HomeMy WebLinkAboutORD 10-072 ORDINANCE NO. 10-072 ENTITLED AN ORDINANCE OVERTURNING THE DECISION OF THE HISTORIC LANDMARK COMMISSION TO DENY AN APPLICATION FOR A CERTIFICATE OF APPROPRIATENESS TO DEMOLISH THE PROPERTY LOCATED AT 2185 SOUTH STREET, BEAUMONT, TEXAS, AND APPROVING SAID APPLICATION. WHEREAS, on July 13, 2010, Dorothy Marshall applied to the Historic Landmark Commission fora Certificate of Appropriateness to demolish a house at 2185 South Street, Beaumont, Texas; and WHEREAS, on August 16 and 26, 2010, the Historic Landmark Commission conducted two (2) public hearings to consider the application for the Certificate of Appropriateness; and WHEREAS, at the conclusion of the public hearings, the Historic Landmark Commission voted 9:0 and 4:3 respectively to deny the request for demolition of the house at 2185 South Street; and WHEREAS, Section 30-21.2(h)6 of the Code of Ordinances of the City of Beaumont gives the applicant the right to appeal to the City Council a decision of the Historic Landmark Commission to deny a Certificate of Appropriateness; and WHEREAS, Dorothy Marshall has timely appealed the decision to deny her request for a Certificate of Appropriateness; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT after considering the evidence and testimony of the witnesses, the City Council hereby finds and declares that the decision of the Historic Landmark Commission to deny the application of Dorothy Marshall for a Certificate of Appropriateness to demolish the property at 2185 South Street, Beaumont, Texas, should be overturned. BE IT FURTHER ORDAINED THAT the application of Dorothy Marshall for a Certificate of Appropriateness to demolish the property at 2185 South Street, Beaumont, Texas, is hereby approved.
