Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont,Texas,met in a regular session on October 5,2010 at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 10:00 a.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 10:00 a.m. Present at the meeting were Mayor Ames, Mayor Pro Tern Pate, Councilmembers Beaulieu, Coleman,Wright,Samuel and Smith. Also present were Kyle Hayes,City Manager;Tyrone Cooper, City Attorney;Tina Broussard, City Clerk; Laura Clark, Chief Financial Officer; Patrick Donart, City Engineer. WORK SESSION -The following items to be discussed: • Capital Program for Fiscal Years 2011-2015 • Funding for Various Projects Identified in the Capital Program for Fiscal Years 2011- 2015 • Closing comments by the City Council RECESS RECONVENE at 1:30 P.M. in Council Chambers Mayor Ames reconvened the council meeting to order at 1:30 p.m. Councilmember Beaulieu gave the invocation. Councilmember Samuel led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Minutes-October 05,2010 Present at the meeting were MayorAmes, Mayor Pro Tern Pate,Councilmembers Beaulieu,Wright, Samuel and Smith. Absent: Councilmember Coleman. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Red, White & You Homecoming Week" - October 3 - 9, 2010 - Proclamation read by Mayor Ames; accepted by Dr. Jimmy Simmons with cheerleaders, band and staff "National Breast Cancer Awareness Month" - October, 2010 - Proclamation read by Councilmember Beaulieu; accepted by representatives from the "Gift of Life" Program "Fire Prevention Week"-October 3-9,2010-Proclamation read by Councilmember Smith; accepted by Fire Chief Anne Huff and Fir Marshal Jack Maddox, Beaumont Fire Department "National Arts and Humanities Month" - October, 2010 - Proclamation ready by Councilmember Samuel; accepted by Sue Bard, Executive Director, Southeast Texas Arts Council "National Domestic Violence Awareness Month" -October, 2010- Proclamation ready by Councilmember Wright;accepted by Misty Craver,Jefferson County Victims Assistance Center Public Comment: Persons may speak on Consent Agenda. Frank Kiefer 3190 Willowood Dr. Beaumont, TX Spoke in regards to item B on the Consent Agenda,ask that Council consider replacing the generators with natural gas rather than gasoline, natural gas is an ample supply doesn't get cut off in a storm and relatively cheap opposed to gasoline CONSENT AGENDA Approval of minutes - September 28, 2010 Confirmation of committee appointments - None A) Approve the purchase of air conditioning condensing units for City Hall-Resolution 10-255 B) Approve a change order to increase the Wastewater Treatment Plant Emergency Generators Project - Resolution 10 - 256 C) Authorize the City Manager to execute all documents necessary to accept the project titled"FY 2011 Safety Traffic Enforcement Program (S.T.E.P.) Waves" - Resolution 10 - 257 D) Approve the renewal of an annual maintenance agreement for software support-Resolution 10 - 258 Page 2 of 4 Minutes-October 05,2010 Mayor Pro Tern Pate made a motion to approve the Consent Agenda. Councilmember Beaulieu seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM PATE, COUNCILMEMBERS BEAULIEU, WRIGHT, SAMUEL AND SMITH NAYS: NONE MOTION PASSED COUNCILMEMBER COMMENTS COUNCILMEMBER SMITH- LOOKS FORWARD TO SEEING EVERYONE AT THE FOOTBALL GAME TO SHOW THEIR SUPPORT"Go LU" COUNCILMEMBER SAMUEL- GET YOUR RED ON MAYOR PRO TEM PATE- ENCOURAGED BUSINESSES ON CALDER TO GET IN TOUCH WITH DANIELLE UNDERFERTH, CITY OF BEAUMONT'S COMMUNICATIONS MANAGER, IN REGARDS TO A CALDER BLOCK PARTY TO BE HELD ON OCTOBER 14, 2010 FROM 5:00 P.M.TO 8:00 P.M., TO CELEBRATE THE COMPLETION OF PHASE I & II, THERE WILL BE BOOTHS SETUP ALONG WITH BANDS, ENCOURAGED EVERYONE TO ATTEND COUNCILMEMBER WRIGHT- RECOGNIZED ALL OF THE PROCLAMATIONS THAT WERE GIVEN OUT, DOMESTIC VIOLENCE, NATIONAL BREAST CANCER AWARENESS,FIRE PREVENTION WEEK,NATIONAL ARTS AND HUMANITIES MONTH AND LAMAR, THANKED THEM ALL FOR WHAT THEY DO FOR THE CITY AND THE CITY WANTS TO SUPPORT ALL OF THEM COUNCILMEMBER BEAULIEU- ENCOURAGED EVERYONE TO ATTEND LAMAR UNIVERSITY'S FOOTBALL GAMES, THANKED THE BRICKYARD NEIGHBORHOOD ASSOCIATION FOR LETTING HER VISIT WITH THEM AT THEIR MEETING,ALSO THANKED ALL OF THE VOLUNTEERS THAT PUT IN SO MUCH TIME FOR OTHERS, IN THE ABSENCE OF COUNCILMEMBER COLEMAN, COUNCILMEMBER BEAULIEU RECOGNIZED KOLIN EDWARD GLIDDEN FOR HIS ACHIEVEMENTS AND SERVICES, THIS RECOGNITION WILL BE PRESENTED To KOLIN AT HIS EAGLE COURT OF HONOR ON OCTOBER 9, 2010 AT WEST END BAPTIST CHURCH COUNCILMEMBER COLEMAN - ABSENT Page 3 of 4 Minutes-October 05,2010 CITY ATTORNEY COOPER- NONE CITY MANAGER HAYES - NONE MAYOR AMES- COMMENTED ON SEVERAL EVENTS OCCURRING THIS WEEKEND,OCTOBERFEST,LAMAR UNIVERSITY FOOTBALL, AND THE ELK LODGE'S BAR-B-Q COOK OFF FOR VETERANS,ALSO COMMENTED ON THE AMERICAN CANCER SOCIETY WHO HAD THEIR FIRST BARK FOR LIFE, WHICH HAD ABOUT 120 TO 130 DOGS IN ATTENDANCE Public Comments (Persons are limited to three minutes) Frank Kiefer 3190 Willowood Dr. Beaumont TX Asked if anyone has compared the cost of the new CNG powered busses to the old diesel busses, or investigated the monetary cost of operating a CNG bus as to what was required for the diesel, does not want the ozone layer increased, the CNG will effectively reduce the ozone layer in this area Open session of meeting recessed at 2:18 p.m. EXECUTIVE SESSION - Cancelled Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: City of Beaumont v.
