HomeMy WebLinkAboutORD 11-039 ORDINANCE NO. 11-039 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A PARKING LOT IN A RCR-H (RESIDENTIAL CONSERVATION AND REVITALIZATION-H) DISTRICT AT 407 7TH STREET IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, 2325 Calder, LLC has applied for a specific use permit to allow a parking lot in a RCR-H (Residential Conservation and Revitalization-H) District at 407 7th Street, being the South 100' of Lots 26-28, Block 22, Averill Addition, City of Beaumont, Jefferson County, Texas, containing 0.35 acres, more or less, as shown on Exhibit "A," attached hereto; and, WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the request for a specific use permit to allow a parking lot in a RCR-H (Residential Conservation and Revitalization-H) District at 407 7th Street; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit is in the best interest of the City of Beaumont and its citizens, subject to the hereinafter described conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, Section 1. That a specific use permit to allow a parking lot in a RCR-H (Residential Conservation and Revitalization-H) District at 407 7th Street, being the South 100'of Lots 26-28, Block 22, Averill Addition, City of Beaumont, Jefferson County, Texas, containing 0.35 acres, more or less, as shown on Exhibit"A" attached hereto; and, is hereby granted to 2325 Calder, LLC, its legal representatives, successors and assigns, as shown on Exhibit 'A," attached hereto and made a part hereof for all purposes, subject to the following conditions: • A 25' setback along Broadway and 7th Street shall be adhered to unless the Board of Adjustment approves variances to the minimum setback for parking lots; • A minimum 6' wide landscape strip shall be installed along the Broadway and 7th Street frontages of the parking lot; • The parking lot shall meet the interior landscaping requirement; • An 8' tall wood screening fence shall be construction along the north property line; and, with a modification to the landscaping requirement along the north property line (no 10' wide landscaping strip). Section 2. That the specific use permit herein granted is expressly issued for and in accordance with each particular and detail of the site plan attached hereto as Exhibit "B," and made a part hereof for all purposes. Section 3. Notwithstanding the site plan attached hereto, the use of the property herein above described shall be in all other respects subject to all of the applicable regulations contained in Chapter 28 of the Code of Ordinances of Beaumont, Texas, as amended, as well as comply with any and all federal, state and local statutes, regulations or ordinances which may apply.
