HomeMy WebLinkAboutORD 12-021 ORDINANCE NO. 12-021 ENTITLED AN ORDINANCE AMENDING CHAPTER 28, ARTICLE 28.03, SUBSECTION 28.03.024(cx17) OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Chapter 28, Article 28.03, Subsection 28.03.024(c)(17) of the Code of Ordinances of the City of Beaumont be and the same are hereby amended to read as follows: Sec. 28.03.024 District area and height regulations (c) Area and height exceptions. (17) In an RS District,the twenty-five(25)foot rear yard setback may be reduced to a minimum of fifteen(15)feet provided no accessory buildings of any type shall be permitted to be located in the reduced rear yard, unless: (A) the width of the rear of the main structure that is closer than twenty- five(25)feet to the rear property line (or lines in the case of a five (5) sided lot which has two(2)rear lot lines) is less than fifty(50)percent of the width of the rear property line(s); and (B) the accessory building is not located in the space behind the portion of the structure that is less than twenty-five (25) feet from the rear property line. An accessory building can be located as close as two and one-half(2 Y2)feet from the rear or interior side lot lines, or as near as existing utility easements allow, if these two (2) conditions are present. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end, the various portions and provisions of this ordinance are declared to be severable. Section 4. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only. Section 5. That any person who violates any provision of this ordinance shall, upon conviction, be punished in accordance with Section 1.01.009 of the Code of Ordinances of the City of Beaumont.
