WHEREAS, on August 16, 2011, the City Council of the City of Beaumont, Texas,
passed Resolution No. 11-226 awarding a one (1) year contract with annual renewal
options not to exceed two (2) renewals that do not have cost increases for mowing
developed vacant city-owned and abandoned properties to Lene' Nursery, of Beaumont,
Texas, in an estimated amount of$42,840 ; and,
WHEREAS,on April 11,2012, Lene'Nursery requested termination of the contract;
and,
WHEREAS, Perfect Cut Lawn Care,of Beaumont,Texas, submitted a qualified bid
in the estimated amount of $50,116 in the unit amounts shown on Exhibit 'A" attached
hereto, is willing to honor its bid and contract at that price; and,
WHEREAS, City Council is of the opinion that the termination letter submitted by
Lene' Nursery, of Beaumont, Texas, should be accepted; and,
WHEREAS, City Council is of the opinion that the bid submitted by Perfect Cut
Lawn Care,of Beaumont,Texas, in the estimated amount of$50,116 should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT the contract termination request submitted by Lene' Nursery, of Beaumont,
Texas, be accepted; and,
BE IT FURTHER RESOLVED THAT the bid submitted by Perfect Cut Lawn Care,
of Beaumont, Texas, in the estimated amount of$50,116 for a one (1) year contract with
annual renewal options not to exceed two(2)renewals that do not have cost increases for
mowing developed vacant city-owned and abandoned properties be accepted by the City
of Beaumont; and,
BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby
authorized to execute a contract with Perfect Cut Lawn Care, of Beaumont, Texas, for the
purposes described herein.
