Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on May 17, 2011, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Dwight Benoit of Magnolia Baptist Church gave the invocation. Councilmember Kevin Keating with Eagle Scout Troop 177 led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Pate, Councilmembers Coleman, Wright, Samuel and Smith. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Hurricane Awareness Week" - May 22 - 28, 2011 - Proclamation read by Councilmember Samuel; accepted by Tim Ocnaschek, Emergency Management Coordinator for the City of Beaumont and Dana Melancon, Meteorologist for Fox4 News "Emergency Medical Service Week" — May 15 — 21, 2011 — Proclamation read by Councilmember Coleman; accepted by Robert Falls with the City of Beaumont EMS and Jason Mercer and Joel Denley with North Star Emergency Medical Services "Older Americans Month"—May, 2011 — Proclamation ready by Mayor Ames; accepted by Lynn Huckaby, Director of the City of Beaumont Best Years Center Presentation — Jennifer Pate, District Coordinator with the office of Senator Williams, presented Mayor Becky Ames with a Senate Resolution #863 as the recipient of the Athena Award from the Greater Beaumont Chamber of Commerce Councilmember Coleman introduced Kevin Keating who has received his Eagle Scout award on Sunday he is a member of Wesley United Methodist Church's Troop 177. His Eagle Scout project involved installing parking signs for senior's and small children at Minutes—May 17,2011 Wesley United Methodist Church. He is a Cum Laude graduate of West Brook High School and will be attending the University of Texas in the Fall to study Architecture Public Comment: Persons may speak on scheduled agenda items 1/Consent Agenda. Mike Getz 7950 Phelan Beaumont TX Spoke in regards to Item A on the Consent Agenda; Contract for the Summer Food Service Program CONSENT AGENDA Approval of minutes — May 10, 2011 Confirmation of committee appointments — None A) Approve a contract for the Summer Food Service Program — Resolution 11 - 152 B) Approve a contract for improvements to the Police Building — Resolution 11 - 153 C) Approve an application for, and acceptance of, funding from the Texas Comptroller's office for Tobacco Compliance — Resolution 11 - 154 D) Authorize the City Manager to sign a contract with South East Texas Regional Planning Commission related to 9-1-1 service and the use of 9-1-1 funds — Resolution 11 - 155 E) Approve repealing Resolution 11-027 accepting a ten foot wide Exclusive Sanitary Sewer Easement located at 5535 Calder Avenue — Resolution 11 - 156 Councilmember Coleman made a motion to approve the Consent Agenda. Mayor Pro Tern Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM PATE, COUNCILMEMBERS COLEMAN, WRIGHT, SAMUEL AND SMITH NAYS: NONE MOTION PASSED Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. GENERAL BUSINESS 1. Consider approving a three-year contract for grounds maintenance and litter removal for the Central Business District. (Tabled) Minutes—May 17,2011 COUNCILMEMBER COMMENTS COUNCILMEMBER SMITH - CONGRATULATED EVERYONE ON THEIR VICTORY FROM SATURDAY'S ELECTION, ANNOUNCED A PAINT-A-THON ON SATURDAY, MAY 21, 2011, HOUSES HAVE BEEN SELECTED TO BE CLEANED AND PAINTED, THE PAINT-A-THON WILL START AT 8:30 A.M., BISD WILL PROVIDE LUNCH FOR EVERYONE,ALSO COMMENTED ON A MEETING HE ATTENDED REGARDING THE UNITED STATES POSTAL SERVICE, A FEASIBILITY STUDY HAS BEEN DONE AND THERE IS TALK ABOUT RELOCATING