Fire Prevention & Safety Grant Programs. Fire Administration has identified equipment needs that are eligible under two Department of Homeland Security (DHS) grant programs. The Assistance to Firefighters Grant will be used to replace a Wildland/Urban Interface Firefighting Apparatus, retrofit one fire engine with a compressed air foam system, purchase SPCO sensors to monitor citizens and firefighters for exposure to carbon monoxide, acquire fitness equipment to support the department's safety and fitness program, and modify Chief s Suburbans to achieve effective Command Post capabilities in the field. The Fire Prevention&Safety Grant will be used to purchase an electronic fire extinguisher simulator to be used for public education and firefighter training. If the grants are approved, the required matching funds will be provided in the FY2013 budget, with $2,400 budgeted in the General Fund and $59,000 budgeted in the Capital Reserve. Councilmember Pate made a motion to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO APPLY FOR AND RECEIVE FUNDING FOR THE CITY OF BEAUMONT THROUGH THE FY 2012 ASSISTANCE TO FIREFIGHTERS GRANT PROGRAM IN AN AMOUNT UP TO $236,000 AND THE FIRE PREVENTION AND SAFETY GRANT PROGRAM IN AN AMOUNT UP TO$8,600. Councilmember Smith seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE, SAMUEL AND SMITH NAYS: NONE MOTION PASSED Resolution 12 - 143 3. Consider approving a resolution accepting the roadway and right of way in front of Sallie Curtis Elementary School that is owned by the Beaumont Independent School District. The road currently travels in front of Sallie Curtis Elementary and connects Peyton Drive with North Circuit Drive. The road and right of way will be deeded to the City of Beaumont. BISD will make a payment of $80,000 to the City in return for the City accepting maintenance and rehabilitating the street. The rehabilitation will be completed by mid August utilizing Contractor and City forces. The proposed transaction was approved by the Beaumont Independent School District Board at their meeting held on Monday June 18, 2012. Approval of resolution. Councilmember Getz made a motion to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO ACCEPT$80,000 FROM THE BEAUMONT INDEPENDENT SCHOOL DISTRICT FOR THE REHABILITATION AND MAINTENANCE THROUGH THE STREET REHAB PROJECT OF THE CAPITAL PROGRAM. Councilmember Smith seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE, SAMUEL AND SMITH NAYS: NONE MOTION PASSED Resolution 12 - 144 COUNCILMEMBER COMMENTS Minutes—July 3,2012 MAYOR PRO TEM COLEMAN - STATED TOMORROW IS AN OPPORTUNITY TO HAVE FUN AND CELEBRATE OUR COUNTRY'S BIRTHDAY, CALDER PLACE 1929's PARADE WILL START AT 9:00 A.M., AT TRINITY UNITED METHODIST CHURCH,THE DOWNTOWN FESTIVITIES WILL START AT 5:00 P.M., FIREWORKS AT 9:00 P.M. Kenneth Beaumont TX Spoke in regards to the streets in the Avenues,they are in much need of repair, knows that the city has other projects and there may not be any money but any help that can be given would be great if possible, wished everyone a happy 4t' of July Roberto Flores 2425 Buchanan Beaumont TX President of the League of the United Latin American Citizens (LULAC) there has been many calls recently regarding issues that concerns the Beaumont Public Library, some of the citizens are being denied a library card, as proof of a photo ID they have been using a particular photo ID and have been issued library cards in the past,the library has now done away with this proof of ID and are requesting other documents which they do not have, inquiries have been made to the Library Director who has directed them to the City Attorney's office, spoke with two people in the City Attorney's office, contacted a Councilmember and a board member of the library committee, there still has not been any details given from these particular persons, the particular photo ID that is being used is recognized by banks, law enforcement officers and is a pictured ID, City ordinance states that proof of residency is required, it is not known if a photo ID is also required by City ordinance, would like more details on this, a meeting has been requested with the City Attorney, would like some kind of reply on this so that the group of people that are being denied will know why, these are residents of Beaumont that pay taxes, these are parents who are concerned because their children cannot check out any books, LULAC is requesting that the meeting with the City Attorney be granted Open session of meeting recessed at 1:56 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Claims against Westchester Surplus Lines Insurance Company and Lexington Insurance Company for damages sustained as a result of Hurricane Ike Derrick Newman vs. City of Beaumont, Texas, Frank C. Coffin, Jr., James Kyle Hayes, James Cody Guedry, Charles J. Duchamp III, David Todd Burke, Jason J.
