Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont,Texas, met in a regular session on July 12, 2011, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-2/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. and spoke briefly about fallen Officer Bryan Hebert. She asked for all citizens to keep the Hebert family in their prayers and thoughts. Mayor Ames then asked for a moment of silence as a tribute to Officer Hebert. Reverend James Blackwell of South Park Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Stephanie Gandy, Deputy City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Pate, Councilmembers Coleman, Getz, Wright, Samuel and Smith. Absent: Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Also present were Kyle Hayes, City Manager; Quentin Price, First Assistant City Attorney; Stephanie Gandy, Deputy City Clerk. Proclamations, Presentations, Recognitions Officer Carol Riley with Beaumont Police Department addressed Council on funeral arrangements for Fallen Officer Bryan Hebert. Wives of police officers who made red and black ribbons to honor Officer Hebert spoke to Council and passed out ribbons. Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Public Comment: Persons may speak on scheduled agenda items 1-2/Consent Agenda. None CONSENT AGENDA Approval of minutes - June 28, 2011 Minutes—July 12,2011 Confirmation of committee appointments - Resolution 11 - 190 Bill Little would be appointed as an alternate to the Planning and Zoning Commission. The term would commence July 12, 2011 and expire July 11, 2014. (Mayor Becky Ames) Jeff Purcell would be appointed to the Police Department Community Advisory Committee. The term would commence July 12, 2011 and expire July 11, 2013. (Councilmember Mike Getz) Karl Duerr would be appointed to the Police Department Community Advisory Committee. The term would commence July 12, 2011 and expire July 11, 2013. (Councilmember Mike Getz) A) Approve a contract for temporary personnel services — Resolution 11 - 191 B) Authorize the conveyance of an Aerial Easement to Entergy, Texas at the Northeast corner of Lucas and Calder Avenue — Resolution 11 - 192 C) Authorize the acceptance of a ten foot wide Exclusive Water Line Easement located at 3415 West Cardinal Drive — Resolution 11 - 193 D) Authorize the acceptance of a ten foot wide Exclusive Water Line Easement to provide water and fire protection services for Westbrook High School located at 8750 Phelan Blvd — Resolution 11 - 194 Councilmember Samuel made a motion to approve the Consent Agenda. Conduct an election of Mayor Pro Tempore. Administration recommended Mayor Pro Tern Pate made a motion to APPROVE A RESOLUTION THAT COUNCILMEM13ER JAMIE SMITH IS ELECTED MAYOR PRO TEMPORE FOR A ONE(1)YEAR TERM. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM PATE,COUNCILMEMBERS COLEMAN,GETZ, WRIGHT, SAMUEL AND SMITH NAYS: NONE Minutes—July 12,2011 MOTION PASSED Resolution 11 - 195 2. Consider amending Chapter 6, Article 6.07 of the Code of Ordinances related to taxicabs. Administration recommended approval. Earlier this year,the Council held a worksession on taxicab rates. Staff recommended that the base rate be increased by 75 cents to $2.75 for the first one-tenth mile. Council supported this recommendation and asked that it be brought back for approval. The rates for taxicab services are established in Section 6.07.072. The Police Department, which regulates taxicabs that operate in the city, asked that it be given time to research amendments to the ordinance that will provide it with better criteria for evaluating the background of an applicant for a chauffeur's license. The amendments proposed for Section 6.07.006 clarify the process and establish the criteria for that evaluation. Upon approval,the Police Department will follow the guidelines established in the Texas Occupations Code. The new process will include a records search, and staff is proposing a $15 application fee to cover the cost of accessing the applicant's records. Mayor Pro Tern Smith made a motion to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 6, ARTICLE 6.07, SUBSECTION 6.07.006(6), (E) AND (N); SUBSECTION 6.07.072(6)(1) OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Samuel seconded the motion. AYES: MAYOR AMES,MAYOR PRO TEM SMITH,COUNCILMEMBERS COLEMAN,GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Ordinance 11 - 045 WORKSESSIONS * Receive a request related to the establishment of Jefferson County Emergency Services District No. 3 which includes areas located within the City of Beaumont's ETJ (Extraterritorial Jurisdiction) Mr. Hubert Oxford, IV addressed Council regarding the establishment of Jefferson County Emergency Services District No. 3 to serve the population located west of the City of Beaumont. The District is required to request the City's consent due to the fact that some of the included areas are located within the City's extraterritorial Minutes—July 12,2011 jurisdiction. Mr. Oxford has worked with City staff to be sure that the proposed district lies outside the City's corporate limits and doesn't include the industrial district property located on Highway 90. Beaumont Fire Chief, Anne Huff, also reported that establishing the emergency services district would reduce some of the work load of the City's Fire Department. * Review and discuss proposed amendments to the Solid Waste Disposal Ordinance Jim Thompson, Director of Management Operations, addressed Council regarding modification to the City's ordinance for solid waste, namely the disposal requirements for tree clippings as brought to Council's attention by a tree service vendor. Mr. Thompson discussed the various modifications that would be made to the ordinance that would allow tree clippings to be put curbside by independent contractors so long as placement requirements are adhered to. Mr.Thompson also indicated that there would be several amendments to the ordinance to bring it up to date, including the removal of reference to the Public Works department, of which Solid Waste is no longer under the direction, and the time by which trash containers must be removed from the curbside by citizens. * Review and discuss the delivery of emergency medical services Ingrid Holmes, Public Health Director, spoke to Council regarding the EMS division. Mrs. Holmes noted the number of EMS stations located throughout the City, along with the number of units operated each day based on available staffing. It was noted that paramedic staffing is a nationwide challenge for emergency medical service systems, though they are being actively recruited. Mrs. Holmes also noted that calls for ambulance service are transferred from the 9-1-1 Operation Center to the Fire Dispatch Office. Fire and EMS crews work together to provide emergency medical care. Fire Department dispatchers determine the nature of the call, issue pre-arrival instructions and dispatch an ambulance and a Fire Department first responder. There are twelve fire stations located throughout the city and the Fire Department first responder typically arrives before the ambulance. If a city ambulance is not available, a private ambulance is dispatched. Should the nature of the call be more critical than anticipated, the crew may then contact the Paramedic Supervisor for assistance. Beaumont EMS has an excellent reputation with emergency room physicians for the quality of care being provided and, for the past sixty days,the 3-1-1 Call Center has not received any complaints about service delivery or the quality of care provided. J. D. Roberts on his efforts with Know Your County Courthouse, gave condolences to the Hebert family Tangela Stephens 4040 Crow Rd.