SOME OF THE PROCESSING TO NORTH HOUSTON WHICH WILL AFFECT ABOUT 25 JOBS HERE IN BEAUMONT COUNCILMEMBER SAMUEL- THANKED EVERYONE FOR THEIR SUPPORT ON SATURDAY'S ELECTION, ALL OF THOSE WHO DIDN'T HE HOPES TO EARN THEIR SUPPORT IN THE FUTURE,ALSO JOINED THE MAYOR IN CONGRATULATING PASTOR BENOIT AND HIS CHURCH ON THE OPENING OF THEIR NEW FACILITY, ALSO HAD THE OPPORTUNITY OF JOINING IN ON THE CELEBRATION OF THE NEW OPENING OF THE CHURCH FACILITY FOR HARVEST OF LOST SOULS, COMMENTED ON THE HOG RALLY AND THEIR SUCCESS MAYOR PRO TEM PATE - THANKED ALL OF THE CITIZENS THAT GOT INVOLVED, VOTERS AND PARTICIPANTS IN LAST SATURDAY'S ELECTION, IT IS AN HONOR AND A PRIVILEGE TO REPRESENT ALL OF THE CITIZENS IN THE CITY AS AN AT-LARGE MEMBER, CONGRATULATED THE MAYOR, NOT EVERYONE GETS A SENATE RESOLUTION COUNCILMEMBER WRIGHT - THANKED EVERYONE THAT TOOK PART IN THE ELECTORAL PROCESS, THANKED THEM FOR RE-ELECTING HER TO COUNCIL, LOOKS FORWARD TO SERVING THEM ALL AND DON'T HESITATE TO CALL HER, SHE WILL ANSWER, GAVE CONDOLENCES TO THE FAMILY OF JUDGE BRITT PLUNK ON HIS PASSING, THANKED TIM OCNASCHEK AND DANA MELANCON FOR THE HURRICANE AWARENESS PROGRAM, HURRICANE SEASON IS JUST AROUND THE CORNER, COMMENTED ON THE UNITED STATES POSTAL SERVICE, STATED THAT CONGRESSMAN TED POE WILL BE AT THE SOUTH EAST TEXAS REGIONAL PLANNING COMMISSION FOR A MEET AND GREET ON THURSDAY,MAY 19,2011 AT 11:30 A.M., HE WILL BE ASKED TO INTERVENE FOR THE CITY ON BEHALF OF THE POSTAL SERVICE COUNCILMEMBER COLEMAN - THANKED THE VOTERS THAT CAST VOTES IN SATURDAY'S ELECTION, CONGRATULATED EMS FOR ALL OF THEIR HARD WORK, CONGRATULATED KEVIN KEATING ON HIS EAGLE Minutes—May 17,2011 SCOUT AWARD,ASKED THAT EVERYONE KEEP PASTOR PAM BESSER,WHO IS FIGHTING CANCER, LIFTED IN PRAYER CITY ATTORNEY COOPER- CONGRATULATED MAYORAND COUNCIL ON THEIR WIN FROM SATURDAY'S ELECTION AS WELL AS 000NCILMEMBER- ELECT MIKE GETZ CITY MANAGER HAYES - INTRODUCED A NEW INTERN, DOUG PRUITT, HE JUST FINISHED HIS SOPHOMORE YEAR AT LAMAR UNIVERSITY IN MARKETING, HE WILL BE WORKING WITH THE CITY ON A PART TIME BASIS IN SEVERAL DEPARTMENTS INCLUDING THE EXECUTIVE OFFICE MAYOR AMES - WELCOMED FORMER MAYOR DAVID MOORE,THANKED ALL OF THE CITIZENS THAT RE-ELECTED HER BACK INTO OFFICE, ALSO CONGRATULATED ALL OF COUNCIL THAT WAS RE- ELECTED AS WELL AS COUNCILMEMBER-ELECT MIKE GETZ, COMMENTED ON THE POLICE OFFICER MEMORIAL,THE HOG RALLY, RELAY FOR LIFE,AND THE SOAP BOX DERBY ALSO THANKED SAMPSON LONE STAR LLC,ON SATURDAY, MAY 14,2011 THEY DEDICATED 38 SHADED STRUCTURES AT THE GULF TERRACE HIKE AND BIKE TRAIL Public Comments (Persons are limited to three minutes) Louis Vaughn 9615 Mapes St. Beaumont TX Congratulated all Councilmembers thatwere re-elected as well as Ward II Councilmember- Elect Mike Getz, also recognized Ms. Tina Broussard who did an excellent job with election preparations, also asked that she be compensated with a raise, also glad that he was a part of the election process and had an opportunity to speak with others involved, stated there needs to be more communication between everyone Bruce Hoffer 2535 North St. Beaumont TX Congratulated everyone that has returned to Council, also congratulated Councilmember- Elect Mike Getz who will represent Ward II, commented on youth and adult soccer as well as the Mexican League, there is still time to sign up for anyone that is interested Open session of meeting recessed at 2:29 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Robert F.
