Article III, Section 6 of the City Charter states"The City Council shall elect one of its members
as Mayor Pro Tempore for a one(1)year term. The Mayor Pro Tempore shall perform the duties
of the Mayor in case of the absence or inability of the Mayor to perform the duties of his office,
and, if a vacancy occurs, shall become Mayor for the unexpired term."

REQUESTED ACTION: Consider a resolution authorizing the City Manager to
apply for and accept funding through the FY2012
Assistance to Firefighter's Grant and Fire Prevention&
Safety Grant Programs.
BACKGROUND
Fire Administration has identified equipment needs that are eligible under two Department of
Homeland Security(DHS) grant programs. The Assistance to Firefighters Grant will be used to
replace a Wildland/Urban Interface Firefighting Apparatus, retrofit one fire engine with a
compressed air foam system,purchase SPCO sensors to monitor citizens and firefighters for
exposure to carbon monoxide, acquire fitness equipment to support the department's safety and
fitness program,and modify Chief s Suburbans to achieve effective Command Post capabilities
in the field. The Fire Prevention& Safety Grant will be used to purchase an electronic fire
extinguisher simulator to be used for public education and firefighter training.

FUNDING SOURCE
If the grants are approved,the required matching funds will be provided in the FY2013 budget,
with$2,400 budgeted in the General Fund and $59,000 budgeted in the Capital Reserve.

BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to apply for and receive funding
for the City of Beaumont through the FY 2012 Assistance to Firefighters Grant Program
in an amount up to $236,000 and the Fire Prevention and Safety Grant Program in an
amount up to $9,600.

REQUESTED ACTION: Council consider a resolution accepting the roadway and
right of way in front of Sallie Curtis Elementary School
that is owned by the Beaumont Independent School
District.
BACKGROUND
The road currently travels in front of Sallie Curtis Elementary and connects Peyton Drive with
North Circuit Drive. The road and right of way will be deeded to the City of Beaumont. BISD
will make a payment of$80,000 to the City in return for the City accepting maintenance and
rehabilitating the street. The rehabilitation will be completed by mid August utilizing Contractor
and City forces.
The proposed transaction was approved by the Beaumont Independent School District Board at
their meeting held on Monday June 18, 2012.
FUNDING SOURCE
Not applicable.
RECOMMENDATION
Approval of resolution.
RESOLUTION NO.
WHEREAS, Beaumont Independent School District(BISD)wishes to convey to the
City of Beaumont a roadway, said roadway being a private road which travels in front of
Sallie Curtis Elementary School and connects Peyton Drive with North Circuit Drive, and
a right-of-way,as described in Exhibit"A"attached hereto,for the purpose of rehabilitating
and maintaining said roadway; and
WHEREAS, BISD wishes to contribute $80,000 to the City of Beaumont for the
purpose of rehabilitating and maintaining said roadway through the Street Rehab Project
of the Capital Program;
WHEREAS, the City Council has considered the purpose of said conveyance and
monetary contribution and is of the opinion that the acceptance of said conveyance and
monetary contribution is necessary and desirable and that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted.
THAT said conveyance by Beaumont Independent School District be and the same
is hereby, in all things, accepted.
BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby
authorized to accept $80,000 from Beaumont Independent School District for the
rehabilitation and maintenance of the above-described roadway through the Street Rehab
Project of the Capital Program.
BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby
authorized to execute all documents necessary to complete the above-described
transaction.
